No. of bitstreams: 1 Manoel Osorio.pdf: 7224116 bytes, checksum: d6f4565e40f8c64b74b2f2a15e7d9b0e (MD5) Previous issue date: 2011-11-17 / The work aims to analyze the responsiveness of the Mediation in academic spaces of Law Bachelor in the city of Pelotas, as an alternative to Justice Access, as well as the representations produced and operated in such contexts of vocational training, and to identify and analyze any differences in the policies of Higher Education Institutions of different natures. The need of this study is justified on the importance that the Institutions reflect in Brazilian law, since they can be considered the bases of institutionalizing legal culture. For that, was taken into account the interface of three additional factors to form the research problem: Justice Access, as a Social Law; Mediation, as an alternative to face social conflicts; and the operator training of the law, to be the dynamic fundamental "actors" that promote or stop the two previous elements. The work consists of the theoretical analysis and field research which, we interviewed the Coordinator of the Law, Coordinator of Legal Aid Institutions, some teachers and students through semi-structured questions. However, it was shown that there is little receptivity in the Institutions from Mediation or other alternative form of conflict resolution that aims Justice Access. Those who have any work connected with these views or Mediation, its manifestations are still unknow to the detriment of traditional tendencies of Law. The result of this study showed that the Institutions are not fully prepared for these alternative trends, also do not have physical space for the practice of Mediation or professional and prepared content for this purpose, and the few professionals who work or seek work to this perspective does not have contents and workload of their disciplines privilege. Credited to this is the manifestation of the field of Law of relational theory from Pierre Bourdieu that is intrinsic in Education Institutions and in the legal practices that influence an entire culture / O trabalho visa analisar a receptividade da Mediação nos espaços acadêmicos do Bacharelado em Direito no município de Pelotas, como alternativa de Acesso à Justiça, bem como as representações produzidas e operadas nesses contextos de formação profissional e identificar e analisar eventuais diferenças nas políticas de Instituições de Ensino Superior de naturezas distintas. A necessidade deste estudo se justifica na importância que as Instituições refletem no Direito brasileiro, já que podem ser consideradas como bases institucionalizadoras da cultura jurídica. Para tanto, foi levado em consideração a interface de três elementos complementares para compor o problema da pesquisa: o Acesso à Justiça, como um Direito Social; a Mediação, como alternativa de enfrentamento dos conflitos sociais; e a formação dos operadores do Direito, por tratar-se de atores fundamentais em dinâmicas capazes de promover ou obstacularizar os dois elementos anteriores. O trabalho é composto pela analise teórica e pesquisa de campo o qual, foram entrevistados os Coordenadores dos Cursos de Direito, Coordenadores dos Serviços de Assistência Judiciária das Instituições, alguns Professores e Alunos através de perguntas semi-estruturadas. No entanto, comprovou-se que nas Instituições há pouca receptividade da Mediação ou de qualquer outra forma alternativa de resolução de conflito que almeje Acesso à Justiça. Naquelas que possuem qualquer trabalho vinculado a estas perspectivas ou à Mediação, ainda são tíbias suas manifestações, em detrimento das tendências tradicionais do Direito. O resultado deste estudo comprovou que as Instituições não estão totalmente preparadas para estas tendências alternativistas, também, não possuem espaço físico para prática da Mediação ou conteúdo e profissionais preparados para esta intenção, e os poucos profissionais que procuram trabalhar ou trabalham esta perspectiva não tem privilégio nos conteúdos e carga horária de suas disciplinas. A isso se credita a manifestação do campo do Direito da teoria relacional de Pierre Bourdieu que esta intrínseca nas Instituições de Ensino e nas práticas jurídicas que influência toda uma cultura litigante
