Ao todo são analisadas quatro variáveis para responder à pergunta sobre qual é o fator determinante sobre a eficácia de um sistema nacional de proteção à propriedade intelectual. Os resultados da pesquisa revelam que, entre os dois casos escolhidos, a resposta não está na adesão ao regime internacional de propriedade intelectual, nas condições sócio-econômicas do país nem nos valores culturais prevalecentes entre os membros da sociedade, mas na estrutura institucional desenhada para a proteção da propriedade intelectual. Descobriu-se que o modo de implementação das normas de propriedade intelectual é fundamental para a proteção eficaz dos direitos. _________________________________________________________________________________ ABSTRACT / This thesis is a comparative study between the protection of intellectual property rights in India and South Africa. Four variables are researched to answer which one is determinant to the effective protection of intellectual property rights. The results reveal that the answer to the research question, between the two cases studied, is neither in the membership to the international regime of intellectual property, nor in the socio-economic environment, nor in the cultural values of a society, but in the structural framework designed to protect intellectual property. It has been found that the enforcement of intellectual property rights is the main factor contributing to the effective protection of those rights.
