A relevância do tema se remete ao fato de que na década de 1990, quando o Estado brasileiro sofre um surto neoliberal, vê-se diluir o debate dos intelectuais da geração de Werneck Vianna, num período em que propõe a pensar numa ação política cujo foco será a sociedade civil e os mecanismos jurídicos de que dispõe, mobilizando a análise gramsciana, sob o tema do americanismo, para compor sua leitura / The purpose of this essay is to analyse of the intellectual trajectory delineated by Luiz Werneck Vianna during the 1990s in Brazil, in order to make an approach of his role and his theoretical production in the academy over that decade. On that behalf, it takes into consideration his engagement in the Brazilian’s Communist Party and his participation in the debate about ways to a democratic transition. Its relevance concerns to the fact that, in the 1990s, the widespread of the neoliberalism ideals ended up to empty the debate between intellectuals from the Werneck Vianna’s generation, who, by that period, proposed the implementation of a policy which focuses the civil society and its legal instruments, by using a gramsci’s analysis of the Americanism to set his reading upon that matter
