A partir do reconhecimento de que as cidades devem ser compreendidas historicamente como partes integrantes de sociedades mais abrangentes, é possível discutir a importância da vida urbana para os diferentes fenômenos sociais. A arquitetura do tecido urbano sugere a multiplicação de um repertório onde diferenciados projetos subordinam-se a lógica do plano da cidade. O estudo proposto nesta dissertação analisa o Plano Piloto apresentado para a nova capital do Brasil (Brasília) sob o ponto de vista da relação social de propriedade em sua dupla dimensão, social e espacial. São analisadas as relações estabelecidas entre o lote urbano e o conceito de propriedade nas superquadras do Plano Piloto de Brasília, sendo especificamente inquirida a natureza das Projeções. A análise teórica do Plano Piloto não se resume às palavras ditas no memorial descritivo do arquiteto e urbanista ou nas normas e regulamentações pertinentes, mas inclui a análise dos desenhos apresentados pelo autor, ou melhor, planos. São tomados os planos não como mera ilustração, pois desempenham papel protagonista num projeto de arquitetura ou de urbanismo. _______________________________________________________________________________ ABSTRACT / Historical reflections about cities in modern ages expose planning as a recurring manifestation of power. Once cities are recognized as part of broader societies the discussion on the importance of city life to other different social phenomenon is raised up. Arquitecture of the urban tissue suggests the multiplication of a repertoir in which different plans are subordinated to the logic of the citie´s plan. This study propposal is to analyse the Pilot Plan of the New Capital of Brazil (Brasília) under the double dimension of property´s social relations, social and spacial. The exhisting connections between urban lot and the concept of property are analysed in the Superquadras of the Pilot Plan of Brasilia, specially the nature of the Projections. The theoretical analysis of the Pilot Plan goes beyond the words from it´s descriptive memmorial and the applicable regulations and laws. It includes the analysis of the author´s presented designs, taken not as mere illustrations. They are understood as essencial parts of an architectural or urban plann.

No. of bitstreams: 1 DissertaMestradoDireito-UnB.pdf: 843573 bytes, checksum: 9f9aa1338c8b916be1fe86d34d5c7c45 (MD5) Previous issue date: 2006-02 / A idéia desse trabalho, a partir da análise do caso específico, a luta dos moradores de um assentamento humano na Cidade de Brasília-DF para permanecerem na terra e conquistarem o direito à moradia digna - a chamada “Ocupação da Estrutural” - é estudar a aplicação do princípio da função social da propriedade às políticas de regularização fundiária desenvolvidas pelo Estado e governos do Brasil, diante dos graves problemas representando pela insegurança jurídica da posse e pela precariedade de milhões de moradias nas periferias das cidades brasileiras. Para tanto, examina-se criticamente o desenvolvimento da dogmática legal da propriedade da terra nas Constituições e na legislação brasileira ao longo da formação do sistema fundiário nacional, assim como o planejamento e construção de Brasília e a forma como foi distribuído o solo urbano na nova Capital do Brasil. Tudo, a partir do novo tratamento dado à política habitacional na Constituição Federal de 1988, que trouxe um capítulo específico sobre desenvolvimento urbano, reafirmando o princípio da função social da propriedade, a ser lido a partir de um novo paradigma: o “Estado Democrático de Direito”. _________________________________________________________________________________ ABSTRACT / The idea of this work starts from specific case, the fight of citizens of a urban ghetto, in the city of Brasília – DF. To stay in their land, and conquest his rights to live in that place – the Occupation of Estrutural - is to study the application of the social functions principles in politics of land regularization development by the State and Government of Brazil. We begins in the path of the construction of the modern knowledge and of the illuminated ideals that helped to base politics and ideology the State and the Modern right, is made the exam of the "theoretical" creation of the property right. For so much the transformation of the property right is analyzed along the transformations of the Modern Constitutional State in the center and in Brazil, along his/her development, whose mark of the slavery and of the great properties, they cannot be inconsiderate. Data for analysis are looked for an area of urban occupation close to in Federal district, area this known as Structural. A dogmatic one legal of the property of the earth in the Brazilian Constitutions of 1988 it is identified and the beginning of the social function of the urban property is analyzed being emphasized the paper of the State in the resignation of the urban space.
