Cuida-se de trabalho interdisciplinar que aborda conceitos da Filosofia do direito, da teoria social e do direito processual constitucional. Para isto, metodologicamente, a disserta??o constitui-se em pesquisa bibliogr?fica da legitimidade do direito em Habermas e das lutas por reconhecimento e o papel do Estado democr?tico de direito. Tamb?m ? utilizado m?todo hipot?tico-dedutivo para definir crit?rios normativos para atua??o do legitimado ativo. Diante disto, pretende-se articular a proposta reconstrutiva de Habermas de constru??o do paradigma jur?dico procedimental que procura garantir as condi??es do processo democr?tico na produ??o e no controle de constitucionalidade das normas. Em seguida, busca-se explicitar nas lutas por reconhecimento, manipula??es simb?licas de exclus?o/inclus?o de grupos sociais, carregadas de sentimentos morais. O intuito ? de problematizar como grupos sociais podem veicular pretens?es de reconhecimentos no controle abstrato de constitucionalidade atrav?s dos legitimados ativo, definidos por um rol fechado de entidades pela Constitui??o. A partir da expectativa normativa de atua??o do legitimado ativo, prop?e-se, com isso, ofertar uma disserta??o que produza crit?rios normativos de atua??o do legitimado ativo, coerente com o paradigma procedimentalista do direito de Habermas e que contribua para o desenvolvimento democr?tico do processo constitucional. / This dissertation aims to develop proposal of criteria for action to abstract control of constitutionality by the active legitimated in recognition of struggles contexts. Takes care of interdisciplinary work that addresses concepts of philosophy of law, social theory and constitutional procedural law. The dissertation?s methodologically is bibliography?s research in Habermas? law legitimacy and struggles for recognition and the role of the democratic rule of law. It is also used hypothetical deductive method to define normative criteria for active legitimated performance. In view of this, we intend to articulate reconstructive proposal Habermas construction of procedural legal paradigm that seeks to ensure the conditions of the democratic process in the production and control of constitutionality. Then seeks to explain the struggles for recognition, symbolic manipulations of exclusion/inclusion of social groups, laden with moral sentiments. The aim is to discuss how social groups can carry acknowledgments of claims in the abstract control of constitutionality through active legitimated, defined by a closed list of entities by the Constitution. From the normative expectation of active legitimized action, it is proposed, therefore, offer a dissertation that produces normative criteria of active legitimized action, consistent with the deliberative concept of the right to Habermas and contribute to the democratic development of the constitutional process.
