Criminal Aspects of Pornography Summary The main purpose of this thesis is to introduce the phenomenon of pornography in terms of criminal law, to point out flaws in the current relevant criminal legislation in the Czech Republic and to propose a possible solution in a form of potential legislative changes. The thesis is composed of five chapters. The first chapter deals with definition issue of vague legal term of "pornography" and other related terms ("child pornography", "hardcore pornography"). Furthermore, it briefly describes attitudes to the term of pornography in the legal systems of Slovakia and the United States of America and examines the issue of so called virtual pornography. The second chapter provides an overview of the related most important international instruments such as anti-pornography treaties concluded in the early 20th century as well as modern United Nations and Council of Europe treaties and European Union legal documents aiming at combat sexual exploitation of children and child pornography. The third chapter outlines historical development of the Czechoslovak and Czech criminal regulation of pornography in the former Austro-Hungarian criminal codes, recodification draft bills from the era of the First Czechoslovak Republic, socialist criminal codes of 1950 and 1961 and later...

An investigation into existing measures aimed at restricting the use of the internet as an avenue to initiate sexual activities with adolescents

The Internet allows individuals to make contact with other individuals, without divulging personal details or information. This means that the user has the choice to remain anonymous. Although the Internet has numerous advantages, the anonymity with which it can be used could cause certain problems. The anonymous nature of the Internet makes it extremely difficult to determine who is gaining access to personal information about Internet users. Thus it becomes an ideal avenue for paedophiles to gain access to information about adolescents and to use this information in the process to get close to, and to abuse them. Few parents who allow their children to use the Internet are aware of paedophiles’ activities on the Internet. This dearth of knowledge about the ways in which paedophiles operate, necessitates that parents and guardians should be educated about the potential dangers the Internet could hold for their children. This is especially necessary “as computers are becoming more and more a part of our daily lives, and computer literacy is a necessity in today’s computer driven world” (Haupt, 2001:26). Within this study the qualitative approach has been used. Interviewing was used as a method of data collection. The purpose of the interviews was to probe particular aspects in depth. An interview schedule was used during the interviews as a guide for the interviewer, and contained relevant questions which ensured that all the necessary aspects were covered during the interview. The focus of the interviews was to determine new avenues that paedophiles utilise to approach children for sexual purposes. In addition, the interviewer enquired if the experts have dealt with South African case studies, where an individual used the Internet to gain access to children. The adequacy of current South African legislation regarding child pornography and sexual activities with adolescents via the Internet was explored. Research participants were asked to discuss the existence of preventative measures to curb the use of the Internet for the enticement of adolescents for sexual purposes. Subsequently the existence of awareness campaigns to make parents or caregivers and children more aware of the dangers that the Internet poses for adolescents was discussed. After conducting the interviews, they were transcribed and interpreted. The research findings derived from the interviews were categorised and these categories were discussed. The analysis of the data indicate that the global problem with regards to the use of the Internet as an avenue to initiate sexual activities with adolescents is still vaguely grasped in South Africa. The fact that only one reported case of a child in South Africa that was approached by a paedophile online was identified, accentuates the dearth of knowledge regarding this social problem. Although it is not easily detectable, it is still a serious problem that needs to be attended to, especially when taking into account that more than three million South Africans have access to the Internet. In addition, children spend the majority of their leisure time using computers and being on the Internet (CIA – The world factbook: Communications South Africa, n.d.). Thus, this problem can only become worse in future. The Internet can be the child’s best friend, or worst enemy. Male Pornography Viewers' Perceptions of Asian Women

Objectification and sexual aggression are common themes in pornography. However, there are only a handful of quantitative studies that examine the role of race in pornography that included Asian women, a population that has been fetishized extensively and historically portrayed as hypersexual in mainstream media. There were also no studies on the self-reported attitudes of viewers around this topic. 96 male university students took a survey measuring the frequency and perception of their pornography use, their acceptance of sexual aggression myths, their objectification of Asian women, and their propensity to agree with microaggressions about Asian women. Results indicated that while problematic pornography use had a moderate positive association with the objectification of Asian women and acceptance of microaggressions against Asian women, there was only a slight positive association between problematic pornography use and acceptance of sexual aggression myths. Results also indicated that the strength of one's acceptance of racial microaggressions against Asian women and their level of problematic pornography use positively predicted the likelihood of one's acceptance of sexual aggression myths.

The main focus of this study is Benhabib' s concepts of the 'concrete other' and 'interactive' universalism, Cornell's 'ethical' feminist thought and Nedelsky's argument on 'rights as relationship'. The need for an affirmation of the feminine is emphasised. I argue that we should strive towards a 'new choreography of sexual difference' based on the ethical view that 'woman' cannot be described in the present. She is the beyond. My study explore the implications of ethical feminism for the possibility of the transformation of a legal system and society as a whole. In this regard it lays particular emphasis on Derrida's concept of 'justice as aporia' and justice as limit to a legal system. I discuss pornography as a concrete example of texts that may either frustrate transformation or contribute to it. I argue in . this regard that pornography should not be banned but that access to pornography should be subjected to restrictions. This approach will serve the ambigious nature of pornography as both a threat to and a vehicle for the exploration of the feminine in contemporary society. / Private Law / LL.M.

As sexual imagery has become a standard aspect of everyday life, it has impacted younger generations in terms of clothing and how they develop relationships. The popularity of social media applications has also helped to perpetuate the pornification of mainstream culture by focusing on physical appearance. The college hookup culture illustrates the lack of satisfaction that can result from the strictly sexual relationships highlighted in pornography. The Relationship between Exposure to Pornography, Victimization History, Attachment to Parents, and the Sexual Offence Characteristics of Adolescents who Sexually Offend

This study was focused on exploring the relationship between victimization history, attachment to parents, pornography exposure/use, and characteristics of the sexual offences committed by male adolescents. It was hypothesized that, the poorer the attachment to parents, the greater number of abuses experienced, and the more exposure to pornography, the more likely an adolescent would be to have had more victims, have offended against more age groups, have both male and female victims, have committed penetration in his sexual offences, and have been forceful or violent in his sexual offences. The study involved secondary analysis of a large data set that was based on prior administration of an extensive survey which also included a number of psychological measures and questionnaires. A total of 308 male participants ranging in age from 13 to 20 at the time of completing the survey were included in this study. Participants were 12-17 years of age at the time of their sexual offending. A series of regressions were used to examine if attachment to parents, history of abuse/neglect, and pornography use could predict the number of victims, age group of victims, gender of victims, sexual intrusiveness, and level of force in the sexual offences that had been committed by the participants. Predictor variables that emerged as important in this study were the duration of the sexual offending, having experienced three or more types of abuse, and exposure to live sex. In general, it was suggested that treatment efforts should focus on intervening promptly and reducing the duration of an adolescent’s sexual offending and that intervention for all types of abuse be prioritized. Additionally, it was recommended that future research seek to identify characteristics that might predispose certain victimized individuals to develop sexual offending behaviours in the future. In general, it was noted that further explorations are needed regarding applicable theoretical approaches, as well as the various factors, and interactions among factors, that contribute to the characteristics of sexual offences committed by male adolescents.

Regulating Internet Pornography as an Issue of Sex Discrimination

This thesis will critically analyse Australia’s censorship laws with a specific focus on the regulation of pornography distributed via the internet, a means of mass production and distribution of pornography. It will be argued that Australia’s current censorship laws are deficient because their focus is morality based. A morality based approach does not take into account what pornography is and does; in particular, the sex equality harms to real women and the inequality within society caused by pornography. This thesis will argue that the current censorship regime is an ineffective means of regulating internet pornography because it fails to address the complexities of internet regulation and the selling and marketing of sexual inequality online. This thesis will also argue that these censorship laws have had little or no impact in reducing the availability of pornography distributed via the internet. This thesis argues that a civil rights/equal opportunity approach to pornographic harm, as proposed by the anti-pornography civil rights ordinance drafted by American feminists Catharine MacKinnon and Andrea Dworkin (“the ordinance”), should be adopted into Australian law. The ordinance will be examined with a particular focus on how it can be amended and incorporated into Australian equal opportunity legislation in order to more effectively regulate the distribution of pornography via the internet in a manner that addresses the harms to social inequality caused by pornography.
