Partindo do método marxiano, Pachukanis resgata do interior de O Capital a trama complexa que permite estabelecer o estreito vínculo entre a forma mercantil e a forma jurídica, sob a determinação em última instância das relações de produção. Em decorrência, Pachukanis sustenta a impossibilidade teórica de um direito "socialista" e pensa as condições de possibilidade da extinção da forma jurídica na sociedade de transição. O abandono de suas posições primevas, nos anos 30, apenas é o índice de que, fora da problemática aberta por Pachukanis em seus trabalhos originários, se impõe de modo necessário o retomo a uma concepção burguesa do direito / Abstract: The analysis of the work of Pachukanis reveals the deep connection between Marx's critique of political economy and the critique of law. Departing from the Marxian method, Pachukanis finds inside The Capital the complex elements which permit the establishment of the dose link between the commodity form and the legal form, under the ultimate determination of relations of production. As a consequence, Pachukanis affirms the theoretical impossibility of a "socialist" law and posits the conditions which would enable the withering away of the legal form in the transition society. The abandonment of Pachukanis's former positions, in the thirties, is only the sign that, outside the problematic initiated by Pachukanis in his first works, there is the necessary imposition of a retum to a bourgeois concept of law / Doutorado / Doutor em Filosofia
