Para afirmar sua juridicidade através do método indutivo, a autora destrincha o tema em três partes, construídas através da pesquisa bibliográfica e documental. Na primeira, descontrói o Romance da Lex Mercatoria, enfrenta o problema da nomenclatura, faz críticas às teorias clássicas e levanta suas incoerências argumentativas, principalmente quanto à afirmação de existência de um Direito anacional sob a perspectiva do Positivismo Jurídico; na segunda, com um resgate histórico que retrocede ao período medieval, tenta responder como o monismo juspositivista foi elevado à categoria de verdade universal e como, com a globalização, essa visão do Direito não responde mais às demandas típicas de uma sociedade hipercomplexa; por isso, demonstra a perspectiva pluralista do Direito Transnacional do Comércio trazida por Gunther Teubner e Ralph Michaels; por último, afirma a juridicidade das normas do comércio transnacional através de sua perspectiva e dá uma visão empírica desse sistema normativo ao apresentar suas fontes sob o ponto de vista do Pluralismo Jurídico. / The Transnational Law of Commerce, which is historically related to Lex Mercatoria, is seen in this thesis as a recent product of a transnational scenario, typical of the Pluralistic theory of Law. To claim its legal nature through the inductive method, the author details the theme in three parts, structured by bibliographic and documentary research. In the first part, she deconstructs the Romance of Lex Mercatoria, faces the problem of nomenclature, criticizes the classical theories and shows their argumentative inconsistencies, especially the one regarding the assertion of the existence of a anational law from the perspective of legal positivism; in the second part, with a historical approach that takes back to the medieval period, she tries to answer how the normative monism was elevated to the position of a universal truth and how, with globalization, this vision of Law no longer fulfills the typical demands of a hypercomplex society; therefore, she demonstrates the pluralistic perspective of Transnational Law of Commerce brought by Gunther Teubner and Ralph Michaels; lastly, she states the legal nature of transnational commercial norms through her perspective and gives an empirical view of this legal system presenting its sources from the Legal Pluralism’s point of view.

Tesis (para optar al grado de magíster en derecho) / No autorizada por el autor para ser publicada a texto completo / Tres problemas surgen en torno a la noción de la lex mercatoria: su historicidad, su juridicidad y su aplicabilidad. La presente investigación se propone elucidar dichos problemas, mediante la elaboración de una estrategia argumentativa que permita, por una parte, reconocer los orígenes medievales de la lex mercatoria y, por otra, entender el proceso de codificación que hoy enfrenta la lex mercatoria, lo que supone defender su autonomía como sistema de normas jurídicas y evitar la objeción que la considera atentatoria contra los valores de previsibilidad y seguridad jurídica. Ambos aspectos han sido considerados, en el debate erudito sobre el tema, como incompatibles. Asimismo, se busca contrastar dichos problemas con la aplicación práctica de lex mercatoria. Se espera lograr una propuesta teórica novedosa, que muestre como meramente aparente dicha incompatibilidad argumentativa, ya que ella depende de una determinada concepción del derecho, la que aquí se sugiere reemplazar. A este respecto, el pluralismo jurídico ofrecerá el marco teórico que permita desarrollar dicha estrategia argumentativa

The objective of this Master's thesis is to analyze the rules of law governing contractual obligations in private international law. First, the relevant sources of law and their concrete application are examined through descriptive and analytical method. The thesis is then focusing on two specific phenomena that have significantly influenced the development of the field in the last few decades. The first one is a gradual process of unification taking place at the legislation level. The second one is called "new lex mercatoria" and represents a non-sate source of rules governing contractual obligations with a cross-border element. Both of the phenomena are analyzed from both theoretical and practical point of view. The thesis is divided in five chapters and the analysis progresses from a general to a more specific level. The first chapter focuses on the legal definitions indispensable for a more detailed analysis provided in the following chapters. In order to better contextualize the rules governing contractual relationships in the international private law, the second chapter is dedicated to its historical evolution. Moreover, the chapter introduces and compares methods regulating contractual relationships in the international private law, while acknowledging the specific circumstances of their creation....
