La Contratación Pública es una de las actividades del Estado con más riesgo de corrupción y mal destino de los fondos públicos; debido justamente a la gran cantidad de dinero que se destina anualmente para dicho fin. Teniendo en consideración dicho escenario y sobre todo con la finalidad de proteger los fondos públicos cuya finalidad debe ser, exclusivamente, la satisfacción del interés público que nuestra legislación vigente sobre las contrataciones con el Estado ha regulado a lo largo de los años determinados impedimentos para contratar con las entidades públicas dirigidos a altos funcionarios públicos y a sus cónyuges, convivientes y parientes más cercanos; esto con la finalidad de evitar cualquier tipo de riesgo de corrupción o favoritismos cuyo único propósito sea la satisfacción de un interés particular. Es a la luz de estos hechos, entonces, que en el presente Informe Jurídico se cuestiona el análisis realizado por el Tribunal Constitucional en una de sus sentencias donde declara que dichos impedimentos referidos a los parientes más cercanos de los Congresistas de la República vulneran derechos constitucionales; sin tomar en cuenta la finalidad de estas restricciones ni el alto riesgo de corrupción y favoritismos que habría si no se contaran con los mismos. / Public Procurement is one of the activities of the State with the highest risk of corruption and bad use of public funds; precisely due to the large amount of money that is allocated annually for this purpose. Taking into consideration this scenario and above all with the purpose of protecting public funds whose purpose must be, exclusively, the satisfaction of the public interest that our current legislation on contracting with the State has regulated over the years certain impediments to contracting with public entities aimed at senior public officials and their spouses, partners and closest relatives; this in order to avoid any type of risk of corruption or favoritism whose sole purpose is the satisfaction of a particular interest. It is in light of these facts, then, that in this Legal Report the analysis carried out by the Constitutional Court in one of its judgments is questioned where it declares that said impediments referred to the closest relatives of the Congressmen of the Republic violate constitutional rights ; without taking into account the purpose of these restrictions or the high risk of corruption and favoritism that would exist if they were not available.
