Politik und Organspende : eine Untersuchung zur politischen Umsetzung gesetzgeberischer Intentionen in der Gesundheitsversorgung / Politics and Organ Donation : a survey of the political implementation of the first German Transplantation Act

In Germany the procurement, distribution und transplantation of cadaveric human organs is understood as a public task. The institutionalization of a specific law on transplantation fall in with a picture of a growing government intervention in all parts of human life, which original had been organized individually by the members of society itselves. From a classical liberal point of view and in consideration of the principle of subsidiarity the institutionalization of a specific law on transplantation is wether a deserving process nor it had been necessarily implemented. The statistic data of organ donation in germany show that the expected increase of the number of available cadeveric organs as an assumed positive result of the new transplantation act - failed to appear so far. Moreover we have to notice that the politicians who are responsible for an adequate implementation of the legal conditions haven`t attended to their duties. As long as the official policy only accept altruistic motivation as an incentive to donate cadaveric organs the status quo won`t change. In these circumstances a slowly reduce of government intervention maybe leeds to a better policy on organ donation. This kind of policy should give people the chance to help themselves in using other incentives than the motive of altruistic help.

Organisation lokaler Nachhaltigkeit: Beharrung und Wandel auf kommunaler Ebene aus strukturationstheoretischer Sicht / Organization of local sustainability: Conservatism and change on the local levelin the light of structuration theory

This thesis analyzes the impact of sustainable strategies on local politics in Germany. Making use of structuration theory and different approaches in organization theory, the dissertation argues that it would be very difficult to increase the ecological effectiveness of local government using the idea of sustainable development. The essential aspects of the theoretical assumptions are confirmed by evaluating a wide range of empirical studies on Local Agenda 21, the Environmental Management and Audit Scheme and environmental impact assessment. It can be shown that the ecological effects of local sustainability are limited. Bureaucratization and the growing dominance of economic principles determine the logic of sustainability on the local level. Drawing on the theoretical considerations discussed here, the author concludes by suggesting ways in which the ecological effectiveness of local government can be strengthened.

This doctoral thesis examines organizational development in public management, using the example of a police department as a basis. It follows the theory of autopoietic social systems according to Niklas Luhmann and establishes what can be observed from a social science point of view within two subsystems of this public management organization (police authority and police clients) and what consequences may result from this. The dissertation consistently follows Luhmanns circular way of thinking in which every term used precludes knowledge of the following terms. The author adopts a critical stance towards Luhmann and persists on one central point where everything converges: an autopoietic social system is regarded as a social system which develops new communication elements from the communications of which it already consists.
