The aim of this thesis is to describe the key issues of employment of persons with disabilities as they are one of the most endangered category of employees and their protection in the scope of the legal regulation. The thesis is systematically divided into five chapters, each of them dealing with different aspects of the topic. Chapter one is introductory and defines basic terminology. This chapter is subdivided into three parts. Part one analyses the historical development of the approach of the majority society to the people with disabilities and focuses primarily on the medical and social model of disability. Part two deals with the definition of the persons with disabilities as defined in the international and European law. Part three further addresses the issue of this definition in Czech law. Chapter two provides an outline of relevant international sources as well as the sources of the European Union. It mentions the main documents of International Labour Organization, United Nations, Council of Europe and also the essential documents of European Union. Social protection of persons with disabilities My thesis treats social protection of persons with disabilities. The purpose of the thesis is to analyse the Czech and French legislation in the field of social security of person with disabilities. The thesis is composed of four sections. The first section which is divided into two chapters is dedicated to generalities - the first chapter gives a theoretic definition of the handicap and persons with disabilities. The second chapter investigates the protection of person with disabilities from the point of view of the international law and European Union's law that represent the foundation of the Czech and French legal system. The second section which is divided into five chapters analyses the Czech legal order. The third chapter provides an outline of Czech legal definition of relevant terms. The subject of this Master's Thesis is to present some legal aspects of employment of persons with disabilities. This thesis deals with the subject particularly with respect to national policy of employment and individual labour-law relations. The largest part of text is devoted to the efforts of the state to reach higher employment rate of persons with disabilities and to compensate their inherent handicaps. This thesis is divided into seven thematic parts. The introduction is followed by part that defines basic terms of employment of people with disabilities which are not legally defined. The issue concerns the terms which are regularly mistaken in common conversation such as disability and handicap. The third part contains an overview of the most important documents, of significant international organizations, which contain the definition of persons with disabilities. These most significant international organizations are the International Labour Organisation, the World Health Organization, the United Nations, the Council of Europe and the European Union. 1 Employment of persons with disabilities Abstract This thesis deals with the employment of people with disabilities. People with disabilities belong to the society with specific needs. These needs have to be taken into account when these people are employed. This thesis focuses on taking into account the specific needs of this group of employees and discusses the possibilities of making them succesful on the labor market. The aim of this work is to evaluate the employment of people with disabilities both from the theoretical and practical point of view and to create an overview of how the employment of people with disabilities is taking place and what it means for their employers. Introdução: o aumento da sobrevida das pessoas com deficiência ao longo dos últimos anos faz com que vivam tempo suficiente para chegar à velhice. A baixa implementação de políticas públicas específicas para esse segmento provoca um vazio entre o que é necessário e o que está disponível, gerando mais aflição e incertezas quanto ao futuro. A deficiência e o envelhecimento são duas vias complexas da experiência humana que se interconectam neste estudo. Objetivo: Compreender a experiência do envelhecimento a partir da perspectiva de pessoas idosas com deficiência física. Método: considerando a adequabilidade da abordagem compreensiva para esta pesquisa, adotou-se o referencial teórico e conceitual da Fenomenologia Social de Schütz. Os participantes foram selecionados no cadastro de associados da Associação dos Deficientes de Mato Grosso. Foram selecionados informantes que atenderam aos seguintes critérios: pessoas com deficiência física congênita ou adquirida, de ambos os sexos e com idade igual ou superior a 60 anos, vivendo em comunidade. Foram excluídas as pessoas com deficiência adquirida após os 40 anos, com o intuito de incluir apenas as pessoas com longo tempo de experiência na deficiência física, antes da velhice. Resultados: o estudo possibilitou a compreensão das seguintes categorias concretas do vivido: a perpetuação do estigma; o avanço do declínio físico e a permanência das barreiras à inclusão social; as necessidades e as redes formais e informais de apoio social; a capacidade para o trabalho e a autonomia como sinônimo de resiliência; a descrença e incertezas de projetos futuros. Essas categorias se apresentaram inter-relacionadas e acomodadas às condições do meio e às singularidades em diferentes trajetórias. Considerações Finais: a experiência de envelhecer com deficiência física não está relacionada apenas ao corpo disfuncional ou à idade em si, mas também a recorrentes aspectos psicossociais e culturais. Acredita-se que os resultados podem subsidiar as famílias, a sociedade e, sobretudo, as políticas públicas no desenvolvimento de ações de saúde mais socialmente aceitáveis direcionadas às pessoas idosas com deficiência física. / Introduction: Increasing the survival of people with disabilities over the last few years makes them live long enough to reach old age. The low implementation of specific public policies for this segment causes a gap between what is needed and what is available, generating more distress and uncertainties about the future. Deficiency and aging are two complex avenues of human experience that interconnect in this study. Objective: To understand the experience of aging from the perspective of elderly people with physical disabilities. Method: considering the adequacy of the comprehensive approach to this research, the theoretical and conceptual framework of the Schütz Social Phenomenology was adopted. The participants were selected in the register of members of the Association of Disabled People of Mato Grosso. We selected respondents who met the following criteria: people with congenital or acquired physical disability, of both sexes and aged 60 years or over, living in a community. Persons with disabilities acquired after the age of 40 were excluded in order to include only persons with a long experience of physical disability prior to old age. Results: the study made possible the understanding of the following concrete categories of lived: the perpetuation of stigma; the progress of physical decline and the persistence of barriers to social inclusion; formal and informal needs and networks of social support; the capacity for work and autonomy as synonymous with resilience; the disbelief and uncertainties of future projects. These categories were interrelated and accommodated to the environment conditions and the singularities in different trajectories. Final considerations: the experience of aging with physical disability is not only related to the dysfunctional body or age itself, but also to recurrent psychosocial and cultural aspects. It is believed that the results can subsidize families, society and, above all, public policies in the development of more socially acceptable health actions aimed at elderly people with physical disabilities.

Title of thesis: Employment of persons with disabilities Abstrakt v anglickém jazyce Persons with disabilities are a vulnerable group of citizens, and not only in terms of employment. Finding their spot in the labor market is made difficult by their handicap and often by low or incomplete education. That is why legislation is in place to help them compensate for their initial disadvantage by raising them to the same level as the rest of job seekers. The goals of this thesis are to analyze and evaluate the current regulation of the employment of people with disabilities, and to research the practical side of this issue in the current labor market. The thesis tries to find out the forms of assistance offered to persons with disabilities and the actual employment options open to these persons. The thesis consists of four chapters. The first chapter defines the basic terms. Particular attention is paid to the definition of a person with disabilities, both in the context of international and European law and within the Czech legal system. Comparison of the social protection of persons with disabilities in the Czech Republic and in France This thesis deals with the social protection of the persons with disabilities in Czech and French legal order. The main aim of this thesis is to analyse both these systems and then propose certain changes which could enrich Czech legal order in this field. The thesis is devided into five chapters. The first chapter defines basic concepts - social protection and individual with health disabality. The second chapter concentrates on the historical development of the protection of disabled persons in international and European law and provides an overview of the most important international and European sources. In the third and fourth part, I describe in detail the Czech and French legislation. In both cases, at first I focused on the state institutions and the private subjects supporting disabled people. Furthermore, both chapters illustrate the protection of persons with disabilities in social security law and then position of disabled persons in the employment relationship, especially the acces to employment, the prohibition of their discrimination and the special rights and obligations of their employers.
