O foco privilegiado deste trabalho remete para as ações diretas de inconstitucionalidade ajuizadas no Supremo Tribunal Federal que tinham por objeto as reformas constitucionais e infraconstitucionais que sustentaram juridicamente essa reforma. Para tanto foram analisados alguns julgados do Supremo Tribunal nessas ações que tinham por objetivo contestar essas reformas legais. A pesquisa focaliza a análise qualitativa dos julgamentos, na tentativa de extrair elementos para verificar como os membros desta Corte fundamentaram as suas decisões. Para um melhor tratamento da interação entre o poder judiciário e as demais instituições que compõem o Estado, buscou-se verificar como alguns estudiosos refletiram sobre os nexos do direito, materializado nas estruturas jurídicas, com os demais agentes públicos. Essas relações tornaram-se mais complexas a partir do momento em que as premissas que sustentavam a ordem liberal passam por intensa revisão e, a partir daí, considerações de ordem material, portanto de justiça, são acolhidas ao campo do direito. A inclusão do poder judiciário na esfera da política pode ser observada em algumas dimensões. A judicialização da política que nos interessa aqui remete para a potencial interferência do Supremo Tribunal Federal nas decisões políticas por meio do mecanismo de controle de constitucionalidade das leis. Em tese, o judiciário, através do Supremo Tribunal Federal, pode anular uma decisão política majoritária do parlamento ou do executivo. A pesquisa também procurou ponderar sobre as distinções e aproximações do processo decisório no âmbito da esfera do jurídico, e dos órgãos políticos... (Resumo completo, clicar acesso eletrônico abaixo) / Abstract: This research has the aim of analyzing the institutional posture of the Supreme Court in relation to the Brazilian State reform accomplished in the 90's during Fernando Henrique Cardoso's government. The privileged focus of this work entrust to the suit for declaration of inconstitucionality filed in the Supreme Court that has had as object the constitutional and infra-constitutional reforms, which juridically support this reform. Thus, some Supreme Court adjudications were analyzed in these actions, which had the objective of contesting these legal reforms. The research focuses on the qualitative analysis of the judgments in the attempt to extract elements to verify how the members of this Court establish their decisions. For a better interaction between the judiciary power and the other institutions that form the State, it was tried to verify how some experts reflected about the law connections, materialized in the juridical structures with the other public agents. These relationships become more complex from the moment the presuppositions, which have supported the liberal order, go through an intensive revision and then the considerations of material order, and so a justice one, are taken to the law field. The inclusion of the Judiciary Power in the political sphere can be observed in some dimensions. The judicialization of politics that we are interested in here, entrusts to the potential interference of the Supreme Court concerning the political decisions through a mechanism of controlling the law constitutionality. Theoretically, the judiciary, through the Supreme Court, can annul a major political decision from the parliament or from the executive.
