This diploma thesis deals with the employer's liability for damages caused by work-related accidents or occupational diseases of his employees. The reason for choosing this topic was partly because of the author's experience with the assessment of work-related accidents in legal proceedings, partly due to the high- frequency of work-related accidents and also the fact, the results of work-related accidents and occupational diseases not rarely cause a long-term adverse repercussion in real life of an employee. The main point of this thesis is to analyse elements of stated employer's liability for damages. Using the case law, detailed analysis of the concept of work- related accidents is performed in the same chapter. There are analysed specific situations with conclusions if the injury can be evaluated as an work-related accident or not. Besides work-related accidents, occupational diseases and other elements of liability, this chapter deals with the possibility of an employer to be absolved from any liability as well. Case law concerning the absolution from liability is also included in this chapter. Darbuotojo sveikatai padarytos žalos atlyginimo garantijos yra susijusios ne tik su darbdavio pareigos sudaryti darbuotojams saugias ir sveikas darbo sąlygas pažeidimu ir jo materialine atsakomybe, bet ir visuomenės interesu garantuoti socialinę apsaugą žalą sveikatai patyrusiems asmenims. Darbuotojo sveikatai padaryta žala atlyginama taikant darbdavio materialinę atsakomybę ir nelaimingų atsitikimų darbe ir profesinių ligų socialinio draudimo kompensacijas. Šie žalos kompensavimo būdai turėtų užtikrinti realų, visišką ir teisingą žalos atlyginimą, tačiau Lietuvoje iki šiol nėra tokių žalos kompensavimo būdų sąveikos koncepcijos. Todėl šio tyrimo objektas yra darbuotojo sveikatai padarytos žalos atlyginimas darbdavio materialinės atsakomybės ir nelaimingų atsitikimų darbe ir profesinių ligų socialinio draudimo būdu. Tyrimo tikslas - atskleisti sisteminius - funkcinius ryšius tarp darbdavio atsakomybės ir darbuotojo sveikatai padarytos žalos kompensavimo nelaimingų atsitikimų darbe ir profesinių ligų socialinio draudimo būdu ir apibrėžti šių žalos kompensavimo būdų sąveiką Lietuvoje. [toliau žr. visą tekstą] / Guarantees of the compensation for the damage caused to employee's health are related not only with the breach of employer's duty to provide employees with secure and health working conditions and his/her pecuniary liability but also with the interest of society to ensure social security to the person who experienced the damage. The damage caused to employee's health is compensated by bringing the proceedings against employer's liability as well as applying social insurance against accidents at work and occupational diseases. These types of redress should guarantee concrete, full and fair compensation for the damage. However, in Lithuania there is no conception of interaction between these types of compensation so far. I have decided to devote my thesis to the topic of "Liability for damage regarding occupational accidents and illness". I consider this problem as very actual, especially regarding currently held debates on particular ways how the damages should be paid in order to compensate a work injury or an occupational disease. As a whole, the work is divided into eight chapters and their sub-chapters. The first two chapters consist of a general introduction into the topic. The very first of them focuses on the importance of employees' health protection (the importance of prevention) and tackles some questions of safety and health protection at work. The second chapter sheds light the concept of duty in law in general and in labour law in order to create a general picture of the problem of damages duty of work injuries and occupational diseases. The major part of my work is devoted to the currently used legislation on damages of work injuries and occupational diseases, which is however understood as temporary and thus is included in provisional law enactments no. 262/2006 Coll. of the Labour Law Code.
