The diploma thesis deals with legal regime of practicing tourism and sports in specially protected areas of the Czech Republic. Specially protected areas are areas with stricter protection regime of nature on specific accurately assessed flat territory. The thesis is composed of five chapters dealing with mutual relationship between sports and environmental protection, general definition of law of specially protected areas of the Czech Republic with a focus on protection tools and sports and tourism activities. Last two chapters are devoted to the pursuit of climbing in the Protected Landscape Area Jizerské hory and the National Park České Švýcarsko. This diploma thesis deals with the analysis and comparison of the legal regulation of special territorial nature protection in the Czech Republic and the State of Israel. The main aim of the diploma thesis is to provide an overview of the legal regimes pertaining to special territorial nature protection in the compared countries and to confront different legal institutes and thus draw attention to some problematic aspects of the present law. The thesis is divided into 5 chapters. The first chapter provides an introduction and is followed by the second chapter, which deals with the legal regulation of the special territorial nature protection in the Czech Republic and it is divided into five parts. The first part of the second chapter briefly introduces the historical development of establishing specially protected areas and also describes former legal regimes of the special territorial nature protection. Since national and international legal regulation in this field are closely connected, the thesis emphasises the most important international treaties in the sphere of special territorial nature conservation, including the legal framework of the European Union. The topic of this diploma thesis is legal regulation of special territorial protection of nature and landscape in the Czech republic. The diploma thesis focuses itself mainly on the legal regulation of large-scaled specially protected areas, however some room is given also to small-scaled specially protected areas and to Natura 2000 system. This diploma thesis is systematically divided into the introduction, three parts and the conclusion. The main part of this thesis is its second part. The fisrt part deals with the protection of the environment in general and its component protection (air protection, water protection, soil protection, forest protection and protection of nature and landscape), and also defines the most important terms in field of nature and landscape protection. The second part of this diploma thesis in its first chapter deals with the differentiation of the general nature and landscape protection from the special protection of nature and landscape, the division into territorial and species protection and the distinction of large-scaled and small-scaled specially protected areas. Nástroje regulace cykloturistiky ve zvláště chráněných územích / Regulatory instruments of cycloturism in specially protected areas

Cyclotourism is one of the most popular recreational activities nowadays, and specially protected areas are often chosen as a preferred destination. This thesis covers the issues that can arise from excessive tourist use of the area, or by not complying with the rules set by the law, or by an administration of the protected area. Cyclotourism has a considerate impact on the environment. The most affected components are vegetation, soil, aquatic ecosystems, and animals located near trails. Regulatory instruments of cyclotourism in specially protected areas are analysed and compared in this thesis. This analysis has covered four European countries, the Czech Republic, Slovakia, Germany, and Austria. The lowest level of restrictions was found to be present in the Czech Republic, the highest on the other hand in Austria. The degradation of the environment caused by cyclotourism is examined in the practical section of this thesis. On cycling routes in 9 specially protected areas, segments were randomly selected for sensitivity assessment... The diploma thesis "Legal regime of free-time activities in wild nature" deals with the legal regulation of individual behavior in the wild nature with respect to the protection of nature. It is based on legislation in force in the territory of the Czech Republic, mainly on the laws and implementing regulations relating to environmental protection. The diploma reflects the creation of new forms of recreation or entertainment in nature, which results in a higher burden on the environment; therefore there is a need for consistent application of legal rules. A fundamental aspect of this thesis is a summary of legal regulations of the execution of leisure activities in the wild nature followed by the review of the legislation including other possible future solutions.

O presente trabalho propõe-se a analisar a efetividade das políticas públicas de criação de unidades de conservação sob a ótica dos mecanismos de regularização fundiária de que dispõe a Lei n 9.985/00, primordiais para o alcance dos objetivos preconizados pelo Sistema Nacional de Unidades de Conservação (SNUC), sobretudo no que diz respeito às unidades de conservação de proteção integral. Para tanto, inicia-se por situar a discussão, abordando como o meio ambiente, os espaços territoriais especialmente protegidos, a propriedade e a moradia são temas que se entrelaçam no ordenamento jurídico brasileiro. Em seguida, foca-se na análise da função socioambiental da propriedade enquanto fundamento das políticas públicas de criação de espaços territoriais especialmente protegidos. Continua com a abordagem de tais espaços segundo a legislação em vigor, em particular das unidades de conservação. Concluída tal exposição, o presente trabalho adentra seu cerne, dissecando aspectos relevantes dos mecanismos dispostos pela Lei n 9.985/00 para a regularização fundiária de unidades de conservação. Assim, com base no estudo do tema, almeja confirmar a hipótese de que tais mecanismos são imprescindíveis à efetividade das políticas públicas de criação de unidades de conservação, sugerindo, tanto quanto possível, alternativas à aplicação da norma para fins de contribuir com a efetividade do SNUC. / This paper intends to analyze the effectiveness of public policies involving the creation of conservation units in view of the land regularization mechanisms provided by Law no. 9,985/00, which are essential for fulfilling the objectives established by the National System of Conservation Units (SNUC), particularly in relation to full protection conservation units. For this endeavor, this paper begins by delineating the discussion, addressing how environment, specially protected areas, property and dwelling are intertwined themes in the Brazilian law framework. Then, it focuses on analyzing the socio-environmental function of property as the foundation of public policies involving the creation of specially protected areas, also addressing current laws and regulations governing these areas, specially the conservation units framework. One this explanation is concluded, this paper advances to its core, scrutinizing relevant aspects in connection with land regularization mechanisms provided for by Law no. 9985/00. Therefore, based on these aspects, this paper seeks to confirm that these mechanisms are indispensable to the effectiveness of public policies involving the creation of conservation units, suggesting, as far as possible, alternatives to the application of regulations for purposes of contributing to the SNUC effectiveness.

The offered thesis focuses on the legal regulation of specially protected areas in the Czech Republic and the Russian Federation. The thesis' objective is to present an explicit overview of the two countries' national systems comprising protected areas from the legal point of view. The thesis includes an explanation of the basic concepts related to specially protected areas in terms of nature and landscape preservation. The author starts with a concise introduction to the issue's background, and then dwells upon constitutional principles for nature conservation, related legislation and a range of categories of specially protected areas in the two countries. The basic legislation concerning specially protected areas in the Czech Republic is the Nature and Landscape Protection Act, while in the Russian Federation that function is played by Specially Protected Natural Areas Act. The thesis includes an analysis of selected legal issues, namely issues related to legal proclamation and cancellation of the status of specially protected areas, special protection regime, state administration functions, implementation of ownership and other rights.
