Mimosmluvní instituty užití autorského díla / Non-contractual legal institutions of the use of copyrighted work

This thesis provides an overview of extra-contractual legal institutions of the use of copyrighted work. The main emphasis is on the institution of free use and related topic of private copying and fair compensation. Statutory licenses, both chargeable and free of charge, are not omitted. The thesis is divided into three chapters. Brief introduction is followed by chapter providing definition of the fundamental terms of copyright from the perspective of Czech copyright law. The second chapter contains summary of sources of copyright law. Czech law, as well as European and international law is included. The third chapter contains crutial part of the thesis, the analysis of the extra-contractual legal institutions of the use of copyrighted work. After brief comment on free works follows analysis of the Three-Step Test, which is of great significance for all examined legal institutions. Relevant case law - WTO Panel report WT/DS160/R - is examined and the Max Planck Institute's Declaration on a balanced Interpretation of the Three-Step Test is also considered. Subsequent subchapters are dedicated to the institutions of free use and private copying under both, Czech and European copyright law. - ENGLISH The content of this thesis is aimed towards the interpretation of the so-called non- contractual legal institutions of the use of copyrighted work. These institutions represent such legal tools, that exceptionally allow individuals different from the author to exploit copyrighted work with no dependence on the author's permission or will. The text of the work is divided into four main chapters. For introduction into the matter, the opening part is dedicated to the explanation of the term copyright law, its position in the Czech legal system and the main principles it lies upon. This broad explanation is subsequently followed by definition of its fundamental terms - author's work and its use. The crucial part of the work lies in the fourth chapter, which bears the same title as the work itself. The structure of this chapter follows the organisation of the Czech Copyright Act. After description of the free work, the paper gets to the interpretation of individual exemptions and limitations to copyright, thus the institutes of free use and statutory licences. The subject of this thesis is a design documentation for new construction of the elderly house in Austerlitz. The building has one underground and two or three floors. Designed capacity is 40 clients in the house. In addition to the accommodation of seniors also provides catering facility, motivational activities and other services connected with the activities of the senior home under the Act on Social Services. From a structural point of view it is an object of a wall brick supporting system, ceiling structures are made of panels of prestressed concrete. Roofs are designed flat single shell.

The legality of music sampling in Sweden : Complicated issues demand complicated measures

The legality of music sampling is in Sweden unknown. The reason for this is mainly the lack of relevant case law and that the legislation and legislative history has not reach clarity within this subject. There are generally two different routes and perspectives on sample issues. The first main route is that samples should be judged according to the “common” copyright rules where originality, similarity and other factors need to be investigated. The second route is that sampling issues should be judged upon the neighbouring rights, and within these rules no other tests needs to be included. It is simply an infringement if it is proven that someone has in fact sampled a recording. American case law has inherent both views and most often are pending between these views. German case law however made it clear in the Kraftwerk case that the neighbouring rights are used within German law. Through this inconsistency the authors have not found any clear indications which rules a Swedish court would apply. Due to the relationship between Sweden and Germany, and that they are both members of the European Union the authors believe that Sweden will judge accordingly to the neighbouring rights. However, the authors believe that the neighbouring rights were created for the purpose to contradict piracy and not sampling disputes. Furthermore, neither the legislative history nor judicial literature gives any indications that the neighbouring rights should be used when a part of a work has been altered and used in a new work. The author’s personal beliefs are therefore that the neighbouring rights should not be applied on sampling cases. The “common” copyright rules should instead be applied which includes originality and similarity tests.

Vysokoškolské koleje / University dormitory

The new building of a university dormitory with workshops is the content of the presented thesis. The building consists of fifty-two beds for students’ accommodation with complete equipment in eight cells, three workshops and a technical support. This is a combination of reinforced concrete prefabricated skeleton and classical masonry building construction with insulation. The building has four floors. It is designed as seven towers with flat roofs, which protrude from a ground floor with a vegetative roof. Paved and parking areas are adjacent to the building. The project is designed into an urban area of Nový Jičín. Glass atrium and overall shape solution are the distinctive features of the proposal.

Planetárium s kavárnou / Planetarium with coffee

Thesis on "Planetarium with coffee" is processed in the form of project documentation for construction. The proposed facility is designed as a two-storeyed without basement with the main ground plan dimensions of 52,8 x 27,47 m and is located near the village Lošov close to Olomouc. The building is operationally divided into a part intended for public entrance and a part for operation and maintenance. Loadbearing structural system is reinforced concrete monolithic skeleton based on monolithic reinforced concrete foundation footings. Ceiling structure consists of reinforced concrete, monolithic, locally supported, cross reinforced floor slab. Vertical external walls are made of ceramic blocks with contact thermal insulation system. Part of the front rounded facade is designed as glass fronted. The building is covered by a warm flat roof. Roof cladding consists of vegetation layers, walkable terrace or non-walkable structure of roof cladding. The planetarium itself is covered by a reinforced concrete dome with a thermal insulation layer of plates of foamed glass. Fillings of doors and windows are made of aluminum profiles with isolating triple glazing. The building meets the requirements for barrier-free use of buildings.
