Nela foram contemplados os direitos sociais frutos das reivindicações dos movimentos sociais que estiveram em luta organizada - armada ou não - durante o período da ditadura militar (1964-85). Dentre eles, o direito à saúde, através da criação do Sistema Único de Saúde - SUS. No entanto, com a crise do Estado de Bem-Estar nos países centrais, a derrocada da URSS - simbolicamente representada pela queda do Muro de Berlim - e a crise do modelo desenvolvimentista vigente na América Latina até a década de 70, tomou força a ideologia neoliberal. Assim, a última década do século XX foi marcada pelo estabelecimento políticas públicas conforme essa doutrina no Brasil, o que causou efeitos negativos às políticas sociais, já que a ideologia neoliberal refuta energicamente a ação do Estado enquanto produtor de bens e serviços. Assim, seguiu-se um quadro de decomposição dos serviços de saúde graças às políticas de redução de gastos empreendidas pelos governos neoliberais. O presente trabalho tem o intuito de analisar a medida desses efeitos e o caráter dessa política neoliberal através da investigação de um caso específico que é a cidade de Marília-SP. / Abstract: The Federal Constitution of 1988 started de "democratic" period of Brazil's recent history. It contains social rights that are the outcome of claims of the social movements that were in organized struggle - armed or not - during the military dictatorship period (1964-85). Among them, the right to Health, through the creation of the "Unified Health System" (SUS, in the Brazilian abbreviation). However, with the crisis of the Social Welfare in the developed countries, the downfall of URSS - the fall of the Berlin Wall being its symbolical representation - and the crisis in the developmental model present in Latin America until the 1970s, the neo-liberalist ideology gained strength. Thus, the last decade of the 20th century was marked by the establishment of public policies that followed this doctrine, which came with negative social effects, since it is against the action of State as supplier of goods and services. A picture of decomposition of health services succeeded the policies of cost saving implemented by the neoliberals. The present work aims to examine the proportions of these effects and the issues of these policies through the investigation of a specific case: the city of Marília, SP. / Mestre

Orientadora: Iraíde Marques de Freitas Barreiro / Banca: Graziela Zambão Abdian / Banca: Maria Eliza Nogueira de Oliveira / Resumo: Trata-se de uma pesquisa qualitativa de estudo de caso que tem como problema investigar a elaboração do Plano Municipal de Educação de Marília (2015-2025) como elemento para a gestão democrática. Trabalhamos com o referencial teórico da Democracia Radical e Plural de Ernesto Laclau e Chantal Mouffe. Utilizamos a metodologia de pesquisa bibliográfica, bem como a análise da legislação correlata, das Atas do Conselho Municipal de Educação referente ao período de elaboração do Plano Municipal de Educação, compreendido entre 2014 e 2015, de entrevista semiestruturada e de outros documentos, objetivando responder ao problema da pesquisa. Concluímos que o Plano Nacional de Educação não faz distinção entre Constituições democráticas e outorgadas, podendo ocorrer sob a regência de ambas, diferentemente da relação anterior entre Constituições democráticas e autonomia municipal, na qual há uma relação direta entre elas, representando dupla condição de sua existência. Outra conclusão é que não há correspondência entre a previsão constitucional do Plano Nacional de Educação e sua efetiva elaboração. Analisamos as possíveis implicações do processo de elaboração do Plano Municipal de Educação de Marília na gestão da educação municipal, desde a sua concepção, sob a coordenação do Conselho Municipal de Educação, até a publicação da Lei Municipal nº 7.824/2015, que o aprovou e destacamos três pontos para concluir que a elaboração do Plano Municipal de Educação de Marília é o resultado último d... (Resumo completo, clicar acesso eletrônico abaixo) / Abstract: This is a qualitative case study research whose problem is to investigate the elaboration of Marília's Municipal Education Plan (2015-2025) as an element for democratic management. We work with the theoretical framework of Radical and Plural Democracy by Ernesto Laclau and Chantal Mouffe. We used the bibliographic research methodology, as well as the analysis of related legislation, of the Minutes of the Municipal Education Council referring to the period of preparation of the Municipal Education Plan, comprised between 2014 and 2015, semi-structured interviews and other documents, aiming to answer the research problem. We conclude that the National Education Plan does not distinguish between democratic and bestowed constitutions, and may occur under the direction of both, unlike the previous relationship between democratic constitutions and municipal autonomy, in which there is a direct relationship between them, representing a double condition of their existence. Another conclusion is that there is no correspondence between the constitutional provision of the National Education Plan and its effective elaboration. We analyzed the possible implications of the process of elaborating the Marilia Municipal Education Plan in the management of municipal education, from its conception, under the coordination of the Municipal Education Council, until the publication of the Municipal Law nº. 7.824/2015, which approved it.
