This phenomenon is established from the euphemistic discourse that the socio-educational measure is a good to the adolescent in conflict with the law, a form of guarantee of integral protection to this subject, which tends to hide its coercive nature, justifying and legitimizing the control Social, and naturalizing and abstracting violence resulting from this response, which restricts and deprives fundamental rights. Therefore, the research aimed to analyze the relationship between assistance of the socioeducation and the ideals of punishment and protection historically embedded in the conformation of the objectives of the socio-educational measures, seeking to contribute with subsidies for the improvement of the policy of socio-educational assistance. Thus, from this study it was possible to know how the justificatory discourses of the sanction of the State to the infraction acts practiced by adolescents are expressed historically; To analyze how the question of assisting socio-educational measures crosses the justificatory discourses of the sanction of the State to the infractions committed by adolescents; And analyze how to update the question of the assitencialization of socio-educational measures in SINASE and SUAS times. The study was of the theoretical type, of a qualitative nature and based on the dialectical-critical method, using bibliographic research and documentary research techniques as data collection techniques. The interpretation of the data was performed through Discursive Textual Analysis, based on the studies of Roque Moraes. The results of this research point to the persistence of the discourse of social control over socio-educational measures, which has repercussions on the (re) production of past conceptions and practices that violate the human rights of adolescents in conflict with the law. It is concluded that there is a need to address the ambiguities surrounding the conception and objectives of socio-educational measures, and to implement SINASE as an instrument for affirming the human rights of this subject. / Esta tese versa sobre o fen?meno da assistencializa??o da socioeduca??o, o qual se manifesta historicamente sob a ?gide da imbrica??o entre puni??o e prote??o, atravessamentos hist?ricos presentes na conforma??o dos objetivos das medidas socioeducativas. Tal fen?meno se estabelece a partir do discurso eufemista de que a medida socioeducativa ? um bem ao adolescente em conflito com a lei, uma forma de garantia de prote??o integral a esse sujeito, o qual tende a ocultar sua natureza coercitiva, justificando e legitimando o controle social formal sobre o adolescente, e naturalizando e abstraindo a viol?ncia decorrente dessa resposta, a qual restringe e priva direitos fundamentais. Diante disso, a pesquisa se prop?s analisar a rela??o entre assistencializa??o da socioeduca??o e os ideais de puni??o e prote??o historicamente imbricados na conforma??o dos objetivos das medidas socioeducativas, buscando contribuir com subs?dios para o aprimoramento da pol?tica de atendimento socioeducativo. Assim, a partir deste estudo foi poss?vel conhecer como se expressam historicamente os discursos justificat?rios da san??o do Estado aos atos infracionais praticados por adolescentes; analisar como a quest?o da assistencializa??o das medidas socioeducativas atravessa os discursos justificat?rios da san??o do Estado aos atos infracionais praticados por adolescentes; e analisar como se atualiza a quest?o da assitencializa??o das medidas socioeducativas em tempos de SINASE e SUAS. O estudo foi do tipo te?rico, de natureza qualitativa e fundamentado no m?todo dial?tico-cr?tico, utilizando como t?cnicas para a coleta de dados a pesquisa bibliogr?fica e a pesquisa documental. A interpreta??o dos dados foi realizada por meio da An?lise Textual Discursiva, baseada nos estudos de Roque Moraes. Os resultados desta pesquisa apontam a persist?ncia do discurso do controle social sobre as medidas socioeducativas, o qual repercute na (re)produ??o de concep??es e pr?ticas pret?ritas violadoras de direitos humanos do adolescente em conflito com a lei. Conclui-se pela necessidade de enfrentamento ?s ambiguidades que envolvem a concep??o e os objetivos das medidas socioeducativas, e de efetiva??o do SINASE como instrumento de afirma??o de direitos humanos desse sujeito.
