Elle ne revêt un caractère pénal que si elle est pornographique et que, soit elle représente un mineur, soit elle est susceptible d'être vue ou perçue par un mineur. La notion de pornographie doit être entendue restrictivement : elle implique nécessairement la représentation d'un acte sexuel qui inclue directement un organe sexuel, c'est-à-dire un pénis, un vagin, ou un anus. Toute autre représentation échappe à la répression, quelle que soit son utilisation. Les comportements prohibés pourront être justifiés par la liberté d'expression (érigée en fait justificatif), sans que l'image (la représentation ou le message) ne perde son caractère pornographique. Ne sera pas pénalement responsable la personne qui accomplira un des actes prohibés s'il existe un caractère artistique ou scientifique ou une information légitime du public. / Any sexuality's image isn't a criminal offense. It's criminal only if it's pornographic and if, either it represents a minor, or it may be seen or viewed by minors. The notion of pornography should be understood narrowly: it necessarily involve the representation of a sexual act that includes a direct sexual organ, that is to say a penis, a vagina, or anus. Other representation escapes punishment, regardless of its use. The prohibited act may be justified by the freedom of expression (set up in justificatory fact) without that the image (representation or message) loses its pornographic nature.
