Objektivní arbitrabilita jako limit transnárodního právního řádu / Objective arbitrability as the limit of a transnational legal order

Vítek, Michal January 2018 (has links)
ENGLISH ABSTRACT Objective arbitrability as a limit of the transnational legal order In general, the disertation deals with a topic of interaction between the transnational and national law in the area of international trade. Specifically, it attempts to use the concept of objective arbitrability as a limit of the privately-created system of law referred to as lex mercatoria (alternatively "new lex mercatoria"). The reason for the chosen methodology is to come up with the most objective criterion to demark the scope of the application of privately created norms. Despite the wide recognition of the NLM fenomenon among the scholars and even arbitrators, the parties of international trade contracts can not be certain whether (and to what extent) the choice of NLM will be limitating, especially in the face of later recognition and enforcement of their arbital awards. The findings of this dissertation flows from the analysis of transnational norms, decisions of both state courts and arbitration tribunals and the relevant sources of law-theory. Especially important is the description of the concept of lex mercatoria as such and the description of order public, both in national and international/european meaning as it represents the final limit of application of privately-created norms. The conclusion of the...

Otázky stylového pluralismu a portálová architektura v okruhu Benedikta Rieda / Questions of Style Pluralism and the Portals from the Circle of Benedikt Ried

Ramešová, Michaela January 2021 (has links)
The submitted dissertation's main object is an in-depth study of the portals created by the lodge of Benedikt Ried at Prague Castle and a group of portals that reflected the lodge's stimuli in Bohemian towns in the first half of the 16th century. The first all'antica portals in Moravia and Italianate works in Prague towns were also researched with the aim to analyse and better understand the contact of local "Gothic" tradition and incoming Italianate forms ca. 1500 in the area of interest on a wider theoretical background. The thesis consists of two parts. First, the key theoretical concepts of how to interpret the contact of the "Gothic" with the "Renaissance" relevant to the object of empirical study are introduced. As recent theoretical thought showed, the tendency to revise the interpretation of formal syncretism and pluralism in European architecture ca. 1500 stemmed, among others, from the need to correct several patterns common in former research methods, i.e. the presumption of stylistic unity, the effort to identify one principle through the "classical stylistic phase" supposed to be common to all artworks of a given time period, and the simultaneous use of the term "Renaissance" for both a set of stylistic features and a historical era connected with the idea of progress. All these were...

Nestátní právní systémy a pluralismus práva / Non state justice systems & pluralism of law

Ivančo, Alex January 2017 (has links)
The theme of this thesis is the assessment of the prerequisites for the pluralism of law and non-state justice systems to improve the possibilities of solving disputes in society. The main research question is whether non-state justice systems fulfil a social role in providing justice. The thesis should offer a descriptive analysis of the concept of legal pluralism and methodological procedures for the inclusion of non-state justice systems in the state. The outcome of the work should be an overview of the possibilities of interaction between different legal systems, whether formal or customary, of the different ways of resolving disputes in this environment, and of the contribution of such proposals to the reform of the legal environment that count on the real situation in society. The thesis of procedural pluralism and participatory methods of solving disputes that have a user, a citizen in the center of these systems is offered as a starting point for new designs. The final part of the work will therefore explore current approaches to improving legal systems that aim to increase participation of user based on their needs, and will include some cases for comparing individual programs to improve legal systems.

Antropologická kritika liberalismu u Charlese Taylora / Charles Taylor's anthropological critique of liberalism

Boudal, Jiří January 2012 (has links)
The thesis presents Charles Taylor's conception of liberalism where the negative concept of liberty is rooted in a positive moral ideal of authenticity. First of all, both the main motivations which led liberals to defend the pure negative concept of liberty and Taylor's claim that these motivations all depend on the atomistic ontology is examined. Later, this atomistic basis is refuted and Taylor's holistic approach is offered which relies mainly on concepts of the personal identity and of the so called strong evaluation. Following this, concept of authenticity is presented as the implicit ideal of modern identity. Authenticity is interpreted as a pluralistic moral ideal appreciating uniqueness although containing some general moral demands. The thesis also shows that such a concept of authenticity presupposes negative liberty. Finally, some political consequences of such a liberal theory are provided.

Logický pluralismus v historické perspektivě / Logický pluralismus v historické perspektivě

Arazim, Pavel January 2018 (has links)
Logical pluralism from historical perspective - Abstract The plurality of logics is understood as a challenge to seek a deeper understanding of the na- ture and import of logic. Two basic approaches to demarcation of logic are considered, the model-theoretic and the proof-theoretic one. Investigation of the history which led to these two appraoches identifies the postion of logic in Kant's epistemology as crucial for the devel- opment. An analogical development from Kant's conception of geometry to the plurality of geometric theories leads to a holistic view both of geometry and of logic. It furthermore proves essential to understand the pragmatic import of logic. Given the problems tied to the attempts to demarcate logic, inferentialism and logical expressivism are arrived at as jointly provid- ing the most appropriate account. These approaches are developed into a conception which stresses, in line with the historical perspective of the work, the ability of logic to develop.
