The topic of the thesis is to analyse the employment relationships with a foreign component. Firstly, the thesis focuses on the employment of citizens of the Union within the territory of the EU countries and the rights of these workers. The next chapter provides an outline of the third-country nationals and concentrates on problems arising for the long-term residents who require staying in one of the EU countries for a longer period. Eventually, the last chapter of the thesis deals with the legislation in the Czech Republic which differentiates between the nationals of the EU and other (third-country) nationals. The purpose of this thesis is to provide an overview of the legal regulation of employment of foreign workers within the European Union and the Czech Republic.

SANTRAUKA Kiekviena valstybės, tame tarpe ir Lietuvos Respublika, yra suinteresuota reguliuoti užsieniečių darbą savo teritorijoje, siekiant, visų pirma, apsaugoti savo vidinę darbo rinką, iš kitos pusės, pripažįstant užsieniečių teisę į darbą ir vykdant prisiimtus pagal tarptautinius teisės aktus įsipareigojimus, garantuoti galimybę dirbti jos teritorijoje bei užtikrinti tinkamas darbo sąlygas. Atsižvelgiant į aktualijas, pastaruoju metu įvyko ne mažai reikšmingų pasikeitimų, įtvirtinant diferencijuotą užsieniečių darbo teisinį reguliavimą. Šiame darbe yra pateikiama sisteminė užsieniečių iš Europos Sąjungos ir trečiųjų valstybių įdarbinimo ir darbo Lietuvoje teisinio reguliavimo analizė. Buvo stengiamasi išryškinti darbo sutarties su užsieniečiu sudarymo, vykdymo ir nutraukimo teisinio reguliavimo specifiką. Darbe yra nagrinėjamas ne tik įsidarbinusių pagal darbo sutartį Lietuvoje, bet ir atsiųstų laikinai dirbti į Lietuvos teritoriją darbuotojų darbo teisinis reguliavimas, siekiant atkreipti dėmesį į komandiruojamų darbuotojų darbo Lietuvoje reguliavimo ypatumus, privalumus ir trūkumus. Atliekant tyrimą, buvo analizuojami galiojantys ir planuojami priimti Lietuvos Respublikos ir Bendrijos teisės aktai, dėstomos teisės mokslo atstovų nuomonės, išryškinami probleminiai užsieniečių darbo teisinio reguliavimo klausimai bei pateikiami galimi jų sprendimo būdai. / SUMMARY Every State, including Lithuania, is concerned with the legal regulation of work of foreigners, first of all, in order to protect its inner labour market, on the other hand, to guarantee an opportunity to work on its territory and proper conditions of work, while recognizing the right to work and carrying out of the obligations accepted on the basis of the international documents. Lately many changes of legal regulation have taken place and various legal acts are being planed to accept, which provide for the differentiated legal regulation of employment and work conditions of foreigners, coming from European Union and third countries. This work, first of all, presents the analysis of legal regulation of work, based on the employment contracts. The purpose was to determine the peculiarities of employment of foreigners, the execution of the employment contracts and their termination. Besides that, this work also presents the analysis of legal regulation of work of temporary posted workers, aimed at determining the specific regulation of such king of work and exposing some of the positive sides and the shortcomings of national regulation. The aim of this diploma thesis is to analyze the Czech labor market and assess whether there is manpower for the group AGROFERT. Furthermore to analyze foreign markets and identify potential foreign workers. Based on the analysis and theoretical knowledge of agency employment to assess whether an internal labor agency for the group AGROFERT would help solve the current problem - a shortage of workers. The thesis is divided into 2 parts - theoretical and practical. The theoretical part defines basic background of labor markets and an explanation of key concepts in the issue of agency employment and employment of foreign nationals. The conclusion summarizes the results of the analysis and proposals of measures that could improve the current situation.

The topic of this diploma thesis is legal and illegal work of foreigners in Czech Republic. Both legal and illegal work are related to the performance of dependent work. Therefore, the thesis begins with the definition of this term when the author describes the individual characters of dependent work stipulated not only by the law but also by applicable case law. At the end of the first part, several tests of employment which are helpful for the identification of the performance of dependent work are explained. The second part is devoted to the conditions of foreigners' stay and employment in the Czech Republic, divided into two groups of foreigners. Firstly, the citizens of the EU, EEA and Switzerland and their family members, especially regarding the free movement of workes stipulated by the Treaty on the Functioning of the European Union and the topic of posting workers in the context of the transnational provision of services. 1 Agency employment with a cross-border element Abstract The topic of this diploma thesis is agency employment with a cross-border element. Employment agencies cover the shortage of workers on the Czech labor market by assigning foreigners to users. The thesis analyzes this process of agency employment of foreigners, by connecting the institutes of agency employment and employment of foreigners. In its introductory chapter, this thesis briefly describes and analyzes the institute of agency employment, focusing primarily on the requirements necessary to obtain a permission for agency employment and on comparable working and wage conditions. Furthermore, this work deals with the cross-border element of agency employment, where the second chapter analyzes in detail the process of agency employment of foreigners, both citizens of other Member States of the European Union and especially foreigners from third countries. Based on this analysis, the content of the second chapter is also a comparison of the legal status of Czech nationals, citizens from other Member States of the European Union and foreigners from third countries in the framework of agency employment. The subject of this diploma thesis is to characterize the requirements on legal stay of foreign employees in the Czech Republic, their employment and recognition of their qualification. Topics found in the literature and associated to international migration of employees in medical facilities, topics associated to their legal stay in the Czech Republic, rules of employing them and rules of recognition of their qualification are described in theoretical part of my diploma thesis. The main goal of the practical part is to find out what is the state in 2 medical facilities which took part in my research. And to compare them from the perspective of their quality, according to the structure of all professions and work adjustment of foreign employees. The dissertation thesis is aimed at actual topic of the international labour migration and working foreigners in the Czech Republic during the period of the global economical crisis of 2008 and 2012. It is an empirical research that comes out from the qualitative and quantitative study of the topic. The subject of the research were working foreigners. We differ foreigners in the position of employees and businessmen as well as foreigners from the European Economic Area and Switzerland and so called third countries. In the work we also focus on the statistical data both from their availability and interpretation point of view and also from the volume of flows of international labour migration and the stock of working foreigners in the Czech Republic. Selected indicators were also used to study spatial distribution of working foreigners in the Czech Republic including its factors from political, social, economic, geographic, demographic or cultural areas. The study was carried out by applying qualitative and quantitative correlation and regression analyses. In this respect we focused also on the discussion of the relevancy of statistical data from areas specified above that may help to clarify the structure of the spatial distribution of working foreigners. The main goal of this final thesis is the analysis of the immigrant's position on the labor market in the Czech Republic and in Germany. For this purpose the thesis makes a research of particular factors and barriers which immigrants have to deal with on the labor market and define their direct effects. Furthermore, the thesis focuses on the integration policy of both countries. Based on performed analysis in the field of immigration and integration the author of the thesis makes a comparison of the attitudes of both countries towards the immigrants with the aim to set up fitting measures for improvement of the immigrant's situation on the Czech labor market. The thesis is divided into theoretical and analytical part. The theoretical part is focused on theoretical solutions in the field of migration, migration policy, integration and discrimination. The aim of the degree work was to chart the labour market in Ceské Budejovice district in relation to foreign countries and to specify the influences on the development of legal employment of foreigners in Ceské Budejovice district, who had been granted a work permit in last 5 years, and the impact on unemployment in Ceské Budejovice district. It also charts the influence of EU entry and its impact on the outflow of workers from the labour market in Ceské Budejovice district. The main aim is to analyze the examined region and the labour market with regard to professions demanded by the employers. It is about how this affects the legal employment of the foreigners. A comparison of Ceské Budejovice employment agency{\crq}s statistics from the years 2003 {--} 2007 and the surveys, done via questionnaire enquiries, at employers (companies) in Ceské Budejovice who employ foreigners or have the intention to employ foreigners, was made. For purpose of cross-border employing of citizens of the Czech Republic via the employees of the employment agency in Ceské Budejovice arranged a contact with an employee of the given agency Arbeitsmarketservice Freistadt, where we talked about questions concerning the way of employing people from abroad, especially the Czech Republic. Further on an analysis of the questionnaire enquiries and the statistical data assigned by the employment agency was made. The results of the questionnaire enquiries were passed on to the employment agency in Ceské Budejovice for further possible use.
