Vaidotas Antanas Vaičaitis Vilniaus universitetas, Teisės fakultetas, Konstitucinės ir administracinės teisės katedra, Vilnius, 2006-05-02 Bendroji darbo apimtis 87 psl., 6 lentelės. Magistro darbo objektas yra Respublikos Prezidento apkaltos procesas, kaip konstitucinė tautos savisaugos nuo valstybės vadovo kėsinimosi į demokratines ir teisines vertybes priemonė. Magistro darbo tikslas - lyginamuoju tyrimu sistemiškai įvertinti ir atskleisti politinei ir teisinei sistemai ypač reikšmingo konstitucinio Respublikos Prezidento apkaltos instituto teorinius, praktinius, teisinius ir politinius aspektus, išryškinti stipriąsias jo puses ir, analizuojant konkrečius precedentus, aptarti probleminius apkaltos proceso aspektus. Magistro darbo uždaviniai: 1. Aptarti apkaltos instituto kilmės priežastis, raidos ypatumus užsienio valstybėse ir Lietuvoje. 2. Apibrėžti apkaltos instituto sampratą ir koncepcinius skirtumus. 3. Išanalizuoti apkaltos instituto organizacinius modelius. 4. Aptarti apkaltos proceso precedentus, išskiriant stipriąsias apkaltos instituto puses bei analizuojant probleminius aspektus. 5. Palyginti Lietuvos ir užsienio valstybių apkaltos procesų teisinį reguliavimą. 6. Charakterizuoti apkaltos proceso įtaką teisinės valstybės ir demokratinės visuomenės funkcionavimui. [toliau žr. visą tekstą] / SUMMARY IMPEACHMENT OF THE PRESIDENT OF THE REPUBLIC: A COMPARATIVE STUDY The subject of the master thesis is the process of the impeachment of the President of the Republic as a constitutional measure of national self-defence against the infringement on democratic and legal values by the head of the state. Based on the comparative research, the master thesis aims at systematically assessing and revealing the theoretical, practical, legal and political aspects of the constitutional institute of presidential impeachment bearing particular relevance to the political and legal system, demonstrating its advantages and considering the problematic aspects of the impeachment by analysing concrete precedents. The master thesis has the following tasks: 1. To discuss the reasons of origin and the evolutionary developments of the impeachment institute abroad and in Lithuania; 2. To define the concept and conceptual differences of the impeachment institute; 3. To analyse the organisational models of the impeachment institute; 4. To consider the precedents of the impeachment process by pointing out the strong sides of the impeachment institute and by analysing its problematic aspects; 5. To compare the legal regulation of the Lithuanian and foreign impeachment processes; 6. Prezidento teisinė padėtis Lietuvos Respublikoje ir Vokietijos Federacinėje Respublikoje: lyginamoji analizė / The Legal Status Of The President In The Republic Of Lithuania And In The Federal Republic In Germany: Comparative Analysis

The Presidential institution is described in the Constitution of the Republic of Lithuania (1992) as a reflection of the choise made between two types of governing systems: parliamentary democracy and presidential democracy. In the Fundamental Law of Germany (1949) the Federal President is described as a polician in a parliamentary republic. Although two different forms of goverment in both states disclose the differences of presidential institution, the similarities are also obvious. Presidential authority, established by legal acts, and its implementation into a political reality gives basis for discussions in the siciety and attempts to decide upon the role of the President of the Republic of Lithuania and the Federal President of Germany. Both formal and real roles are discussed in judicial and scientific literature. This double character of formal and real authority of both Lithuanian and German presidents forms inadequate understanding of the President as a state institution. Also there exists a problem of a judicial position of both presidents as well as aproblem of strengthening it and making it more effective. In Lithuania there are only few authors dealing with the topic of Federal President of the Federal Republic of Germany and its judicial position. There is no doubt that its historic experience and the development of constitutionalism is important to many states of Eastern Europe.
