The increase of antidumping measures could represent a source of mounting frictions in the trading systems among Canada, United States and Mexico. Mexico is an active user of antidumping measures suggesting that both private sector groups and government policy makers have found antidumping measures to be a convenient response to the pressures of import competition. / In the last two decades, Mexico has opened its economy to international commerce. Nevertheless, its economy and legal system are not comparable to those of the United States or Canada, although it has adopted analogous antidumping laws. The Mexican antidumping practice is based today on common law practices influencing civil law formalities. In the NAFTA context, more specifically, in its Chapter 19, legal problems facing the binational panel review system have arisen from Mexico's different legal tradition, notably in the areas of transparency and procedural issues, standard of review, parallel amparo and the power of panel vis-a-vis national courts. The procedural requirements of the Antidumping Agreement prove a challenge for Mexico and will likely lead to trade disputes concerning procedure because it lacks the tradition of administrative and legal process.

This paper advances a theoretical construct entitled "neoliberal globalization" to explain the transformations in state form since the late 1970s which have been inspired by neoliberalism, an ideology privileging market mechanisms for capital accumulation and social organization. The essay will then examine the phenomenon of Canada's and Quebec's integration into the North American and the hemispheric economies since the mid-1980s. The following section will focus on the impact of neoliberal globalization on Quebec's idiosyncratic modalities of state organization and social integration. Lastly, the essay will investigate a transnational resistance movement in the Americas opposing neoliberal hemispheric integration, as well as recent mutations on Quebec's social and political left. The growth of cross-border coalitions opposing the Free Trade Area of the Americas (FTAA) and transformation of left politics in Quebec will be accounted for by reviewing theories of social movement internationalism.

The United States trucking industry underwent deregulation starting in 1980. There was much opposition to the process in fears that trucking companies would be adversely affected by increased competition. There were also many proponents and researchers who proved that the increased competition due to regulatory reform only helped strengthen the industry by forcing firms to become more cost efficient. There has been similar opposition and support for the trucking provisions of NAFTA. Although the provisions have not been fully implemented, the trucking industry is well aware it will only be a matter of time. In early 2002 it was announced that the process to begin implementing the trucking provisions would begin in mid-2002. Many in the industry and other groups have opposed implementing the
provisions, concerned that U.S. trucking firms would be subject to competition from Mexican firms, just as they feared trucking firms would be adversely affected by deregulation more than 25 years ago. This thesis analyzes the effects the 2002 announcement of the process to begin implementing the trucking provisions has had on the cost structure of the industry. It uses a translog cost function to determine if firms have become more efficient in the years following the announcement in anticipation of increased competition from Mexican firms after the provisions are fully implemented. The translog cost function is used to determine what effects the NAFTA variable has had on costs and what specific operating characteristics have caused the costs to increase or decrease.
