title: Collective redundancies key words: labour law collective redundancies consultation This study focus on collective redundancies. In the first part is analysed legal regulation in Czechoslovakia in 30ies of the 20 century. Then it was considered as an easy and cheap solution for current issue of high unemployment and economic crisis with small impact on state budget. The analysis of legal regulation is based on archive sources and standard law interpretation methods. The legislation process is also discussed. Strong positon of the state is characteristic of first republic regulation. The public authority could even ban collective redundancy. In the second part the analysis is aimed at the development of European law regulation of collective redundancies. The context of its genesis is explained. The legislative process of all three Directives is described in detail. The study highlights the purpose of the law regulation. Afterwards the analysis focuses on interpretation of Directive 98/59/EC based on Court of Justice of the European Union case law. The basic definition of collective redundancy, all legal persons, and consultation procedure is examined gradually. The position of public authority within the consultation procedure is addressed. The purpose of my thesis is to analyse the collective administration of copyright and neighbouring rights ("collective administration") in the Czech republic under the Act No. 121/2000 Coll., on Copyright ("Copyright Act"). The thesis is composed of seven chapters. Chapter One is introductory and includes basic definition of collective administration, its goals, models of administration and the current applicable law in the Czech republic. Chapter Two examines the main activities of copyright collecting societies in two parts. The first part focuses on the blanket licensing while the second describes the internal rules according to which the fees collected by copyright collective societies are distributed among the interested parties. Chapter Three is subdivided into three parts and provides an outline of rights that can be collectively administered. The first part describes the mandatory collective administration of rights. A questão da biodiversidade foi definida como o viés prático da dissertação, que, por sua manifesta complexidade e por apresentar aspectos nitidamente coletivos, haja vista ser representativa das mais variadas manifestações de vida no planeta, bem como por ser referência para a geração e transmissão de saberes tradicionais, clama pela reconstrução de conceitos tradicionais da ciência jurídica, em termos coletivos, como condição para a proteção desse novo direito de dimensão coletiva. Assim, o trabalho buscou semear algumas perspectivas normativas e teóricas para a proteção da biodiversidade e dos conhecimentos tradicionais associados na condição de novos direitos coletivos, concluindo no sentido de que a efetivação de um novo regime de proteção da biodiversidade e dos conhecimentos associados, é uma importante via para o fortalecimento dos direitos individuais e para a construção de um futuro com maiores possibilidades de justiça social e de sustentabilidade ecológica. / This study must be understood in the context of the crisis of some postulates in the traditional juridical science which are confused with the aspects of the crisis of modernity, since the instrumental, positivist, individualist and patrimonialist reasons, which have always leaded the traditional juridical science, are not able to provide answers for the complexity of the contemporary problems anymore, as the socioenvironmental problems of collective nature are. In this perspective, the aim of the study is to reconstruct, in collective terms and under the methodological frame of reference of the Critical Legal Theory, the traditional concepts of the right holder, property and juridical report, as an essential condition for the recognition and protection of the new rights of collective dimension. The biodiversity issue was defined as practical bias of the dissertation, which, due to its apparent complexity and for presenting aspects clearly collectives, once that is a symbol of the most diverse manifestations of life in the planet, as well as an indicator for the generation and transmission of the traditional knowledge, claims for the reconstruction of the traditional concepts in the juridical science, in collective terms, as a condition to protect this new right of collective dimension. In this manner, the study attempted to propagate some normative and theoretical perspectives for the protection of the biodiversity and for the traditional associate knowledge in terms of new collective rights, concluding that the execution of a new biodiversity and associate knowledge system, is an important way for the strengthen of the individual rights and for the construction of a future with better opportunities of social and ecological justice.

Collective labour law in times of economic crisis : theoretical and comparative perspectives

The thesis explores the interaction of the economic phenomenon of 'economic crisis' with the legal phenomenon of Collective Labour Law (CLL). This interaction is the thesis' main problematique. Rather than undertaking an all-encompassing investigation, it seeks to modestly contribute some new theoretical and comparative perspectives on the problematique. These perspectives are of potential value both to the highly underdeveloped area of the theorisation on economic crises and CLL and to the comparative labour law literature. On the theoretical side, the thesis puts forward a novel Marxist-critical theoretical framework for understanding the crisis' operation of CLL. Building successively on the Marxist-critical insights of a fundamental contradiction between the (capitalism) reproductive and (worker) protective function of CLL, the crisis theories' common assertion of economic rationalisation as the primary crisis response and a joint reading of Gramscian counterhegemony and Habermas' theory of legitimation crisis, a theoretical framework is constructed around a proposed concept: crisis (dis)equilibrium. These (dis)equilibria, which arguably determine the course of CLL's crisis developments are composed of two fundamental opposing forces: the force of economic rationalisation, pushing for reforms dictated by the need for intense capitalist restructuring and the opposing counter-legitimation force, which reflects the level of socio-political threat of withdrawal of support to the prevailing economic system or at least to the reforms dictated by economic rationalisation. The comparative side that serves also as a testing empirical ground for the theoretical framework, consists of an extensive interrogation of the recent crisis CLL trajectories in Greece and the UK. For Greece, the analysis observes and accounts for a dramatic collapse of the pre-crisis protective CLL edifice as a result of multiple and abrupt far-reaching CLL reforms bringing about the neo-liberal crisis movement. Subsequently, the thesis offers a response to why the protective constitutionalisation of CLL rights in Greece failed to prevent the de-construction by designating a de-constitutionalisation triangle of normative spheres. The triangle maps and explains how the neoliberal-oriented EU-IMF bailout conditionality prevailed over domestic-constitutional and transnational labour rights normative spheres through identifying a series of 'strong' and 'weak' legal and non-legal interactions. For the UK, the analysis dismisses a suggestion of a complete stasis during the crisis. Instead, it ascertains and accounts for a further -more gradual- neo-liberal consolidating crisis movement of UK's pre-crisis neo-liberal CLL paradigm. Hence the British crisis movement is described as neo-liberal continuity by consolidation. Very importantly, the thesis observes a significant crisis de-constitutionalisation process of CLL in the UK, which takes the shape of a constitutional attack on the political voice of unions by regulatory reforms. Eventually, the thesis finds a comparative crisis pattern of a 'Great Neo-liberal Convergence' between the two previously diametrically opposite CLL systems, since they moved closer and toward the neo-liberal end during the crisis. The 'neo-liberal convergence' finding is situated as a supportive case for the convergence theorists within the convergence/non-convergence debate over whether the European CLL systems are to converge. Moreover, the analysis demonstrates the explanatory value of the Crisis Equilibrium theoretical framework for understanding the crisis trajectories in both countries and suggests that crisis developments confirm the heteronomy of CLL to the theoreticallyidentified dialectic between the capitalist force of economic rationalisation and the social force of counter-legitimation.

For this purpose, the first part of this paper aims to demonstrate that the Ação Ordniária Coletiva is suitable for the protection of interests of this nature. To do so, starting with a Neo-constitutionalist notion of Law, the principle of access to justice is explored and it is demonstrated that class actions are a necessary instrument for this constitutional guarantee to be truly effective. Once the correlation between access to justice and class actions has been verified, the legal classification of the species of collective rights and the criticisms made by the Jurisprudence of this classification are analyzed, in order to conclude that the Tax Law not only can, but shall be protected by means of instruments procedures. From this point on, we will study the collective procedural instruments provided for in the Brazilian legal system and their compatibility with the protection of tax law. The conclusion that this analysis leads to is that the Ação Ordinária Coletiva, provided by the Consumer Defense Code, is among all the collective lawsuits provided by the Brazilian law, the one capable of delivering more effective judicial protection on Tax Law. The second part of this paper analyzes the operation of the Ação Ordinária Coletiva and the main obstacles encountered by the legal operators working in this area, among which are the reiterated, and unconstitutional, attempts by the Public Authorities to impose limits on effects of the judgment rendered in these actions / O objeto de estudo deste trabalho é a utilização da Ação Ordinária Coletiva, instrumento processual previsto no Título III (arts. 81 a 104) da Lei nº 8.078/90, o Código de Defesa do Consumidor, para a tutela do direito Tributário. Assim, a primeira parte do trabalho tem o objetivo de demonstrar o cabimento da Ação Ordinária Coletiva para a tutela de interesses desta natureza. Para tanto, partindo de uma noção Neoconstitucionalista do direito, explora-se o princípio do acesso à justiça e demonstra-se que as ações coletivas são um instrumento necessário para que esta garantia constitucional seja verdadeiramente efetiva. Evidenciada a correlação entre acesso à justiça e tutela coletiva, analisa-se a classificação legal das espécies de direitos coletivos e as críticas feitas pela doutrina a esta classificação para se concluir que o direito tributário não só pode como deve ser tutelado por meio de instrumentos processuais coletivos. A partir deste ponto, passa-se a estudar os instrumentos processuais coletivos previstos no ordenamento jurídico brasileiro e sua compatibilidade à tutela do direito tributário. A conclusão que esta análise leva é a de que a Ação Ordinária Coletiva, prevista no Código de Defesa do Consumidor é, dentre todos os instrumentos processuais coletivos previstos pelo legislador brasileiro, aquele capaz de entregar tutela jurisdicional mais efetiva no campo do direito tributário. Demonstrado este ponto, a segunda parte do trabalho analisa o funcionamento da Ação Ordinária Coletiva tributária e os principais empecilhos encontrados pelos operadores do direito que atuam nesta seara, dentre os quais destacam-se as reiteradas, e inconstitucionais tentativas do Poder Público de impor limites aos efeitos da sentença proferida nestas ações
