Teleworking is one of many possibilities reflected in working process. In this work the author explains not only the term, advantages and disadvantages, but also adverts to psychological factor, which has dominant influence on each individual. The author looks on the problem of teleworking not only from the general point of view, but also from the point of chosen teleworking project in Czech Republic and tries to find out its importance for society including its impacts on reality. Psychological aspects lead the author by studying teleworking also into Cognitive Informatics represented by complex transdisciplinarity. During analysis of the teleworking supporting project the author finds many discrepancies in the project and asks the fundamental philosophical question about essence of these projects financed from public founds. Practical impact of this work's result is project coordinator's assurance to accept corrective actions.

1 Performance of work outside the employer's workplace Abstract The goal of this diploma thesis is to critically assess the current legislation regulating performance of work outside the employer's workplace contained in the paragraph 317 of the Labour code and to describe historical roots of this institute. Further this diploma thesis aims to describe eventual shortcomings of the current legislation and to propose some legislative changes. This diploma thesis is divided into 9 chapters including the introduction. In the first and second chapter there is an introduction of the problematics of the performance of work outside the employer's workplace and definition of the basic concepts, specifically homeworking and teleworking. In the third chapter there is a description of historical roots of the performance of work outside the employer's workplace in the era of the First republic, Protectorate of Bohemia and Moravia and socialism. Práce se zabývá možnostmi a způsoby, jakými lze v dnešní době pracovat z domova. Definuje a osvětluje jednotlivé pojmy, které s touto problematikou úzce souvisí, protože je tato oblast zatím v literatuře jen velmi nejednoznačně popsána. Základním cílem této práce je pokus vymezit práci z domova a mimo stálé pracoviště. Druhým cílem je ukázat vzory takovéto práce a upozornit na její pozitiva a negativa. Dalším cílem je ukázat jednotlivé možnosti, kterými lze tento model práce či podnikání realizovat. Po úvodní kapitole, která definuje základní pojmy, následuje druhá část práce, která řeší možné postupy při realizaci práce z domova. Třetí část práce je zároveň nejobsáhlejší a je věnována zkušenostem a konkrétním příkladům nabídek na práci z domu.

Work performance outside the employer's workplace Abstract The aim of this diploma thesis is to describe the institute work performance outside the employer's workplace, to assess its current legislation and to provide possible solutions in terms of de lege ferenda. The first part of the diploma thesis defines basic terms relating to discussed issues, which are place of work, regular workplace, homeworking and teleworking, for the purposes of better understanding of the following text. The second part deals with the historical development of this institute from the first legal regulations relating to homeworking to current legislation contained in the Labour Code and in Act on Civil Service. One chapter of this part is also dedicated to amendment of the Labour Code from 2017, which should have brought substantial changes into this institute, but it was not accepted. The third part represents the most significant documents concerning homeworking or teleworking at the international level and at EU level. The Labour Code introduces several variations from statutory regulations for employees who work outside the employer's workplace and organize their working time themselves. This thesis describes a concept of telework, its background, diffusion and penetration, the European Framework Agreement on Telework and provides a detailed analysis of home office as one form of telework in Czech Republic and Germany during the financial crisis. Evaluating the impacts of the financial crisis on using this form of flexible working is based on statistical data, researches and case studies from both countries and on interviews with representatives of two companies located in Czech Republic and two companies located in Germany which practice home office. The research is completed with an interview with a telework service provider.

The topic of this dissertation thesis is a debated issue called "homeoffice and homeworking", which originates from "atypical and flexible forms of work/employment", which are not captured in our labour code as a relevant section that describes legal foundation for setting up standards for employees, nor the employer. The Selected topic comes out of current needs of labour market, ergo needs from the companies, employers and employees. These needs are rising from changes and implementations of new terms and conditions for working out of employers work place, it also originates from demands of young population for more flexible and "free" working time. It comes hand in hand with industry revolution called Industry 4.0. The thesis is brainstorming about changing the established terms of atypical forms of work, if they even still are "atypical" or did they become a new standard for employment relations.
