L’Europe du droit constitue une réalité. Europe des libertés économiques et de circulation, des droits de l’Homme, désormais elle se révèle également Europe du droit civil. En s’inscrivant dans le phénomène plus général l’européanisation du droit civil des États membres, l’intégration juridique européenne tend à la construction d’un espace civil européen. Ce constat conduit à s’interroger sur la structure de cet espace. Si la tendance actuelle est à favoriser une structure substantielle, il n’en demeure pas moins que la démarche processuelle pourrait être exploitée, voire être privilégiée. Ainsi, liée aux questions de méthodes, la construction de l’espace civil européen s’analyse classiquement en termes de rapprochement des droits substantiels. Mais la structure, en ce qu’elle raisonne en termes d’agencement entre eux des éléments constitutifs d’un ensemble ne peut être exclusivement substantielle. L’étude se propose ainsi d’aborder l’espace civil européen à travers le droit processuel civil de l’Union européenne. Ce dernier, en constante consolidation, semble pouvoir révéler cet espace civil en ce qu’il permet la réalisation et la coordination des droits civils au sein de l’espace judiciaire européen. / Europe of law is a reality. From economic liberties, freedoms of movement and human rights, now Europe is also developing in the field of civil law. Within the movement of Europeanization of Member States civil law, European judicial integration contributes to the construction of a European civil area. This observation leads to wonder about the structure of such area. While the actual trend is to promote a substantive structure, the procedural approach could also be explored, and even preferred. Classically, due to methodological issues, the European civil area construction is studied through approximation of substantive laws. However, the structure may not be entirely based on substance, especially since the area is constituted of different aggregated elements, which interact altogether. This study aims to analyse the European civil area also through European Union civil procedural law. Being in constant consolidation, the latter seems to be able to reveal the civil area as it allows to fulfil and to coordinate civil laws within the European judicial area.
