No. of bitstreams: 1 2012_CleomirtesSocorroJosePires.pdf: 2175537 bytes, checksum: a197707dc24604401503084504d8992a (MD5) / É proposta deste trabalho o levantamento das áreas de Reserva Legal (RL) existentes no Município de Formosa-GO, verificando se foram devidamente delimitadas e averbadas no Cartório de Registro de Imóveis, em conformidade com o que estabelece o Código Florestal Brasileiro, analisando o estado de preservação das áreas que foram legalmente constituídas. Foi realizada abordagem referente à proteção das florestas no Código Florestal Brasileiro sob a ótica e a análise histórica, legislativa, conceitual, e da aplicabilidade, à instituição e à obrigatoriedade de recomposição e à responsabilidade do proprietário quanto à recuperação no interior da propriedade rural ou posse. Oportuna também foi a inserção do contexto das discussões acerca das alterações do Código Florestal Brasileiro que já passou pela Câmara dos Deputados e pelo Senado Federal e retornou à Câmara e a qualquer momento pode ser votado para posteriormente ser encaminhado à presidência da República. Pretende-se, ainda, ampliar o debate em torno do instituto, como instrumento de preservação da vegetação nativa regional, questionando se esta ferramenta está sendo efetiva e se vem alcançando o objetivo proposto, qual seja, o de contribuir para a sustentabilidade econômica e ambiental da propriedade rural. E, por fim, esse estudo sugere o desenvolvimento de políticas públicas para o setor e programas a exemplo do Pagamento por Serviço Ambiental (PSA), destinados a incentivar o produtor rural a recuperar as áreas de RL e a assegurar a melhoria econômica e ambiental como um todo. ______________________________________________________________________________ ABSTRACT / This work aims at surveying the Legal Nature Reserve areas existing in Formosa, a municipality located in the State of Goiás (Central Brazil), verifying if they were properly delimited and communicated to the Registry of Real State, in accordance with what is established by the Brazilian Forest Code, analyzing the state of preservation of the areas that were legally constituted. An approach was made referring to the protection of forests in the Brazilian Forest Code, from the perspective and the historical, legal, conceptual analyses, and its applicability, and the legal obligation of reconstitution and the owner’s responsibility towards the restoration within the rural property or land possession. Timely was also the insertion of the context of discussions regarding the changes in the Brazilian Forest Code, which has already been analyzed at the Chamber of Deputies (House of Representatives) and at the Federal Senate, returned to the Chamber and at any time might be voted and later sent to the Presidency of the Republic. Still, the intention is to increase the debate on the institute, as a preservation tool for the regional native vegetation, questioning whether this tool is effective and has achieved its objective, which is that of contributing to the economic and environmental sustainability of rural property. And, finally, this study suggests the development of public policies concerning the sector and programs such as the Payment for Environmental Services, which are destined to encourage the rural producer to recover the Legal Nature Reserve areas and ensure the economic and environmental improvement as a whole.
