Diploma thesis: Legal regulation of protection of animals against cruelty This diploma thesis deals with national and transnational legal regulation of the protection of animals against cruelty. It comprises of four chapters. First chapter concerns ethical grounds of given issue and it provides analysis of term "animal welfare". Second chapter contains the most significant transnational legal rules of the protection of animals against cruelty adopted within the Council of Europe or the European Union. Third chapter includes national legal rules. It defines basic terminology, determines fundamental principles and considers certain sections on the basis of classification of animals according to the Act on Protection of Animals against Cruelty, No. 246/1992 Coll. It summarises sanction legal options and related practice. The last fourth chapter describes legal regulation of this sfere in Ireland, particularly with emphasis on newly passed Animal Health and Welfare Act 2013.

Legal regulation of animal testing The diploma thesis is analyzing current legislation in the field of animal experiments. It is formed by five chapters and each chapter is concerned with different aspects of animal protection, when focusing on experimental animals in particular. The first chapter is divided into three subchapters and it is successively describing development of animal experiments, progress of legislation dealing with animal protection and experimental animal protection on the international and European level, when analyzed is also Czech legislation in the last subchapter. Second chapter is focused on the basic legal sources and its legal foundation. It has four subchapters, when every subchapter explains relevant terms, which are being formulated in the experimental animal protection law. This chapter of the diploma thesis also involves sections dedicated to experiments and alternative methods of the experiments. 1 Abstract Diploma thesis: Legal regulation of the treatment of animals under human care This diploma thesis deals with legal regulation of the treatment of animals under human care at the national, international and European Union levels. It is systematically divided into four main chapters. The first chapter deals with the definition of relevant animal protection concepts, in particular defines the difference between the concepts of animal, creature and wildlife, it also gives an overview of further categorization of animals such as experimental animals, farm animals, animals breed for hobby, handicapped animals, animals that need special care from human, wandering and deserted animals. In my second chapter, I attempted to outline the relationship between national and international law. Firstly is the diploma thesis devoted to presents five most important agreements adopted within Council of Europeat international level, then mentions the Universal Declaration for protection of animals adopted within the United Nations organizations. Advantages and risks of introducing animal legal personality into Czech law system The topic of my thesis is animal legal personality and consideration of advantages as well as negative aspects of introducing it into the Czech law. The aim of this work is to examine whether the animal legal personality is a solution that could lead to higher animal protection. In order to assess the benefits and risks of introducing legal personality of animals, I analyze the current legal status and investigate whether animals have any rights today. Furthermore, I concentrate on whether the integration of the legal personality of the animals into the legal system is at all possible, and seek such form that would make the integration acceptable. The work is divided into six chapters. In the first chapter I examine the history of the legal protection of animals with a focus on its development in the Czech lands. The second chapter is a summary of current legislation of animal rights, especially in the Czech Republic but also in other European countries. Legal regulation of experimental animals handling This thesis deals with the legal regulation of experimental animals handling and their protection in international law, European union law and national law. Its goal is to complexly capture current legislation in this field, point out unsystematic or otherwise unsuitable institutes and propose means of their change. The core of the thesis is a description and an analysis of relevant parts of the Act on Animal Protection Against Cruelty, directives and regulations of the European Union and international treaties. This diploma thesis deals with legal regulation of the treatment of animals under human care. It provides a comprehensive overview of international legislation, European legislation and also Czech laws. On the international level it describes fundamental conventions of the Council of Europe. On the level of European Union this thesis does not omit primary law of the European Union, secondary legislation as well as conceptual tools. On the national level it tries to outline the key regulations governing the treatment of animals. Next it deals with definition of an animal, creature and wildlife, and categorizations of animals. It also also includes a civil nature of the animal. The major Czech law governing the main ways of dealing with animals in captivity this thesis describes the act no. 246/1992 Coll., On Protection of Animals against Cruelty. After defining possible ways of the treatment it does not forget to acquaint with the possible torts for breach of the requirements for the protection of animals, including act no. 40/2009 Coll., The Criminal Code. This diploma thesis entitled Legal protection of farm animals against cruelty aims to provide comprehensive overview of legal provisions for the protection of farm animals, authorities providing this protection and historical bases of the way humans interact with animals. The thesis has 7 chapters. The first chapter defines the key terms for this work, animals and farm animals. The second charter pursues the development of the human-animal relationship and philosophical, religious and other influences affecting this relationship. The third chapter gives an overview of the first legislation dealing with animal cruelty. We can find International treaties and European Union law on the protection of farm animals against cruelty in the fourth charter. Then the thesis focuses on the current Czech legislation, the individual areas of animal treatment regulated by law and in particular the Act no. 246/1992 Coll., On protection of animals against cruelty. The sixth chapter defines the scope of the individual animal protection authorities and finally it provils the overview of the possibilities of sanctions imposed on persons in order to protect farm animals.

Magistro baigiamojo darbo objektas – baudžiamosios atsakomybės už žiaurų elgesį su gyvūnais samprata ir teisinis reglamentavimas Lietuvos ir užsienio įstatymuose bei teismų praktikoje. Magistro baigiamajame darbe apžvelgiama gyvūnų apsaugos įstatymų ir žiauraus elgesio su gyvūnais kriminalizavimo istorinė raida. Analizuojami pasirinktų užsienio šalių (JAV, Rusijos Federacijos, Vokietijos Federacijos ir Europos Sąjungos) teisės aktai numatantys baudžiamąją atsakomybę už žiaurų elgesį su gyvūnais, aptariamos tų šalių teisinės bazės spragos. Darbe nagrinėjami šiuo metu Lietuvoje galiojantys ir gyvūnų gerovę reglamentuojantys įstatymai ir tarptautinės sutartys. Atliekama detali LR Baudžiamojo kodekso 310 straipsnio, numatančio baudžiamąją atsakomybę už žiaurų elgesį su gyvūnais sudėties sisteminė analizė. Pasitelkiant teismų praktikos pavyzdžius loginio-analitinio ir lingvistinio (verbalinio) teisės aiškinimo metodų pagalba išryškinami šios teisės normos dispozicijos trūkumai ir pateikiami pasiūlymai kaip tuos trūkumus būtų galima pašalinti. Pateikiami pamąstymai ir pasiūlymai gyvūnų numarinimo (eutanazijos) problemos sprendimui bei nagrinėjamos LR Gyvūnų gerovės ir apsaugos įstatymo projekto nuostatos reglamentuojančios žiauraus elgesio su gyvūnais sampratą. Įvertinus šiame darbe formuluojamos problemos aspektus ginama hipotezė, kad dėl nepakankamai detalios teisinės reglamentacijos kyla praktinių baudžiamosios teisės normų taikymo už žiaurų elgesį su gyvūnais problemų. / Subject of Master's thesis is the criminal responsibility for cruelty to animals and the concept of legal regulation in the Lithuanian and foreign laws, and in court practice too. The Master's thesis gives the historical review of evolution of criminalization of the legislation on protection of animals and ill treatment of them. In the Thesis the analysis of legal acts of selected foreign countries (USA, Russia, Germany and European Union) is made. Are analyzed the legal acts providing criminal sanction for ill treatment of animals, and are discussed the gaps of legal base of mentioned countries. In the Master's thesis the laws existing now in Lithuania and also international treaties which regulate welfare of animals are considered. It is made the detailed analysis of the contents of the Article 310 of the Criminal code of the Republic of Lithuanian, which provides the criminal responsibility for cruelty to animals. On examples of court practice by means of analytical and verbal methods of statutory interpretation of rules of law the shortcomings of a disposition of this legal norm come to light, and also ways of their emendation are offered.
