No. of bitstreams: 1 Rafael Jose Nadim de Lazari.pdf: 1630911 bytes, checksum: 0bce27eb4913eb1686840803d21b3f7f (MD5) Previous issue date: 2015-10-26 / Coordenação de Aperfeiçoamento de Pessoal de Nível Superior / The discussion of the operational dimensions of the National Council of Justice in its intra-court relations (within the Judiciary) and inter-institutional (toward the other functions and republican institutions) represents an attempt to, adopting as common denominator the reciprocal constitutional dialogue between organs and agents that make up the Democratic State of Law of the Federative Republic of Brazil, analyze how the new member of the adjudicative function, brought by Constitutional Amendment nº 45/2004, may represent unique opportunity that administrative and constitutional body entirely forged in consolidated democracy after 1988 provide guidelines applicable to all other institutions, using the homeland constitutional history practices ("how to" and "how not to do") and gestation of innovative performance modes that take advantage to the Brazilian State. Thus, based on a thorough investigation of the Judiciary in contemporary, through the National Justice Council assignments within the Republican function which integrates, and reaching a very broad context of dialogue, not restricted only to the judicial environment. The aim is to operationalize dimensions of the activities of the National Council of Justice in this process, which currently has gone far beyond his assignment of only covering the peripheral aspects of the jurisdictional activity take place in fair, fast and effective way. Presenting other modus operandi that not only the traditional that just mentioned is modestly intended here / A discussão das dimensões operacionais do Conselho Nacional de Justiça nas suas relações intrajudiciais (dentro do Poder Judiciário) e interinstitucionais (para com as demais funções e instituições republicanas) representa a tentativa de, adotando como denominador comum o diálogo constitucional recíproco entre órgãos e agentes que compõem o Estado Democrático de Direito da República Federativa do Brasil, analisar de que maneira o novo integrante do Poder Judiciário, introduzido pela Emenda Constitucional nº 45/2004, pode representar oportunidade única de que um órgão administrativo-constitucional forjado inteiramente na democracia consolidada pós 1988 estabeleça padrões universais e interfaces operativas com todas as outras instituições, a partir do aproveitamento de práticas da história constitucional pátria ( como fazer e como não fazer ) e da gestação de modos de atuação inovadores que aproveitem ao Estado brasileiro. Sendo assim, partindo de uma contextualização do Poder Judiciário na contemporaneidade, passando pelas atribuições do CNJ dentro da função republicana, e chegando a uma fase amplíssima de diálogo que não se restrinja apenas ao ambiente judiciário, o objetivo é operacionalizar dimensões da atuação do Conselho Nacional de Justiça em todo este espectro, algo que atualmente tem ido muito além de sua atribuição de apenas proteger os aspectos periféricos da atividade judicante, para que a atividade jurisdicional ocorra de maneira proba, célere, eficaz e padronizada.
