Nástroje ochrany životního prostředí v českém právu / Tools for environmental protection in Czech law

The thesis is concerned on the topic "Instruments of environmental protection in the Czech Republic". The environmental law knows some categories of instruments. Mostly they are divided according to the influence to the subjects, respectively if they have direct influence to subjects or not. First category of direct instruments is called conceptual instruments and includes group of plans, programs and other documents concerned on scheming in area of environmental protection. Second group of direct instruments is called administrative instruments. These instruments contain commands, prohibitions, permits and approvals. They also contain standards categorization and ecologically-legal liability. Third group of direct instruments is called voluntary instruments. These instruments contain voluntary agreements, environmental managements systems and eco-labeling. Last group of instrument described in this thesis are institutional instruments. They are concerned on system of institutions which have some competences in environmental protection. The object of this thesis is Voluntary tools for the protection of the environment. Voluntary environmental tools, also known as voluntary instruments or approaches, are a set of activities primarily used by business entities to reduce their negative impact on the environment. Their hallmarks are voluntary, ie. Private entity make voluntary decision if voluntary instrument applies or not, and their use is not mandatory in any legislative provisions stipulated, and prevention, ie. applied mainly as a preventive tools used to eliminate the negative effects of business activities on the environment. Voluntary tools are one of the tools of environmental policy. Ekonomické nástroje v mezinárodních smlouvách o ochraně životního prostředí / Economic tools in international treaties for the protection of the environment

The subject of this thesis is the usage of economic instruments (EIs) in multilateral environmental agreements (MEAs) and their relation to international economic law. The thesis aims at analysing and evaluating the possibilities of using economic instruments, their potential to ensure the compliance with the treaties' provisions and assessing, under which conditions it is possible to use them in compliance with the international economic law. As a lot of economic instruments operate with restrictions to international trade in several manners, they can get in conflict with the law embodying this area, namely the law of the World Trade Organization. The thesis therefore analyses the main principles and provisions of General Agreement on Tariffs and Trade that can affect the usage of EIs in MEAs. Most attention is paid to the interpretation of exemptions from the Agreement that can legalize such restrictions. Trade-Related Environmental Measures shouldn't be discriminatory. They shouldn't present arbitrary or unjustifiable restriction to trade against the principles and provisions of the WTO agreements. The aim of the diploma thesis is the analysis and comparison of the elementary legal instruments of territorial nature protection in the Czech Republic and the Federal Republic of Germany. This diploma thesis is divided into 8 chapters including the introduction and the conclusion. The second and the third chapter deal with the most important sources of legal regulation of the territorial nature protection in both international law and law of the European Union and emphasises their influence on the creation of legal regulations of national law. The fourth chapter is concerned with the historical development of the territorial nature protection in both countries in question and focuses mainly on the development of legal regulations since the 30's. The fifth chapter provides an elementary overview of the legal sources of the territorial nature protection in national law. The sixth and the seventh chapter deal with general and special nature protection respectively and provide comparison of the respective legal institutes. The conclusion is concerned with the comparison and the evaluation of common and different features of Czech and German legal regulations and provides proposals for constituent changes of the provisions in question.

The thesis is focused on the activity of children instrumental ensembles in the region of the capital city Prague. In the first chapter we are studying the role of a musical instrument during the development of musical education in Czech schools. The next chapter concerns with psychological aspect of the human personality. Musical skills and abilities acquired by playing musical instrument and especially engaging in an ensemble, where it is important to perceive every other person and instrument support its development. The teachers are also an important part of an ensemble. We are dealing with use of the musical instruments that are currently available for teachers at schools. The research part of the thesis is dedicated to the particular ensembles in the region of Prague. Our goal was to map and summarize what motivates children to play in the ensembles and to find out what leads people to found musical ensembles, what they expect their work to be like and what they would appreciate in their pedagogical experience.

This thesis deals with instruments in the fight against financing of terrorism, introduced on the international level. The thesis focuses on three key instruments in fight against terrorism financing, the International Convention for the Suppression of the Financing of Terrorism, the resolution of the Security Council of the United Nations no. 1373 (2001) and the Nine Special Recommendations of the Financial Action Task Force. The instruments are described with regard to the circumstances under which they were created and their progressive development. The thesis is trying to answers the question of the significance of dealing with the issue of terrorism financing from the view of international law as well as assessing the described instruments. The diploma thesis consists of an introduction, five chapters and the conclusion. The introduction briefly clarify the issue of terrorism and it's financing as well as expresses the reasons for the need to address these issues on the international level. The second chapter deals with the United Nation Organization and it's contributions in this issues and then leads on the look at the Resolutions of the General Assembly of the United Nations. - Bank guaranty The thesis deals with the topic of bank guarantee and its legal regulation in the Czech legal system. The purpose of this thesis is to provide comprehensive characteristics of bank guarantee, both from theoretical and practical point of view. The thesis can be divided into tweleve chapters. The first chapter is the introduction a and the last chapters contains conclusion. Second chapter is focused on nature and function of securing instruments and their legal regulation in respective legislation. Third chapter compares bank guarantee with ordinary guarantee.
