Growing numbers of America's 1,281,432 active licensed attorneys open their own law firms due to strained employment opportunities. With 50% of small businesses failing within 5 years, and solo law offices accounting for 75% of attorneys in private practice, there is a need for preparing solo criminal law practitioners for business success. Some solo criminal law practitioners do not understand the critical business performance variables that impact small business success. The total population for this quantitative correlational study included solo criminal law practitioners from the Philadelphia Bar Association Legal Directory and Pennsylvania Association of Criminal Defense Lawyers members. Barney's resource-based theory (RBV) and Lussier's nonfinancial success-failure business prediction model were the foundational frameworks of this study. I used Lussier's nonfinancial success-failure questionnaire to collect data via a self-administered survey. A Kendall tau correlation was used to determine the relationship between Lussier's 16 independent variables measuring success or failure and a single dependent variable of 'level of profits' for the 31 participants. 31 participants (4%) is a very low response rate. Increased participation is needed for better research results. Fifteen of the 16 variables showed no relationships with the level of success. Only 1 hypothesis showed a relationship between the type of start-up plan developed by the firm and the level of success (Ï? = .322, p = .032). The findings from this study support the Small Business Association's definition of a business plan as a living roadmap for business success. The implications for positive social change include the potential to increase employment opportunities by directly impacting the economy in creating economic expansion.

Ce mémoire est une étude de cas sur Le voyage d’hiver (2013) de Keith Kouna. Réalisée par René Lussier, cette œuvre de musique enregistrée est une transposition musicolittéraire d’après Winterreise (1828) de Franz Schubert. Malgré la réécriture d’un texte en français et les transformations musicales notables qui caractérisent Le voyage d’hiver, les fondements mélodiques et harmoniques qu’il reproduit génèrent un effet de reconnaissance qui ne cesse de renvoyer Kouna vers Schubert. Plutôt que de les tenir pour inséparables l’un de l’autre, cette étude propose une réflexion sur la distance qui les sépare. On se demandera si Le voyage d’hiver peut constituer une œuvre avec le caractère propre de ce qui la rendrait autonome et originale. Considérant que la réécriture textuelle dont il procède s’enracine dans l’écoute musicale, la recherche pose d’abord que le Voyage d’hiver s’établit comme la trace d’une écoute de Winterreise. À partir du rapport entre texte et musique qui s’y déploie, il s’agit ensuite de suivre cette écoute à travers les médiations de la musique enregistrée en studio qui en ont constitué l’inscription. L’établissement de ce tracé permettra d’évaluer l’ampleur des transformations qui donnent lieu au Voyage d’hiver afin de mettre en perspective la distance qui le sépare et le distingue de l’œuvre de Schubert. / This master’s thesis is a case study of Keith Kouna’s music recording Le voyage d’hiver (2013). Produced by René Lussier, this album is a literary and musical transposition based on Franz Schubert’s Winterreise (1828). Although the text was rewritten in French and the music underwent significant transformations, the melodic and harmonic foundations of Le voyage d’hiver create a recognition effect that constantly hearken Kouna’s work back to Schubert. Instead of viewing both works as inseparable, this study will examine the distance that separates them. One may ask if Le voyage d’hiver possesses the distinctive traits to be considered an original, free-standing musical work. Given that the rewriting of the text is rooted in music listening, this research posits that Le voyage d’hiver takes form as the result of listening to Schubert’s Winterreise. Based on the relationship that unfolds between the text and music, the research is then a matter of following this listening through the mediations of the resulting music that was created and recorded in the studio. Establishing this path will make it possible to assess the extent of the transformations that led to Le voyage d’hiver in order to put into perspective the distance that separates and distinguishes it from Schubert’s work.

Non-profit organisations serve disadvantaged people by fulfilling their social needs, promoting social inclusion and building economies. Non-profit organisations are confronted with a tightening funding environment, growing competition for donors and grants, rising demand for services and increasing calls for accountability. The objective of the study was to investigate the way in which non-profit organisations in the Western Cape province apply fifteen management factors of the Lussier Business Success Versus Failure Model. This model was successfully used in various parts of the world to predict the success or failure of a business. A descriptive research design, using a qualitative case-study research approach was used in this study. A purposive non-probability sampling method was applied, and convenience sampling was used to identify twelve participants from four non-profit organisations. Semi-structured interviews were conducted with founders, managers and staff. Descriptive and thematic analysis techniques were utilised, and a deductive coding approach was used to develop thematic areas. Thematic analysis showed three broad themes, namely people, management, and finance. The research established that the non-profit organisations applied nine success factors of the Lussier Business Success Versus Failure Model. Non-profit organisations keep accurate records and adequate financial controls. They do have staff with management experience, while the staff have limited NPO experience. The non-profit organisations make use of professional advisors and networks. The research also revealed that non-profit organisations experience challenges with income-generating activities. They do not plan for the long term and find it difficult to retain staff. Non-profit organisations also lack critical skills, such as strategic planning, marketing management, and administrative management. Non-profit organisations need to build and maintain relationships with government bodies, support organisations and other non-profit organisations. Enhanced information sharing and relationships will reduce the dependence on government grant funding. Applying management principles will enhance the long term survival of non-profit organisations. / Business Management / M. Com. (Business Management)
