Humankind conflicts reached a point where the use of terrorism continues to be viewed as an acceptable and valuable instrument to pursue political goals. Because of the fact that the Romanian forces have encountered little action in the terrorism arena, one can say that the Romanian counter-terrorism and antiterrorism arrangements within the law enforcement and military are immature. This paper attempts to shed light upon the current crisis management procedures and how that arrangement can affect the effectiveness of the state response in hostage situation crises both in country and abroad. The paper analyzes five hostage rescue operations, conducted by German, British, Peruvian, and Russian forces, and focuses on three critical procedures that lead to hostage deaths: security measures, negotiations, and handling the media. The analysis exposes that the effectiveness of these procedures will minimize the civilian casualties and will act as prerequisites for successful hostage rescue operations. In the light of the case studies results, a general-based model provides the Romanian authorities with critical tasks faced by either military or law enforcements assets that are required in order to accomplish rescue operations. The project concludes with a number of suggestions for immediate and long-term alleviation of current development problems faced by Romanian Special Operations Forces.

Magister Legum - LLM / This thesis examines the sexual rights violation in Eastern DRC, which has been described as the worst in the world. The sexual violence against women and children in this country is systematic and widespread and perpetrated by armed groups, and increasingly also by civilians. The prosecution of sexual offences should contribute to the reduction of these offences, but the Congolese state prosecutes very few cases. The resulting impunity became an obstacle to the state to stop sexual violence, which become unable to overcome the obstacles to prosecutorial action. The successful prosecution of sexual offenders in Eastern DRC faces many obstacles and requires an exceptional jurisdiction which must provide a minimum of better freely conditions to the prosecutors and better unrestrained justice access to the victims. The enforcement of the international instruments of justice will be possible only by this jurisdiction. The victims of sexual violence need more confidence in the jurisdiction which is really working for them to attain justice.

Britain’s Royal Navy of the nineteenth century was the unquestioned master of the world’s oceans, having won such standing after over a century of near-uninterrupted warfare. However, while the strategies, tactics and technology of the navy evolved dramatically during this period, the laws that governed its many thousands of sailors and officers remained virtually unchanged from the original 1661 Articles of War. Despite minor amendments throughout the eighteenth century and a major reworking in 1749, both capital and corporal punishments were frequently employed as punishment for minor offences in a system that made England’s “Bloody Code” look positively humane. The 1860 Naval Discipline Act provided the first substantive overhaul of the original Articles of War, but historians have generally lamented this act as providing little comprehensive change to the governance of the navy. Using statistical data collected from thousands of courts martial records, this thesis takes a broad look at trends in naval courts martial, studying how these courts interacted with the legislative changes of the 1860s. Viewing how charges and sentences changed on the global scale, it becomes clear that the “arbitrary and cruel punishments” of the previous century had at last given way to a centralized, formal expression of discipline. / Graduate / 2021-07-21

The purpose of this study is to analyze certain major reforms in the Code in an effort to determine whether or not the "status quo" has been change. These reforms are: (1) henceforth all military legal proceedings are to be governed by a single Code equally applicable to all the services; (2) all military judicial proceedings are to be governed as near as practicable by the rules of civil procedure and evidence observed in the criminal proceedings of the United States district courts; (3) all persons charged with an offense are to have competent legal counsel at all stages of pretrial and trial proceedings; (4) all persons subject to the Code are assured that they shall not be subject to compulsory self-incrimination; (5) all who are subject to the Code are presumed innocent until proven guilty beyond a reasonable doubt and (6) all are guaranteed an automatic and mandatory review (under certain conditions) of their trials.
