Leadership and accountability of ward councillors in South African municipalities: a case study of Buffalo City Metropolitan Municipality

The aim of the study is to critically examine the leadership and accountability of ward councillors in South African municipalities: A case of Buffalo City Municipality. The theory of communicative action by Jürgen Habermas was used to interpret the manner in which ward councillors are expected to interact with the members of the community when performing their leadership and accountability roles. The study adopted a case study design that assisted in establishing what is required from ward councillors with regard to their leadership and accountability roles in local governance. Qualitative and quantitative data collection instruments were used to collect data. The focus group interviews with ward committee members (n=100) from twenty-five (25) wards identified themes that relate to leadership and accountability constructs. The identified themes were verified in the quantitative phase in which questionnaires were administered to fifty (50) ward councillors. The qualitative data was analysed thematically using NVivo and quantitative data was analysed using MS Excel. Generally, the views of the ward councillors regarding their leadership and accountability were positive. However, their leadership and accountability were largely dependent on their individualised communication skills and emotional intelligence. Hence the study established that unless ward councillors are equipped with skills and knowledge in communication and emotional intelligence respectively, their leadership and accountability roles will not be able to contribute effectively to local governance. Subsequently, the study made a set of recommendations in this regard.

Public participation in local government municipalities in South Africa between 2006 and 2011 : lessons from Hibiscus Coast Municipality

There is an on-going debate in South Africa whether municipalities are an effective vehicle for deepening participatory democracy or not. Due to serious backlogs on services, the role of municipalities has largely been reduced to service delivery, to the detriment and total neglect of fundamental functions of local government. These are (Act 200, 1996):(a) To provide democratic and accountable government for local communities;(b) To ensure the provision of services to communities in a sustainable manner;(c) To promote social and economic development;(d) To promote a safe and healthy environment; and (e) To encourage the involvement of communities and community organisations in the matters of local government. On the other hand Haveri, Stenvall & Majoinen (2011) argue that if the municipalities are a government sphere closest to the people, they are therefore best placed to, and should, lead and support the deepening of participatory democracy, what they call self-government. As the debate rages on, there are indications that most of thechallenges that face the municipalities are related to the distance that has been developing between municipal institutions and the citizens.

Statutory local government structures to enhance service delivery : Kouga Local Municipality

The purpose of this study was to review ward committee structures and the role of Community Development Workers (CDWs) in terms of service delivery, with special focus on the Kouga Local Municipality in the Cacadu district. For the study to be successful main objectives were to be highlighted. The study sought to highlight and explain the correlation between ward committee structures and Community Development Workers with regard to basic service delivery. Taken further the study will review the kind of service delivery that communities expect and an analysis was undertaken to establish if there is any link between said structures and the expected service delivery by selected communities who fall under the jurisdiction of the Kouga Local Municipality. The literature review assisted in understanding the concepts of public participation, Ward Committees, Community Development Workers and Ward Councillors and their roles and responsibilities in the Local Government Sphere. In essence, the qualitative approach applied in this study has revealed the casual relationships that may be obtained between variables or events, in order to explain or predict particular phenomena in terms of specific causes. The selection of a qualitative and interpretative approach for this research is justified. The main purpose of the study was to determine the level of effectiveness of Ward Committees, as well as the Community Development Workers in co-ordinating and facilitating public participation process in the Kouga Local Municipality. The study has revealed that there is a need for renewal of the operations of the operations of formal structures, especially the ward committees, as they represent the communities at ward level. The study has revealed that the man reason why national programmes deploying community based workers fail is because of inadequate attention to the provision of institutional support such as adequate training, technical expertise and close supervision. It is recommended that a comprehensive support structure ranging from national to local level is a pre-requisite in order for the CDW programme to succeed.

An investigation of the challenges facing the ward committee system with specific reference to selected municipalities in the province of the Eastern Cape

Local government in South Africa has undergone radical changes since the first democratic local government elections were held in 1995 and 1996. It is generally known that local government in South Africa was based on racial fragmentation. The new South Africa therefore has to go beyond purely representative democracy to address the inequalities of the apartheid era. The Constitution of the Republic of South Africa Act, 1996 (Act 108 of 1996), envisages a complete transformation of the local government system. Subsequently, a policy framework has been developed to give effect to a new vision of local government. The White Paper on Local Government was passed in March 1998. It spells out the framework and programme in terms of which the existing local government system will be radically transformed. This culminated in the birth of the concept of developmental local government. Developmental local government establishes the basis of a system of local government which is centrally concerned with working with local citizens and ward communities in particular to find sustainable ways to meet their needs and improve the quality of their lives. Developmental local government encourages public participation at the local level. One of the most powerful instruments by which the communities and groups become involved in local government affairs is through the ward committee structures and ward planning forums. The Municipal Systems Act, 2000 (Act 32 of 2000), makes provision for community participation. Ward committees are established in terms of section 17 (1) of the Municipal Structures Act, 1998 (Act 117 of 1998). Ward committees play an important role in creating a democratic culture of local participation and accountability. They are the main mechanisms available to municipalities and communities to enhance public participation in ix the local sphere of government. Their major obstacle is that their powers are limited to advising the communities and the relevant council. The White Paper on Local Government provides for three approaches which can assist municipalities to be more developmental, namely integrated development planning and budgeting, performance management and working together with local citizens. Ward committees provide a link between the council and these processes. The new system of local government also provides for the consideration of gender issues at the ward committee level. The local government policy framework requires that at least fifty percent of representation on ward committees should be women. The involvement of youth is also greatly encouraged. The system also provides for and clarifies the role/relationship with traditional leaders at the ward committee level. The local government legislative framework accepts and acknowledges the existence of traditional leaders. Their involvement in ward community activities and functions is well documented. Lastly, the capacity building of ward committees is posing a major challenge. In order for ward committee members to perform their functions effectively training must be provided. The respective local councils should be responsible for providing the necessary training to ward committees through the office of the speaker under which they fall. In the national sphere efforts are made to ensure that training for ward committees is provided.

An evaluation of public participation on service delivery at Lukhanji Municipality

After 1994, the democratic South Africa passed a number of legislations in order to address the imbalances of the previous apartheid regime. The new South African government had a special mandate to provide appropriate services to all the citizens of the country. In 1995 the government formulated the White Paper on the Transformation of the Public Service. The aim was to transform the South African public service, which is the indication of the importance of service delivery, as the key machinery of the government to equalize service delivery to all citizens. In 1996, the Constitution of the Republic of South Africa anchored the Bill of Rights as the cornerstone of democracy that enshrines the rights of all people and affirms the democratic values of human dignity, equality and freedom. Chapter ten of the Constitution stipulates the basic values and principles governing public administration. The South African Government has developed a wide range of legislation that ensures that communities are consulted on a continuous basis with regard to how services need to be rendered. Communities have a right to be consulted and to give input into issues affecting them. Public consultation as envisaged in the South African legislation has, however, not yielded the desired results which is evident in the spate of service delivery protests over poor or non-service delivery. Section 152(1) (e) of the constitution stipulates amongst others, promotes involvement of communities and community organisations in the matters of local government. Section 73 of the Municipal Structures Act (no.117 of 1998) also requires municipalities to establish ward committees in a manner that seeks to enhance participatory democracy at the local level. The study therefore is to check that decision-makers at the Chris Hani Municipality understand the consequences of their decisions before they act and people affected get the opportunity to participate in designing their future.

An assessment of the role of ward committees in public participation with reference to the Kouga local municipality

The Republic of South Africa became a democratic country in 1994 after the historic democratic elections. This year also marks the year when South Africa’s first democratic parliament was convened. The Constitution of the Republic of South Africa Act (no. 108 of 1996) was enacted in 1996. This Constitution provides for the creation of the three spheres of government, namely, the national level, which deals with matters of national importance, the provincial level, which deals with matters of provincial importance, and the local level which deals with matters of local importance. Section 152(1) (e) of the above-mentioned Constitution stipulates that the object of local government, amongst others, is to ensure the involvement of communities and community organizations in the matters of local governance. Section 73 of the Municipal Structures Act (no.117 of 1998) also requires municipalities to establish ward committees in a manner that seeks to enhance participatory democracy at the local level. Municipalities are established in terms of Section 12 of the Municipal Structures Act (no. 117 of 1998), wherein Members of Executive Councils (MEC’s) may, by notice in the Provincial Gazette, establish a municipality in each municipal area which the Demarcation Board demarcates in the province in terms of the Municipal Demarcation Act (no. 27 of 1998). Sections 7 and 8 of the Municipal Structures Act (no. 117 of 1998) further stipulate the categories of municipalities as A, B and C. Category A is a metropolitan municipality with wards and ward committees. B is a local municipality characterized by the existence of wards and ward committees to enhance public participation. C is a district municipality, whose responsibility is to support local municipalities within its area of jurisdiction so that they are self sufficient and can manage their own affairs. This study focuses on the Kouga Local Municipality, which is a Category B Municipality as promulgated by the then MEC for Housing, Local Government and Traditional Affairs, Honourable MEC S. Kwelita in the Provincial Gazette (Gazette No. 1537) dated 23 May 2006. The scenario above indicates that in the Kouga Local Municipality, ward committees are supposed to play a critical role in public participation. The study seeks to assess their role and to establish whether or not the ward committee system is effective in this regard. It is common knowledge that, whilst various pieces of legislation are clear in terms of what the role of ward committees should be, the question remains whether there is any adherence in municipalities to ensure that they fulfill their role in public participation, and hence the study.

An assessment of the local government turnaround strategy: the Umzimvubu local municipality

South African Municipalities have often been labeled as failures in the provision of services to local communities. These allegations include poor governance, maladministration, corruption and poor delivery of services. Certain municipalities are unable to deliver sufficient services to the communities of their geographic areas due to maladministration, political interference and corruption. This study undertook an assessment of the implementation of the Local Government Turnaround Strategy with emphasis on the Umzimvubu Local Municipality. The study comprises of five chapters and was motivated by the National Cabinet‟s decision to turn around the image of South African municipalities. The study includes an overview on the development and transformation of local government in South Africa as a point of departure. This is followed by an assessment of the implementation of the Local Government Turnaround Strategy, with specific reference to the Umzimvubu Local Municipality. The quantitative research methodology was employed for purposes of the study and the interpretation of the research findings are analyzed and described. A number of conclusions that were arrived at during the study, followed by specific recommendations are proposed in the final chapter. These are based on the findings primarily from the literature review and empirical survey.

Public participation in integrated development planning, New Brighton, Nelson Mandela Bay Municipality : 2006-2010

The most important difference between the new form of local government and that of the past is the creative and dynamic “developmental role” for local government to ensure maximum impact on poverty alleviation within resource constraints, and to address spatially entrenched socio‐economic inequalities. This needs to take place within the framework of integrated development planning, which is linked to the annual budgeting cycles. The IDP process is intended to provide communities with opportunities for participation in articulating, monitoring, reviewing and evaluating their needs. The aim of the research was to establish to what extent cooperation between the communities and the ward committees in the ward of New Brighton exists, with specific reference to consultation and participation in terms of IDP. A qualitative study was undertaken and literature review on public participation in terms of the IDP was conducted. Relevant secondary data was sourced and structured interviews were conducted with councillors representing New Brighton. Focus group interviews were also conducted with ward committee members from New Brighton. The research revealed that the priorities and genuine needs of the communities were often ignored by the Nelson Mandela Bay Municipality. There is no correlation between the genuine needs of the communities and those perceived to be the needs of the communities by the public officials. Challenges on public participation in IDP process were also found to be associated with the relationship between the councillors and public officials on what constitute the genuine needs of the communities.

Investigating variables that have impact on annual financial statement audit report outcomes in local government

The third sphere of government (Local Government) has been persistently clouded by unfavourable Annual Financial Statement (AFS) audit reports. This results in local government losing credibility and its stakeholders losing confidence in the institutions or municipalities. In-depth analysis of the root cause of this dilemma is an opportunity for the municipality to reorganise its house and redeem its dignity and credibility to its stakeholders through addressing the identified challenges. The importance of the study can be attributed to the need to investigate the root causes of unfavourable audit opinion and recommend possible remedies that can assist municipalities to improve their audit report outcomes which in turn will improve the confidence of its stakeholders. The primary objective of the study was to investigate variables that impact on the audit report outcomes on annual financial statements of the municipalities that are within Alfred Nzo District (AND) Jurisdiction, including Alfred Nzo District Municipality (ANDM). This was achieved through investigating the root causes of the audit report outcomes with specific focus on the relationship that exists between the management role and audit outcomes of the Alfred Nzo District Municipalities. This was measured by the municipality’s leadership, governance, internal controls and human capital management. Convenient sampling was used wherein 150 questionnaires (30 per municipality) were sent out to the selected employees in all the municipalities in the Alfred Nzo District. Out of the questionnaires that were sent out, 103 responses were received. These were analysed to draw findings, conclusion and recommendations. The empirical results of the study revealed that there is strong evidence that leadership, governance and human capital management have a positive influence on the municipality’s AFS audit report outcomes. It also revealed that there is overwhelming evidence that internal controls have a positive influence on the municipality’s AFS audit report outcomes. The study recommends how leadership, governance, internal controls and human capital management must be improved. It also provides future research recommendations to improve this study.

In South Africa there is an extensive legislative framework supporting public participation in local government; however, participation which is genuinely empowering, and not token consultation or manipulation, is still lacking in most local municipalities. This study seeks to explore and explain public participation approaches adopted by local municipalities in South Africa by looking at a comparative study of two local municipalities. The study will further evaluate international effective practices in public participation and drawing on those, make recommendations on how to strengthen public participation in South Africa.
