The role of Nelson Mandela Bay Municipality in the upkeep and management of open spaces in Zwide Township

This paper is an investigation into the role of the Nelson Mandela Bay Metropolitan Municipality (NMBMM) in the up-keep and management of open spaces, in Zwide Township. The study examines the manner in which the legislative framework for waste management is being implemented as prescribed in legislative directives. The Constitution of the Republic of South Africa Act, 1996 (Act 108 of 1996), envisions the transformation of the local government system. Subsequently, policy frameworks and principles have been developed to support the new vision of local government. The Batho Pele Principles and the white paper were passed in March 1998. Both documents spelt out the implementation of the principle and the framework in which the local government system should operate as set out in the developmental local government concept. The developmental local government system’s core ethos lies in working with local citizenry to find ways of meeting their needs, thereby improving their quality of life. It also makes provision for public participation. Ward councillors and ward committees are an indispensable backbone of community participation. It is assumed in this study that a number of environmental, social, economic and health challenges are associated with waste disposal in open spaces. Such hazards range from health risks to the abuse of open spaces by antisocial individuals and groups. The situation is exacerbated by poor implementation of constitutional and legislative directives regarding waste management and disposal to ensure a humane and environmentally friendly atmosphere. The research assumes that the problem cannot be overcome by the NMBMM alone. Well-orchestrated community awareness education programmes such as projects like “trash is cash “and innovative ways of managing waste, including waste recycling, need to be drawn upon. The strategic placement of waste stations and the timeous collection of waste could improve the situation. The observation is that the level of service delivery varies within residential areas and in socioeconomic strata. The previously disadvantaged areas seem to have borne the brunt in terms of poor waste management services until now. The municipality has been accustomed to a situation whereby it removes the waste on an ad hoc basis in selected areas in the townships. The situation is exacerbated by little foresight into the ever growing population, specifically amongst the lower socioeconomic sector of the population. As a result, the ecology and environment is impacted in a negative way. Amidst the challenges of dumping in open spaces, a sense of determination appears within the community to want to prevent the situation; to illustrate: There is an organized group of youths who have cleaned up open spaces at along Qeqe Street in Zwide. They developed a car wash bay as a venture to generate an income. The Green Township Movement is another scheme which is mobilising the community, street by street, to keep their neighbourhood environmentally clean and green. Potentially, the Waste Management Directorate could collaborate with these groupings to halt waste dumping in open spaces. In so doing they could contribute to establishing an environmentally friendly neighbourhood. The NMBMM needs therefore to take advantage of the situation and reengineer its waste management strategy, policies and directives and augment the initiatives that the community have taken upon themselves. The study will endeavour to ultimately advise on viable strategies in an attempt to unravel barriers that have been identified, while simultaneously addressing the challenges to improving the quality of life in the township. This will be done by analysing a legislative framework and thereafter replicating the best practice used locally, nationally and internationally.. It also seeks to associate with individuals within local government in addition to groups that are like minded in combating the concern. The existing environmental regulations and the present economic situation are sound starting points. Together they present an opportunity to change the prevailing attitudes towards recycling. Finally, a number of conclusions that were arrived at during the study will be followed by recommendations. These will be based on the literature review and observations.

An examination of public participation in decision-making within the IDP processes with reference to Mhlontlo Local Municipality

Public Participation is widely accepted as a way to strengthen the pillars of democratic and accountable governance. In South Africa, public participation is receiving prominence and increasing attention especially at local government level as this level is regarded as the sphere of government closest to the people. The new democratic government in South Africa regards public participation as a cornerstone of democracy. Ackerman (2004:448) asserts that the opening up of the core activities of the state to societal participation is one of the most effective ways to improve accountability and governance. Such accountability and involvement can be better achieved when communities are part of decision making processes in their communities. In South Africa, public participation was heralded by various pieces of legislations which obligated the public to participate and have a say in the decisions taken by their communities. Section 152 of the constitution: Constitution of the Republic of South Africa (Act No 108 of 1996) requires local authority to “encourage the involvement of local communities and community organizations in matters of local government” Informed by the broad principles of the Constitution, the White Paper on Local Government 1998 introduced the notion of developmental local government. According to this Paper, “developmental local government is defined as local government that is committed to working with citizens and groups within the community to find sustainable ways to meet their social, economic and material needs and improve the quality of their lives”. It is through the process of public participation that citizens are given the opportunity to provide input and partake in decision making on service delivery and governance matters of their municipalities. It is widely acknowledged that active public participation is evidence of deepened democracy and can assist municipalities in i) enhancing service delivery ii) making government and officials more effective and accountable and most importantly involve the communities in decisions affecting their lives and communities. By and large, community involvement through public participatory systems ensures that municipalities incorporate the developmental needs of the people. Theseneeds are expressed and consolidated in municipal integrated development plans. To realise the above, the White Paper on Local Government 1998 suggests that “municipalities should develop mechanisms to ensure citizen participation in policy initiation and formulation, and the 3 monitoring and evaluation of decision-making and implementation”. As outlined above various laws gave a new meaning and a legitimised mandate to the role of local communities in the development of their communities. Informed by the above, this study examines the extent to which public participation influences decision making within the IDP processes and by association its impact on service delivery. This study is premised on the widely accepted view that public participation is a process involving the community or the public to gather opinions, investigate the needs, desires and wishes of the local community and to ensure that they as the community are involved in the decision making processes of their municipality. The study is of the view that the IDP processes represent a structured vehicle to enable citizens and groups to influence decision making through institutionalised municipal participatory structures. By so doing, the public and the government form a pact/partnership to ensure that the needs and aspirations of the community receive priority in the IDP processes.

An evaluation of the provision of houses in the Eastern Cape at Intsika Yethu local municipality: the case of Joe Slovo informal settlement at Chris Hani District Municipality (for the period 2009-2011)

The research seeks to evaluate the housing service rendering in the Intsika Yethu Local Municipality with special reference to the Joe Slovo informal settlement at Chris Hani District Municipality. The introduction provides the general overview of the study and provides a background to the intention of the research to evaluate the housing services provision in the municipality. The problem statements briefly describe the problem identified in the study and the objectives of the study are set. The theoretical framework is provided and the theories used to evaluate the housing service are discussed which are institutional theory and the system theory. The importance of conducting the research is discussed and the limitations of the study are discussed in the research. Importantly, the study plan directs the researcher in the direction towards the goals of the research. Also the terms used in this study that are not clear were defined to avoid misinterpretation; misunderstanding and confusion of words and terms. The review of the current literature on the theoretical framework and the nature and place of public administration was discussed. The policy process and the nature and place of policy making as well as steps in policymaking were discussed. The nature and place of policy implementation which includes all the functions was discussed in the study. The policy analysis and evaluation as the final step in the policy process including the stages in policy analysis and evaluation i.e. input phase; processing and conversion phase; output phase, impact/effect phase were discussed The legislative framework for rendering of housing services in South Africa was discussed as it influence and affects the housing service rendering in Intsika Yethu Local Municipality. The role of municipal authorities in the rendering of housing services was discussed. The permission to conduct research was received from Intsika Yethu local municipality on the 13 October 2009 from the Municipal Manager. The research design was explained together with research approaches and strategy as qualitative and quantitative. The research methodology with a clear population and sampling for the study as well as the data collection instruments and procedures as questionnaires; literature study and interviews were explained. The ethical considerations are discussed. The data analysis and interpretation was conducted to enable the researcher to identify patterns which are consistent within the data. The theory and techniques for data analysis was discussed to link the theory and data analysis. The demographics of chief officials and political office bearers as respondents include their age; year of service, home language, gender, the academic qualification as well as the different stakeholders were analysed. The housing as essential services in the initiation of policy which the input phase of the Systems theory analysis was conducted and the data on the nature of housing services as output phase were analysed and discussed. The data on the structural problems were analysed and discussed. Also the analysis was conducted on the legislative framework for housing x services. The problems with the rendering of housing services especially administrative enabling problems as a processing phase in the policy process were analysed and discussed. And lastly, the possible solutions to the solving of housing problems were discussed and analysed. The findings of the study were provided and discussed and the concluding remarks were provided to whether the problem is real and whether the hypothesis is true and valid. The recommendations of the study were provided to enable Intsika Yethu Local Municipality to improve the housing service provisioning and ultimately to provide better service delivery.

An evaluation of the impact of the provincial housing policy in the Nxuba Municipality

The Eastern Cape Department of Housing has a constitutional and legislative mandate to provide houses to the poor and disadvantaged citizens living within the province. Parliament must also, according to the Constitution of the Republic of South Africa, 1996, as amended, take reasonable legislative and other measures within its available resources to achieve the progressive realisation of the right of citizens to have access to adequate housing (section 26 (1) and (2)). The commitment to improve the existing housing situation, namely the serious lack of adequate housing and basic services in urban townships and rural settlements, is thus in the first instance a policy matter and secondly a financial matter. However, despite the existing policy measures, such as the Housing Act, 1997 (Act 107 of 1997), the rendering of housing services resulted in uncompleted and defective houses due to inexperienced contractors providing poor workmanship and also corruption in the housing programmes. The rendering of housing services as a functional area has constitutionally been given to the national and provincial legislatures in South Africa. The Constitution allocated this function to the local sphere of government. Municipal authorities are the facilitators of sustainable housing services to (xiv) citizens on behalf of the national and provincial spheres of government. The study was thus conducted within the Nxuba local municipality which is one of eight local municipalities in the Amathole district municipality. The purpose of the study was to evaluate the implementation of the provincial housing policy and to determine the impact of the existing policy on the housing needs of the citizens of the Nxuba local municipality. For this purpose the fundamental and overall study problem was found to be that the rendering of housing services at the Nxuba local municipality is hampered by the implementation of an inadequate provincial housing policy and by incompetent municipal personnel and that these actions do not satisfy the growing demand for sustainable and suitable housing. The hypothesis was furthermore based on the fact that the existing provincial housing policy is inadequate to satisfy human needs and impacts negatively if not harmfully on human well-being. The study revealed that besides the implementation of an inadequate housing policy by incompetent municipal personnel, there are economic, social, political, physical and environmental effects on the citizens. As far as the environmental is concerned, the staging of protest marches resulting in the burning of tyres, rubbish cardboards and road barricades had caused serious air pollution which might lead to the spread of diseases such as TB, cancer and bronchitis when people inhale the poisonous gas evolving from smoke such as carbon monoxide (CO) and sulphur dioxide gases. Secondly, there is an economic impact on the citizens. Houses have been built away from town and people are compelled to commute between the town and their place of residence on a daily basis. With a continuous increase in the petrol price and its associated increase in transportation costs people pay large amounts to get to town. Furthermore the building of the RDP houses frequently comes to a standstill, builders, plumbers and carpenters lose their jobs. People’s income levels fall, impacting negatively on economic activity.

The efficacy of integrated development plan in enhancing service delivery in Lepelle-Nkumpi Local Municipality, Limpopo Province

(Planning and Management)) -- University of Limpopo, 2019 / The new democratic government has introduced integrated development planning as a strategy to enhance service delivery at the municipal level. This study intends to investigate the efficacy of IDP in enhancing service delivery in Lepelle-Nkumpi local municipality. This study adopted a normative and evaluative research design. Data was collected using households survey, interviews, observation and literature review. A total of 80 households and 6 key informants participated in the study. The finding revealed that Lepelle-Nkumpi local municipality has been implementing the IDP. The integrated development planning has several importance’s for the municipality in particular to addressing service delivery backlogs, promoting community participation towards determining the needs and priorities as well as improving integration and coordination. However, the implementation of the IDP encountered certain challenges including amongst other poor shortage of resources, incomplete projects poor community participation and political meddling. another finding shows that the municipality has increased the level of services to beneficiary households more especially the delivery of electricity while the provision of water, sanitation and refuse removal are still inadequate. However, due to water and electricity cut-off the households developed some coping strategies. Most households reported their dissatisfaction with the provision of water, sanitation and refuse removal. Regarding involvement of communities in service provision respondents highlighted that municipalities held consultation sessions, IDP forums and ward councillor meetings. However, communities are still dissatisfied about their level of involvement. Despite the overall achievements by the municipality in rendering basic services, there is still a service delivery backlog caused by corrupt practices, shortage of resources, lack of capacity and improper targeting. The finding further shows that the implementation of the IDP has contributed significantly to enhance service delivery in the municipality. It is evident that all the development planning and programmes of the municipality start with the IDP hence the municipality is able to plan and deliver in accordance with the intended needs of the people. The services viii and infrastructural projects implemented through has assisted the municipality to provide basic service such as water, electricity and sanitation. In addition, the municipality has also implemented infrastructure including roads to benefit the community. However, the municipality has not fully achieved the provision of basic services due to poor implementation of the IDP which was caused by lack of capacity, poor community participation and shortage of resources. As a remedy, the study recommend that the municipality should give priority to improve the provision of water, electricity particularly for new settlements, sanitation and refuse removal. It is further recommended that the municipality should pay attention to improve community participation, efficient use of MIG and building its capacity to strengthen the planning and implementation of the IDP. / National Research Foundation (NRF)

The relationship between service delivery protests and crime in the Sekhukhune District of the Limpopo Province

To achieve the study a qualitative approach was adopted. Focus group discussions were held with 10 discussants in each of the municipalities within the Sekhukhune District Municipality (10 in Elias Motsoaledi Municipality, 10 in Ephraim Mogale Municipality, 10 in Greater Tubatse Municipality, 10 in Fetakgomo Municipality, and 10 in Makhuduthamaga Municipality).Thematic analysis were used to analysed data collected from 50 participants. The results revealed that lack of service delivery, corruption, poor housing and unemployment cause service delivery protests. Service delivery protests turn violent due to community frustrations and police presence escalates the violence. Sekhukhune District Municipality members participate in violent service delivery protests due hopelessness and lack of knowledge of participatory mechanisms. Road barricading, tyre burning and vandalism are the nature of criminality associated with service delivery protests. Public protests are caused by a myriad of factors; however the findings indicate that there is a gulf that exists between the public and the municipal authorities. The public voice seems not to be heard by authorities, which leads to the public engaging in public protests. Public protests come only as a last resort, after all public participation avenues have been exhausted including the failure of the authorities to respond timeously to public demands. The study was able to determine the relationship between service delivery protests and crime. Sekhukhune District Municipality need to explore ways for both the invited spaces and invented spaces of participation to co-exist. This will provide for early detection (warning signs) for the levels of frustrations and subsequent protests.

An investigation into the prevalence of unethical behaviour in a South African Municipality: A case of Vhembe District Municipality

Municipalities are responsible for providing services such as maintenance of local roads, refuse removals, water supply and sanitation, amongst others. However municipalities’ unethical behaviour have produced many disadvantages for themselves and the society at large. Effective and efficient service delivery is negatively affected by unethical behaviour resulting in the waste of government millions of rands each year, money that could have been spent on delivering services. The fact that there is unethical behaviour in municipalities can be interpreted as a total absence of ethical culture in the behaviour of municipal officials. Municipal officials are encouraged to uphold moral principles such as impartiality, accountability and trustworthy while performing their official duties. Given this background, the research project attempted to provide explanations for the patterns of unethical conduct and also pointed out strategies that could be employed to curb unethical behaviour in municipalities. For the purpose of this study, the researcher employed both qualitative and quantitative research methodologies. The researcher used purposive sampling to select respondents of the study. Two (2) instruments were used to collect data, namely, questionnaires and interviews. To analyse data, two types of data analysis were used. For data collected through questionnaires, the researcher used the Statistical Package for Social Sciences to analyse data. Data collected through interviews were analysed through the use of thematic analysis in the form of narrative. The study revealed specific unethical behaviour that were prevalent at Vhembe District Municipality. The study indicated that senior municipal officials must ensure that ethics initiatives systems and programmes should be put in place so that conducive ethical environment is created. The results indicated that despite challenges, employed strategies provided desired results. Specific solutions such improving employment practices and procurement activities were recommended that could improve ethical standards in the municipalities. / NRF

Challenges of Service Delivery in South Africa: A case of Gert Sibande District Municipality

PhD (African Studies) / Department of Development Studies / Protests for basic services in South Africa are a relatively new phenomenon. Noticeably, they now happen almost on a daily basis. The manner in which they manifest is at times worrisome. Under the new political dispensation after 1994, South Africa has seen an unprecedented mushrooming of protests for services. Like other provinces across the country, Mpumalanga Province was also hit by the protests for services between 2004 and 2010. Since 2008, Gert Sibande District Municipality has experienced more intensified protests for service delivery, wherein communities were mobilized and marched to various local municipalities demanding improved services by these municipalities. The study aimed to establish some of the sources of these protests, their trends and their impact with the view to propose some solutions. To achieve this goal, the study used document analysis and empirical data obtained through interviews. Firstly, the study provides a historical background and overview of the three municipalities which fall under Gert Sibande District Municipality, namely: Msukaligwa, Mkhondo and Dr. Pixley Ka Isaka Seme. It further investigates the causes of violent protests for services in these municipalities. Attention is given to various pieces of legislation that establishes Local Government in South Africa. The socio-economic conditions of the three municipalities are also examined. The key findings from the interviews that were conducted pointed out factors that gave rise to the violent protests at the three municipalities. Amongst them was that the protests were politically motivated. Some were caused by lack of resource allocation and lack of human capacity to deliver services, lack of the political will by both the political and government representatives to deliver on their mandate, as well as the criminal elements that hijacked the protests. It is the mandate of government to deliver quality services to the people uninterrupted as prescribed by the Constitution. This will minimise the ongoing protest for services in the country. / NRF

Analysis of municipal demarcation on financial non-viability of the Vhembe District Municipality

This study investigates whether municipal demarcation addressed the challenge of financial non-viability in the Thulamela and Makhado local municipalities and the Vhembe District Municipality. The study also seeks to establish the main causes of demarcation disputes and whether the Municipal Demarcation Board (MDB) consulted the villagers in the Vuwani and Malamulele areas. The study examines whether financial viability is the sole or core factor in determining municipal boundaries. The study opted for a mixed-methods research approach using positivism and interpretivism research philosophies, including key informant interviews with municipal officials of Thulamela and Makhado local municipalities and the Vhembe District Municipality and a survey of households in the Vuwani area (previously under Makhado Local Municipality) and the Malamulele area (previously under Thulamela Local Municipality). The data were complemented by documentary analysis, including annual reports, financial statements, literature review, and legislation pertaining to financial management and local government. The study provides empirical insights into the relationship between municipal boundary demarcation and financial viability. It suggests that municipal boundary demarcation did not address the challenge of financial non-viability in the Vhembe District. The study also provides that the MDB did consult the villagers of the Vuwani area and that the main causes of demarcation disputes were the location of the newly established Collins Chabane Local Municipality. The study recommends that the South African government and the MDB should consider other factors provided for in the Local Government: Municipal Demarcation Act when demarcation decisions are made and that financial viability cannot be used to trump other factors in the restructuring of local government. The implications of this is that the government must address service delivery challenges in the Malamulele and Vuwani areas and that municipal demarcation cannot be used as a solution for financial challenges, especially in rural municipalities. The study includes implications that the MDB can explore other methods to foster stakeholder engagement and public participation. The study contributes to the body of knowledge within the sub-area of financial viability and public participation in the discipline of Public Administration and Management. / Public Administration and Management / D. An investigation into citizens' trust in service delivery in Makhado Municipality, Limpopo Province, South Africa

Thesis (MPAM.) -- University of Limpopo, 2019 / The purpose of the study was to investigate citizens’ level of trust in service delivery in Makhado Municipality by assessing the relationship between the performance of local government and the level of trust of citizens in the Municipality. In addition, the study sought to establish whether citizens’ involvement in decision-making in local government has an effect on their level of trust; and to establish the approaches which are important to improve citizens’ trust in local government. Data was collected through a questionnaire which was administered to 100 residents of Makhado Municipality. The findings of the study revealed that the citizens of Makhado Municipality do not trust in the service delivery in the Municipality. Residents are dissatisfied with most of the services they are receiving from the Municipality. It was determined that water shortage is the biggest problem in the Municipality, and residents spend days without water which poses serious risks to their health. Housing provision is another area that residents are displeased with. There is no transparency in the allocation of RDP houses, nepotism and corruption are rife and the quality of these houses is also poor. The area of roads and storm water supply is also of concern. Roads and streets in the municipality are in a bad state with potholes everywhere. Some roads and streets that were tarred have been turned into gravel roads, gravel roads in villages are also in a bad state of disrepair because they are not consistently maintained. The findings further revealed that service delivery challenges in the Municipality are caused by a lack of consultation and leadership, as well as corruption and if these three factors are addressed, service delivery will improve and trust would be fostered amongst citizens. This study recommends that the Municipality should develop its own anti-corruption strategies; invest in research and form partnerships with tertiary institutions; improve public participation and consultation; and collaborate with other government departments. Unfortunately, the research findings cannot be generalised to other municipalities since they differ in terms of categories and responsibilities. Nonetheless, some ideologies of the recommendations can be applied to other municipalities.
