Participa??o privada na investiga??o criminal no Brasil : possibilidades e limites

Therefore, the research ensues from the study of the fundamental rights to establish the existence of the right to law enforcement and investigative action to be executed by the state. Such intervention should be developed through procedures and institutions created and maintained by the state, which also determines the need for private investigative action in the absence or inefficiency of the official criminal investigation. The work is based on the right to investigative action resulting from the duty to provide protection, as a means to allow private participation in the investigation of crimes, which are also analyzed by the decisions of international courts of human rights that make use of similar paths to determine the need for preliminary criminal investigation as a means to protect fundamental rights. Furthermore, are exposed limits as to who investigates and how that can be produced by private participation. / Este trabalho tem por objetivo analisar a possibilidade da participa??o privada na investiga??o criminal brasileira, envolta pela obrigatoriedade e pela oficialidade da atua??o do Estado. Para tanto, a pesquisa parte do estudo dos direitos fundamentais para estabelecer a exist?ncia do direito ? a??o policial e investigativa a ser efetivada pelo Estado. Tal interven??o deve ser desenvolvida por meio de procedimentos e institui??es criados e mantidos pelo ente estatal, o que tamb?m determina a necessidade de atua??o particular em caso de aus?ncia ou inefici?ncia da investiga??o criminal oficial. Fundamenta-se o trabalho no direito ? investiga??o como decorr?ncia de um dever de prote??o, como meio de permitir a participa??o privada na apura??o de delitos, pelo que tamb?m s?o analisadas decis?es de cortes internacionais de direitos humanos que percorrem caminhos similares para determinar a necessidade da apura??o preliminar criminal como meio de resguardar direitos fundamentais. Ainda, s?o expostos limites quanto a quem investiga e quanto a que pode ser produzido pela participa??o privada.
