A partir do exame dos precedentes, evidencia-se que o tribunal mantinha uma relação conturbada com o positivismo ortodoxo: se, de um lado, o afirmava; de outro lado, flertava com argumentos que dele destoavam ou que o enfraqueciam. / This dissertation systhematises the decisions and the advisory opinions of the Permanent Court of International Justice in order to induce its understanding of international legal personality. Based on case law, it is evinced that there was a problematic relationship between the court and orthodox positivism: whereas the tribunal affirmed it, it often flirted with concepts that were contrary to it or that undermined it.
