No. of bitstreams: 1 Eduardo Ono Terashima.pdf: 743770 bytes, checksum: 83124d6457ebcfeb1bd01fecf71a51f2 (MD5) Previous issue date: 2016-04-12 / This research aims to analyze the good-faith principle in the United Nations Convention on Contracts for the International Sale of Goods (“Convention or CISG”). In this sense, it highlights the origins of good-faith within contemporary law. It considers the history and applicability of the CISG, which has recently entered into force in Brazil. Moreover, the research analyzes the interpretation and gap-filling methods provided by the Convention and defines its general principles. It also analyzes the concept of good-faith in International Law under the various uniform international legal instruments. The research dissertates about the goodfaith in the CISG, highlighting the need to promote uniformity brought by the Convention. It demonstrates the different functions of good-faith under the CISG, i.e. as an interpretation rule, as a rule application to the conduct of the parties and as general principle. It clarifies the different reflections of the good-faith principle in the CISG and examines the methods for materializing the functions of good-faith. The research concludes that, notwithstanding the formal restriction of art. 7o(1) limiting the good-faith principle to the interpretation of the CISG, it is possible to identify other principles in the Convention which constitute reflections of the goodfaith. However, when applying these principles, it is always paramount to consider the international character and the duty to promote uniformity in the CISG / Este trabalho tem por objetivo analisar a boa-fé na Convenção das Nações Unidas sobre Contratos de Compra e Venda Internacional de Mercadorias ("Convenção ou CISG").
