The analysis undertaken is given in order to overcome the paradigm radically anthropocentric, said the three knowledge areas (criminal law, bioethics and philosophy), but with maintaining the idea of a criminal law, onto-anthropological view, (re) conducted constitutionally imposed limits. Search, in this context, the use of non-maleficence bioethics principle as a criterion of offensiveness, both as in crimes against fauna. The subject of the thesis is tightly linked with following research content: Contemporary criminal legal system, specialization area: Criminal System and violence from Postgraduate Program in Criminal Law at Pontifical Catholic University (Rio Grande do Sul). / A presente investigação, através de um diálogo entre direito penal, filosofia e bioética, busca analisar - de modo interdisciplinar - a tutela jurídico-penal da fauna. A análise empreendida se dá no sentido da superação do paradigma radicalmente antropocêntrico, nas três referidas áreas do conhecimento (direito penal, filosofia e bioética), mas com a manutenção da ideia de um direito penal, de base ontoantropológica, (re)conduzido aos limites constitucionalmente impostos. Busca-se, neste contexto, a utilização do princípio bioético da não-maleficência como critério de ofensividade nos crimes contra fauna. A pesquisa se encontra vinculada à linha de pesquisa: Sistemas Jurídico-penais Contemporâneos, área de concentração: Sistema Penal e Violência, do Programa de Pós-Graduação em Ciências Criminais da PUCRS.
