El derecho a la identidad: una visión dinámica

El presente trabajo analiza los alcances del derecho a la identidad, la importancia de abordarlo desde una visión moderna, dinámica y comprensiva y la necesidad de introducir mecanismos institucionales efectivos para tutelar sus esferas estática y dinámica; la primera de las cuales se refiere al registro e identificación de una persona y la segunda se extiende a la “verdad personal o proyecto de vida” de cada sujeto. También se identifican los principales obstáculos para acreditar la existencia legal de las personas y reconocer los derechos sobre sus tierras y viviendas - que a nivel mundial representan hasta un 90% del patrimonio familiar; y se pone en evidencia cómo la informalidad y la exclusión del Estado de Derecho no sólo impiden tutelar el derecho a la identidad en su dimensión más amplia, sino consolidar temas de relevancia nacional como la gobernabilidad, institucionalidad, inclusión, seguridad ciudadana, protección del medio ambiente, responsabilidad social, manejo de recursos naturales. Asimismo, se analiza el contenido, logros y limitaciones de las principales reformas y mecanismos institucionales dirigidos a crear un sistema legal moderno e inclusivo que posibilite formalizar activos prediales y garantizar el derecho a la identidad en su doble dimensión. El trabajo se ha enfocado en la experiencia peruana, incluyéndose información sobre otros países para efectos comparativos. Los planteamientos, definiciones legales, data, reflexiones y conclusiones de la tesis provienen del análisis de doctrina, jurisprudencia y normatividad nacional e internacional, así como de investigaciones y proyectos orientados al diseño e implementación de reformas en Latinoamérica, el Caribe, Norteamérica, África, Asia y Europa del Este en los que la autora ha participado durante más de dos décadas. / This thesis contains an analysis on the scope of the right to identity, the importance of addressing said right from a modern, dynamic and comprehensive perspective, as well as on the necessity of building efficient institutional mechanisms oriented towards providing legal protection to both the static and the dynamic dimension of the right to identity. The static scope of the above referred right relates to birth registration and the provision of an identity document to a person so as to be recognized everywhere before the law, while the denominate dynamic dimension of said right attains to the “personal truth” and the “life project” of a human being. Likewise, this paper incorporates a diagnosis of the main shortcomings which delay or impede people´s legal identification all over the world and the ones that the vast majority of people face worldwide to get the legal recognition and the capitalization of their real estate assets – which actually represent up to 90% of the international family patrimony. In addition, this thesis attempts to shed some light on the high incidence of informality and exclusion throughout the developing world, which does not only hinder the protection of both dimensions of the right to identity, but also has deleterious effects on society as a whole. For example, it does not allow - or makes it harder - to improve good governance, to strengthen democratic and efficient institutions, to transit towards an inclusive market economy, to implement environmental and security programs, to harmonize land rights, investments, social responsibility and natural resource management. This paper also analyses the contents, achievements and shortcomings of the main reforms and institutional mechanisms oriented towards building a modern and inclusive legal system to allow formalizing real estate assets as well as guaranteeing legal protection of both dimensions of the right to identity. This thesis is mainly focused on the Peruvian experience, information regarding other countries has been introduced for comparative purposes. The statements, legal definitions, data, reflections and conclusions contained herein derive from the analysis of national and international legal doctrine, jurisprudence and legal framework. They also emanate from researches and projects carried out to design and implement institutional reforms in Latin America, the Caribbean, North America, Africa, Asia and Eastern Europe in which the author of this thesis has been involved during the last 25 years. / Tesis
