Title: Modes of Public Tender Author: Ing. Adéla Kohoutová Department: Department of Business Law Supervisor: JUDr. Tomáš Horáček, Ph.D. In my diploma thesis I focus on the topic of public procurement, especially the modes of procurement. This issue is very topical mainly due to the existence of the new Law on Public Procurement which is currently in the middle of the legislative process. In the very first I deal shortly with the history of regulation of public procurement. Further I think of the status of procurement law in the legal system and I also introduce the basic principles of public procurement including its application on small-scale public tenders. In chapter three I try to give brief overview of all modes which can be used in public procurement according to the current legislation. For each of them I concentrate on its specific characteristics and highlight the peculiarities that distinguish it from others. It is not my intention to submit precise instruction for the procedure under the Law on Public Procurement or exhaustively comment on the statutory provisions. The most important chapter of the whole thesis is chapter four where I describe various innovations that will be brought by the new Law on Public Procurement which should apply soon. Fem för en - från komplexitet till simplicitet : En fallstudie om avgörande faktorer och riskkällor utifrån en multidimensionell IT-investering / Five for one – from complexity to simplicity

Bakgrund: Dagens snabbföränderliga värld och höga konkurrenstryck ställer krav på innovativa investeringar för en verksamhets fortskridning. Nytt paradigm inom IT-branschen är molntjänst, där utbjudande leverantör bör ta hänsyn till vissa faktorer för att erhålla ett gynnsamt utfall. Vanligt förekommande inom IT-branschen är att nyttja Business Case i beslutssituationer där olika faktorer noga övervägs innan investeringsbeslut fattas. Syfte: Studiens syfte är att med hjälp av Business Case identifiera och belysa avgörande faktorer och riskkällor vid investeringsbeslut. De identifierade riskkällorna ska också undersökas i syfte att söka minimera dem. Med hjälp av teoretisk och empiriskt underlag ämnar studien sammanställa ett Business Case för säkrare investeringsbeslut vid multidimensionella IT-investeringar. Metodik: Detta är en fallstudie utifrån en kvalitativ forskningsmetod. Studien är uppbyggd kring semi-strukturerade intervjuer, där tre representanter ifrån fallföretaget IST låtit svara på djupgående intervjufrågor. Slutsats: Samtliga faktorer som granskats har mer eller mindre betydande roll för beslutstagande vid multidimensionell IT-investering. De faktorer som anses ha störst betydelse vid ett investeringsbeslut är också de faktorer som utgör störst risk. Dessa är marknadsbehov IT-branschen och tekniska förutsättningar vilka besvarar kandidatuppsatsens frågeställningar. Med Business Case som utgångspunkt reduceras osäkerheter och säkrare investeringsbeslut möjliggörs. / Background: In today’s rapidly changing society, the high competitive pressures require innovative investments in order for companies to proceed. A new paradigm within the IT-industry is Cloud service, where the vendor needs to take into account certain factors to obtain a favourable outcome. Therefore, it is common to use Business Case in the IT-industry during the decision making process where different factors are carefully considered before deciding whether or not to make an investment. Purpose:  By using Business Case, the aim of this study is to identify and highlight the critical factors and sources of risk when making an investment-decision. The identified hazards should also be explored in order to seek to minimize them. With the help of theoretical and empirical data the study intends to compile a Business Case for safer investment for multidimensional IT-investments. Methodology:  In this study qualitative research has been used. The study is based on semi-structured interviews, where three representatives from IST have been asked to answer essential interview questions. Conclusion: All factors examined in this study were more or less of a significant role in the decision making process of a multidimensional IT-investment. However, the most important factors when making a decision are also the factors that constitute the greatest risk. These are the market needs in the IT industry and technological conditions, which respond to the questions asked in this particular thesis. Using the Business Case as a starting point, uncertainties are reduced and the possibilities of a safer investment decisions are improved.

Transparentnost veřejných zakázek / Transparency of public procurement

In the theoretical part I tried describe most basic terms of the law of public procurement, because of easier understanding of this topic. In this part I also tried assess the condition of transparency of public procurement in Czech Republic. Then I desribed the basic principles, which relating to standards of transparency of public procurement. These principles were defined by the OECD. I also tried to explatin, how European legislation solves the issue of transparency in public procurement. In the practical part, I focused on several practical examples related to non-transparent public procurement, where are seen various shortcomings in the process of public procurement. In one of the other chapter of thesis is shown a short statistical overview about public procurement in Czech Republic and also overview about public availability of informations related to public procurement in selected OECD countries. In this part I made a short comparison of legal measures in Czech Republic with the principles of transparency of public procurement, which are defined by the OECD. I also tried suggest possible effective solutions to improve the current situation.

This study contains groups of tasks for public procurement contracts in reference model Management Business Informatics (MBI). The tasks are sorted in chronological order in regard of procedure of public procurement contracts. The tasks contain new law on public procurement contracts, elaborated in the procedural point of view, and are complemented with a best practice. Process view in the reference model is intended for public procurers. It enables for the public procurer that he can have better control during public procurement. A separate chapter is devoted to specificities of public procurement contracts to the fulfilment of ICT. The study contains recommendations for the preparation of tender documentation of ICT procurement.

Diploma thesis deals with comparing of current awards by Classification of building structures and works and awards by Functional parts. It is possible to calculate Building life cycle costs by Functional parts. This is definately the advantage of the system because the calculation cannot be done by Classification of building structures and works. A new law on public procurement deals with Building life cycle costs as an evaluation criterion. So it is recommended to use Functional parts awards. The other goal of the thesis is to find bridges between Functional parts and the issue of BIM. BIM is a trend of global construction industry.
