SANTRAUKA Šiame magistro darbe nagrinėjami nuosavybės teisės į bešeimininkį daiktą įgijimo pagrindai. Atskleidžiami šio instituto tikslai, paskirtis ir įgyvendinimo galimybės. Darbe buvo apžvelgta kaip reglamentuoja Lietuvos Respublikos įstatymai nuosavybės teisę įgijimą į bešeimininkius daiktus: namines bites, naminius gyvūnus, radinį lobį, taip pat ir į kitus daiktus. Remiantis teises teoretiku darbais, LR įstatymais, bei teismų praktika darbe nagrinėjama nuosavybės teisės samprata ir jos požymiai, bešeimininkio daikto samprata ir požymiai. Detaliai analizuojami bendrieji nuosavybės teisės įgijimo pagrindai į bešeimininkius daiktus. Kitose temos dalyse nagrinėjami atskiri – specialūs bešeimininkiai daiktai kuriems civilinis kodeksas numato atskira nuosavybės teisės įgijimo ir praradimo reglamentavimą t. y. į: namines bites, naminius gyvūnus, radinį bei lobį. Pateikiami terminai ir sąlygos nuosavybės teisei į bešeimininkį daiktą įgyti priklausomai koks tai bešeimininkis daiktas ir kokia jo įgijimo forma, kai nenustatomas bešeimininkio daikto savininkas. Analizuojamas nuosavybės teisės gynimas į bešeimininkį daiktą, kai nustatomas savininkas esant sąžiningam ir teisėtam, nesąžiningam ar sąžiningam ir neteisėtam bešeimininkio daikto valdytojui. Atkreipiamas dėmesys ir į skirtingus bešeimininkių daiktų nuosavybės teise įgijimo būdus, taip pat pateikiama šių įgijimo būdų skirtumai ir panašumai. / SUMMARY This master’s thesis examines the basis for the acquisition of the right of ownership to ownerless property. It reveals the aims, purpose, and realisation possibilities of this institution. The work surveys how the laws of the Republic of Lithuania regulate the acquisition of the right of ownership to ownerless property: domestic bees, domestic animals, finds, hoards, etc. On the basis of works by legal theorists, Lithuanian laws, and judicial practice, the work examines the conception and features of the right of ownership as well as of ownerless property. It analyses in detail the general basis for the acquisition of the right of ownership to ownerless property. Other parts of the thesis examine individual – special ownerless property, for which the Civil Code foresees a separate regulation of the acquisition and loss of the right of ownership, i.e. to: domestic bees, domestic animals, finds, and hoards. It presents the deadlines and conditions for the acquisition of the right of ownership to ownerless property depending on what kind of ownerless property it is and in what form it is acquired when the owner of ownerless property is not established. It analyses the defence of the right of ownership to ownerless property when an owner is established who is the honest and legal possessor of an ownerless property or who is its dishonest or honest illegal possessor.
