"voorskryf" in te sluit. Die vermoedens, wat die Wetgewer in die Wet
ingebou het om die taak van die vervolging te vergemakl ik, sowel as die
voorverelstes vir die inwerkingstel I ing daarvan, word bespreek. Verbode
Afhankl ikheidsvormende medisyne word gelys in Deel I in die Bylae tot die
Wet en die strekking van die bewyslas op die vervolging word bespreek.
Geen statut~re regverdigingsgronde word geskep nie, maar die gemeenregtel
ike regverdigingsgronde behoort hier aanwending te vind. Opset blyk die
vereiste skuldvorm te wees. Wet 101 van 1965 en Wet 41 van 1971 oorvleuel

geniet. / The law with regard to the dependance-producing drugs is governed by the
Act on the Misuse of Dependence-producing drugs. The Act distinguishes
between three types of dependence-producing drugs and the work focuses
only on prohibited dependence-producing drugs. The lawmaker gave extended
interpretation to the term" dealing in" to include aspects Iike the
transfer from one vehicle to another, administering, dispatching and
prescription. Certain presumptions which Iighten the burden of proof on
the prosecution were introduced in the act and the prerequisites for their
operation are discussed. No statutory defences are created but it is
submitted that common law defences should apply. Intention is set down to
constitute the required mens areas. Act 101 of 1965 and Act 41 of 1971
overlap on certain aspects where sections are in conflict with each other,

The original publication is available at http://www.samj.org.za / The March 2011 Anti-Substance Abuse Summit in Durban
continued the outdated approach to policy around illicit drugs
in South Africa. It missed opportunities for discussing how to
impact significantly on the health and social harms associated with
problematic drug use and reduce the burden of drug-related cases
in the criminal justice system. The government needs to move
away from the political rhetoric of a ‘drug-free society’ and start
the real work of formulating and implementing an evidence-based
drug policy that learns from the experiences of other countries
around decriminalising drug use; takes into account differences
in the harms resulting from different classes of drugs; adopts a
rights-based, public health approach to policy; and identifies a
single (accountable) agency that has the authority to oversee policy
implementation. In addition, consensus is needed on the short-,
medium- and long-term priorities for drug policy implementation.
The 17 evidence-based drug policy strategies identified by Babor
et al. may serve as a useful starting point for policy development.

A research report submitted to the Faculty of Humanities, University of the Witwatersrand, Johannesburg, in partial fulfilment of the requirements for the degree of Master of Arts (International Relations), 2017 / The trafficking of illegal narcotics on the African continent and into West Africa has resulted
in human insecurity and state insecurity in the region. Furthermore, it has helped facilitate
shadow economies such as the illegal trade in fire arms and human trafficking within the region
deteriorating law and order, judicial enforcement, and political institutions in these countries.
The West African region serves as a transit point in the distribution of narcotics to Europe from
Latin America and has increasingly become a destination in drug trafficking.
Various national, regional, and international strategies have been undertaken in combating this
perceived scourge. The African Union, European Union, United Nations, and West African
states themselves have all provided frameworks in combating drug trafficking in Africa.
Despite these various strategies drug trafficking still thrives in West Africa. This thesis will
assess one of these strategies that being the West African Coast Initiative (WACI). This thesis
attempts to outline the various reasons for the growing importance of West Africa in the
regional and international drug trade whilst assessing the impact WACI has had in dealing with
the drug trade in West Africa.
The reason the paper seeks to assess the effectiveness of the West African Coast Initiative is to
highlight the obstacles and challenges the strategy has faced over the last eight years of its
existence, to make recommendations in this regard, and to identify specific shortcomings in
African institutional efforts in engaging with threats that exist outside the state / XL2018

On July 1, 1994, Taiwan¡¦s Executive Yuan ratified and determined the Ministry of Justice would dispatch personnel from drug enforcement related units and the Taiwanese High Prosecutor¡¦s Office would establish a ¡§Drug Enforcement Unit.¡¨ Each District Prosecutor¡¦s Office established an ¡§executive drug enforcement unit¡¨ and attempts were made to resolve problems arising from drug enforcement units being subsumed under different units. However, at present drug enforcement still suffers from the problem of various actors vying for jurisdiction over various matters related to drug enforcement. In addition, no national database for drug enforcement, has, as yet, been established, making it more difficult to solve drug related criminal cases. The drug related units of various government organs lack horizontal lines of communication, thus leading to wasted cooperative resources when dealing with international organs. That is why a study of drug enforcement responsible authorities has been an important and pressing issue.
This thesis will discuss cross-national drug enforcement institutions in the United States based on exploring their social, political, economic background, to consider the provisions of international drug trends, and reference to the U.S. Drug Enforcement Administration of manpower, budget , training and other mechanisms so on, and provide future scholars and explore the practical possibility of development of anti-drug system. It will be expected to let our drug enforcement work more effective and reduce the spread of drugs in our country by researching U.S. law enforcement cooperation model.
