Žemės naudojimo valstybinės kontrolės organizaciniai ir teisiniai aspektai / Organizational and legal aspects of state control of land use

Norint nustatyti, ar žemė naudojama racionaliai ir tikslingai, vykdoma žemės naudojimo valstybinė kontrolė. Žemės naudojimo valstybine kontrole siekiama užtikrinti, kad valdant ir naudojant žemę, būtų laikomasi Lietuvos Respublikos žemės įstatymo bei kitų įstatymų, kurie susiję su žemės naudojimo priežiūra. Siekiant užtikrinti tinkamą žemės naudojimą, tenka išspręsti nemažai įvairių problemų. Tyrimas atliktas siekiant nustatyti žemės naudojimo valstybinės kontrolės darbų organizavimo problemas, trukdančias pasiekti efektyvų kontrolės vykdymą. Tyrimo metu buvo išanalizuoti žemės naudojimą ir valstybinės kontrolės vykdymą reglamentuojantys teisės aktai, Nacionalinės žemės tarnybos prie Žemės ūkio ministerijos ir Marijampolės apskrities viršininko administracijos Žemės tvarkymo departamento kontrolės vykdymo veiklos ataskaitos. Kylančios problemos vykdant žemės naudojimo valstybinę kontrolę Marijampolės apskrityje nustatytos išanalizavus teisės aktus, jų praktinį taikymą ir kontrolės vykdymo veiklos ataskaitas. Tyrimo metu panaudoti literatūros šaltinių analizės, alternatyvų paieškos, lyginamosios ir vertinamosios analizės ir loginio mąstymo metodai. Nustatyta, kad apskričių viršininkų administracijos vykdoma žemės naudojimo valstybinė kontrolė nėra pakankamai efektyvi ir neskatina taupiai naudoti žemę. Tai paaiškintina pareigūnų kompetencijos trūkumu ir nesureguliuotomis jų funkcijomis – vykdoma kita veikla su kontrole nesusijusiose srityse. Baigiantis žemės reformos darbams... [toliau žr. visą tekstą] / In order to determine whether the land is used rationally and purposefully, state control of land use is performed. By the state control of land use one strives to ensure that while managing and using land, the land law and other laws of the Republic of Lithuania related to land use care are obeyed. In order to ensure the appropriate use of land, one has to solve many different problems. The research was carried out in order to find out the problems of state control of land use that prevent from effective control implementation. During the research one analyzed the use of land and legal acts that regulate state control implementation and control implementation work reports of National Land Service under the Ministry of Agriculture and Marijampole county governor’s administration Land Managing Department. The problems that rise while implementing state control of land use in the county of Marijampole were determined by analyzing legal acts, their practical application and work reports of control implementation. During the research one used the analysis of literature sources, alternative search, comparative and evaluation analyses and methods of logical thinking. It was determined that state control of land use that is performed by county governor’s administration is not quite effective and does not encourage using land economically. Root Exploitation of Fertile Soil Microsites

Root exploitation of enriched soil microsites was examined for the tussock grasses Agropyron desertorum and Agropyron spicatum and the shrub Artemisia tridentata. Two mechanisms of exploitation of the microsites were examined: root proliferation and changes in nutrient uptake capacity. One day after nutrient solution was applied to small soil patches, the mean relative growth rate of Agropyron desertorum roots in enriched patches was two to four times greater than for roots of the same plants in soil patches treated with distilled water. This rapid and striking root proliferation occurred in response to N-P-K enrichment as well as to P or N enrichment alone. Agropyron spicatum showed no tendency to proliferate roots in enriched soil patches during the two-week experiments. The shrub Artemisia tridentata proliferated roots within one day of initial solution injection in the N-enrichment experiment, but root proliferation of this species was more gradual and less consistent in other experiments. The ability of Agropyron desertorum partly explain its to proliferate superior ability roots to rapidly may exploit soil nutrients compared to Agropyron spicatum in Great Basin rangelands of North America. Changes in nutrient uptake capacity in enriched soil patches were also studied for each species. rapid changes in uptake capacity of plant roots Large and from the field were observed after creation of nutrient-rich patches in the soil. Phosphate uptake of excised roots from enriched soil patches was roots of control patches as much as 80% greater than for treated with distilled water. These increases in uptake capacity took place within one week of patch treatment for all three species. A follow-up experiment showed increases within three days of patch treatment. These results showing rapid physiological plasticity in roots exploiting nutrient patches have important implications for nutrient belowground competition among plants.
