Magistro darbo tema „Kontrabandos sudėties analizė“. Darbe nagrinėjama kontrabandos sudėtis remiantis galiojančiu LR BK. Nusikaltimas įtvirtintas LR BK skyriuje, kuriame numatoma atsakomybė už nusikaltimus ekonomikai ir verslo tvarkai, 199 straipsnyje. Kontrabanda, atsižvelgiant i jos dalyko specifiką, skirstoma į paprastąją ir kvalifikuotąją. Norint geriau atskleisti kontrabandos nusikaltimo sudėties požymius išnagrinėtas kontrabandos teisinis reglamentavimas – aptarta kontrabandos samprata, išanalizuoti teisės šaltiniai, kurie turėjo įtakos formuojant dabartinę kontrabandos sudėties konstrukciją. Vėliau pereinama prie svarbiausios magistro darbo dalies, kurioje visas dėmesys sutelktas į kontrabandos pagrindinės sudėties požymių analizę remiantis galiojančiais Lietuvos Respublikos teisės aktai, bei lygiagrečiai naudojant teismų praktikos analizę. Taip pat detaliai išnagrinėjamas kontrabandos specialiojo dalyko gabenimas, kuris atitinka kvalifikuotos kontrabandos nusikaltimo sudėtį. Darbo pabaigoje nagrinėtas kontrabandos nusikaltimų ir kitų panašių nusikalstamų veikų sudėties požymių santykis, kurio pagalba buvo atskleisti kontrabandos kvalifikavimo ypatumai nusikalstamų veikų sutapčių atveju, bei kontrabandos nusikaltimo požymių atribojimu nuo kitų panašių nusikaltimų požymių. / The topic of the master’s thesis is “Analysis of the corpus delicti of Contraband”. Throughout the work, the contraband features are analyzed according to the effectual criminal code of the Republic of Lithuania. The definition of contraband is defined in the criminal code, paragraph 199, that establishes the responsibility for economical and business crime. According to the subject specificity, contraband is subdivided into main and qualified. First of all, in order to achieve the best results identifying the corpus delicti of contraband, the juridical reglamentation of this crime was examined. The author described literary meaning and content, also analyzed the juridical sources that influenced the development of legal regulation of the contraband. Further on, the main part of Thesis paper was dedicated to the detailed analysis of contraband corpus delicti – object and article, objective side, subject and subjective side. Parallel to this analysis, effectual law acts and courts‘ practices of the Republic of Lithuania were used. Next chapter was devoted to the detailed description of the contraband article - the qualifying feature of the crime. The delicate cases during the qualifying features of the contraband and other crimes concurrence were inquired in chapter four. Finally, to reveal the separation between contraband and other similar crimes corpus delicti, they were compared in the last chapter.
