M.A. (Social Work) / This study analyses the aims and objectives in probation service programmes and those formulated for probation services within more comprehensive social welfare programmes. Probation services refer to all the social work services aimed at preventing crime and promoting the social welfare and functioning of the offender, his dependants and the victims of crime. A programme refers to a group of interdependent activities that focuses on achieving objectives or a set of objectives. An aim refers to, a statement that describes the long-term goal of a programme. refers to an operational describes in specific, what goals or results the a certain period of time. An objective, on the other hand, statement in a programme which observable and measurable terms programme plans to achieve within Measured against these definitions, the problem statement was formulated that the aims and objectives of probation service programmes would not meet the required standards. The point of departure was that programme formulators give inadequate attention to the components of aims and objectives. Furthermore, the general types of formulated aims and objectives were determined, as well as the preferred levels of objectives. The research included a study of the literature and archival sources and the completion of questionnaires in order to undertake an empirical investigation in which aims and objectives were evaluated and a model was drawn up for them. It is stressed that the history of probation services in the Republic of South Africa; the policy as it is laid down in the various Acts, particularly; and the formulated probation service programmes

Korrektiewe toesig is 'n vonnisopsie wat oortreders binne die gemeenskap rebabiliteer. 'n Literatuurstudie oor die ontwikkeling van korrektiewe toesig in verskillende wereldlande is ingestel asook die wetlike ontstaan en praktiese toepassing in Suid-Afrika. Korrektiewe toesig is met deeglike navorsing deur die Krugel-Werkgroep vooraf gegaan. Die Witskrif rakende die Departement van Korrektiewe Dienste wat op navorsing gevolg bet, is gedurende Mei 1991 in die parlement van Suid-Afrika ter tafel gele. Parlementsdebatte is gevolg deur wetswysigings van onder andere die Strafproseswet, 1977 en die Wet op Gevangenisse, 1959. Eenstemmigheid het genoemde parlementsitting gekenmerk wat gevolg het tot die instelling van korrektiewe toesig. Korrektiewe toesig soos deur die Departement van Korrektiewe Dienste toegepas word, is ondersoek maar veral die funksionering van huisarres, monitering en gemeenskapsdiens. Correctional supervision is a sentencing option aimed at rehabilitating offenders within community context. This research will focus on the development of correctional supervision in differnt countries around the world inclusive of South Africa. The implementation of correctional supervision in South Africa was precede by research done by the Kriigel Commission. In May 1991 a White paper was tabled in Parliament regarding the broadening of the mission of the Department of Correctional Services. Much debate in Parliament resulted in amendments to inter alia the Criminal Procedures Act, 1977 and the Prisons Act, 1959. In this thesis the application of cor!'ectional supervision as redered by the Department of Correctional Services is investigated with special reference to house arrest, monitoring and community service. Assessment and promotion from maximum intensive to medium intensive and to minimum intensive supervision are also looked at. Assessment methods and other criteria in the States of Georgia and Wisconsin in the United States of America are investigated in order to propose classification categories for the selection of offenders. A quantified decision-making approach to probation in South Africa

Quantified decision-making refers to the scaling of factors such as crime seriousness, risk assessment, violation severity, and punitive responses or intensity of surveillance. As such, it is largely based on the justice principle, according to which the punitive response should be commensurate with the crime committed. This study consequently looks at the applicability of a retributive stance towards probation, and suggests a quantified, or structured, approach to decision-making in probation with special reference to the South African situation. Referring to historical and ideological precedents, it is maintained that the current crisis in corrections - referring to the congestion of prison facilities and the negative spin-offs related to it - can, to a large extent, be ascribed to an over reliance on imprisonment as a sentencing option. It is argued that imprisonment can be seen as a failure in terms of both its basic motives, and more importantly, with regard to its unintended consequences, necessitating a search for viable sentencing alternatives. With regard to probation, and Intensive Supervision Probation (ISP) in particular, this study recognizes its limitations, but maintains that probation still holds the greatest potential as a workable alternative to incarceration. In view of South African corrections, that is plagued by prison overcrowding, on the one hand, and certain structural shortcomings, on the other, a structured probation system is proposed that will evade the weaknesses of subjective decisionmaking, which often act to intensify the crisis. It is proposed that quantified decision-making tools be developed that will replace both sentencing and revocation decisions. An exploration of family group conferencing as part of the diversion experience of young male offenders

The aim of this study is to explore the experiences and evaluations of young male offenders who were diverted to family group conferencing in order to improve current services. An exploratory research design was chosen to obtain an understanding of what these young male offenders experienced during their conferencing and also to seek out their recommendations for future improvement of the family group conferencing diversion programme. This study comprised two samples which were purposively selected. The first sample was made up of ten young male offenders and the second sample comprised of the parents and /or guardians of the young male offenders. The data was collected using structured interview schedules. The data was collected on separate occasions for the two samples. Each interview lasted about 30- 40 minutes each. The findings of this study showed that there is still a need to train probation officers on appropriate implementation of family group conferencing and that families also have a role to play towards succefull implementation of diversion programmes. It is evident from the findings that young offenders need their families to support and care for them during difficult situations, as purported by the systems theory whereby society is regarded as a system with different parts and families are an important part of this system. Young offenders belong to families and families are part of communities and society. It is also important to note that victims are part of families, thus also part of society and the system. Family group conferencing provide an opportunity for all these parts to meet in a mediated environment to address the harm caused and make amends. The findings of this study also showed that there is a need to educate the general public about child justice legislation and the emerging trends in the field of child justice including diversion programmes.

Text in Afrikaans / Gevangenis oorbevolking is ʼn probleem waarmee die Suid-Afrikaanse korrektiewe stelsel reeds vir baie jare worstel. Suid-Afrika is een van die lande met die hoogste gevangenis bevolking in die wêreld. Een van die grootste probleme wat tot die situasie bydra, is die aantal oortreders wat nie in staat is om borg te betaal nie. ʼn Ander probleem is die aantal verhoorafwagtendes wat in aanhouding is. Die Suid-Afrikaanse Witskrif van die Departement van Korrektiewe Dienste, is vasberade om die rehabilitering van die oortreder te bevorder. Die fokus van die studie wentel om die rehabilitasie van die oortreder en die vraag of hierdie doelwit binne die korrektiewe stelsel haalbaar is. Heelwat klem word op die noodsaaklikheid van alternatiewe vonnisse geplaas asook rehabilitasie as strafoogmerk tydens vonnisoplegging. The role of correctional supervision in curbing overpopulation in prisons

The aim of this dissertation is to place the phenomenon of the overpopulation of South African prisons in perspective and to rectify the current situation in search of possible solutions. Since 1981, when this phenomenon reached unmanageable proportions, government has made numerous amnesties. This was only a short-term alleviation of the problem due to the high levels of recidivism. Correctional supervision as a sentence option was advocated by both the Lansdowne and Viljoen Commissions, enacted during 1986 and finally implemented during 1991. Initial expectations soon became blurred by factors such as insufficient development programmes and specialised personnel, enormous caseloads and the exclusion of supervision cases from development programmes. This study endeavours to analyse the current application of correctional supervision to determine the stumbling blocks and to create a foundation for new perspectives and possible solutions. / Penology / M.A. (Penology)
