This Thesis needs a theory that supports it. To get to it, I raise some of the issues that this sketch of theory will deal with, after an exposition of the thoughts of Carr, Morgenthau and Waltz, relevant thinkers of the realist school of I.R.I consider the limits that their theories have in order to address the problems proposed by themselves, in the perspective of Carr's bargains of power, Morgenthau's problems brought by the ethics of different nationalisms, the three images of Waltz, as well as the limits of his systemic theory. I understand that there are three realist obstacles to stability and international cooperation: those arising from the attempt to universalize national values, the struggle for power and concerns with relative power. Since international actors can recognize that cooperation can bring greater benefits than the non-cooperation, they may seek a scenario where cooperation can occur with greater security. To this end, a solution to the first obstacle, like the one I propose, can minimize the magnitude of the other two. To propose such solution I make use of the concepts of overlapping consensus and reflective equilibrium in a way similar to the one they appear in John Rawls' Justice as Fairness. I give my theory the name of Legitimacy as Fairness and establish as temporary fixed point the values of International Jus Cogens. I establish a virtue correlative to Aristotelian prudence for international agents and I divide the Legitimacy as Fairness in a preliminary stage and an institutional stage. I defend the use of reflective equilibrium in Legitimacy as Fairness against its major objections, ensuring its validity. The Thesis proposed, when supported by a theory like the Legitimacy as Fairness, is justified. / Proponho a Tese de que a estabilidade oferecida pela busca de um consenso sobreposto (moral) de Estados, que se procura atingir pelo m?todo do equilibrio reflexivo, ? mais eficiente do que a baseada em um equilibrio de poder ou a??es prudenciais e pode ser alcan?ada com mais facilidade do que a cria??o de uma institui??o internacional com uso exclusivo da for?a. Tal Tese precisa de uma teoria que lhe d? suporte. Para chegar a ela levanto alguns dos problemas que esse esbo?o de teoria ir? tratar ap?s uma exposi??o do pensamento de Carr, Morgenthau e Waltz, relevantes pensadores da escola realista das R.I. S?o considerados os limites que suas teorias possuem para dar conta das quest?es que prop?em, dentro da perspectiva das barganhas de poder de Carr, dos problemas trazidos pelas ?ticas de diferentes nacionalismos de Morgenthau, das tr?s imagens de Waltz bem como dos limites da teoria sist?mica. Entendo que s?o tr?s os obst?culos realistas para a estabilidade e coopera??o internacionais: aqueles advindos da tentativa de universalizar valores nacionais, a disputa pelo poder e as preocupa??es com poder relativo. Uma vez que agentes internacionais reconhecem que a coopera??o pode trazer maiores benef?cios que a n?o-coopera??o eles podem buscar um cen?rio em que a coopera??o ocorra com maior seguran?a. Para esse fim, uma solu??o para o primeiro obst?culo, como a que proponho, pode diminuir a relev?ncia dos outros dois. Para propor tal solu??o fa?o uso dos conceitos de consenso sobreposto e do equilibrio reflexivo de maneira an?loga ?quela como eles aparecem na Justi?a como Equidade de John Rawls. Dou ? minha teoria o nome de Legitimidade como Equidade e estabele?o como ponto fixo provis?rio os valores do Jus Cogens Internacional. Estabele?o uma virtude correlata ? prud?ncia aristot?lica para os agentes internacionais e divido a Legitimidade como Equidade em uma fase preliminar e outra institucional. Defendo o uso do equilibrio reflexivo na Legitimidade como Equidade contra suas principais obje??es, garantindo sua validade. A Tese proposta, quando respaldada por uma teoria como a Legitimidade como Equidade, se justifica.
