Already the Federal Constitution of 1988 lifted that right to the status of fundamental social right, which transcends the effectiveness and cure of the disease is based on the joint liability of public entities for the provision of a quality service, efficient and prioritize human dignity and comprehensive evaluation of patients. According to the World Health Organization, the definition of health, first characterized as the mere absence of disease, has become recognized as the need to search for preventive mechanisms to ensure the welfare and dignity of the population. Garantista this context, the growing seem lawsuits that deal with the implementation of public policies, especially in the area of the right to health, the omission of which the Government can result in the risk of death. Hence the concern of law professionals about whether or not the intervention of the judiciary in cases that deal with providing material benefits of health care. It claims to break the principle of separation of powers, disobedience to the principle of equality and the impossibility of judicial intervention in the formulation of public policy to try and exclude the liability of public entities. In contrast, the judiciary has repeatedly guardianships granted injunctions or merit determining the supply of materials indicated by the medical benefits that accompany the treatment of patients who resort to a remedy. In this context, mediation, object of study and resolution presented in this work, is presented as an instrument conciliator between the reserve clause and the right to financially possible existential minimum, as it seeks to serve all through rationalization of health services , avoidance of negativistic influence of the pharmaceutical industry, with prioritizing the welfare of the individual and the quality of relationships. This is alternative way to judicialization that in addition to encouraging and developing active citizen participation in public policy formulation also allows the manager to public knowledge of community needs. It is in this sense that affirms and defends the right to health is no longer the mere provision of medical care and prescription drugs, but a dialogue conscious existential minimum to guarantee a dignified life / No Brasil, a Constitui??o de 1946 consagrou direito ? sa?de, tendo-a definido como a posse do melhor estado de sa?de que o indiv?duo possa atingir. De acordo com a Organiza??o Mundial da Sa?de, a defini??o de sa?de, antes caracterizada como a mera aus?ncia de doen?as, passou a ser reconhecida como a necessidade de busca por mecanismos preventivos que assegurem o bem-estar e a dignidade da popula??o. Neste contexto garantista, crescente se afiguram as demandas judiciais que versam sobre a execu??o de pol?ticas p?blicas, notadamente na ?rea do direito ? sa?de, cuja omiss?o do Poder P?blico pode ocasionar risco de morte. Da? a preocupa??o dos operadores do direito sobre a possibilidade ou n?o de interven??o do Poder Judici?rio nos lit?gios que tratam do fornecimento de presta??es materiais de assist?ncia ? sa?de. Sustenta-se a quebra do princ?pio da separa??o dos poderes, a desobedi?ncia ao princ?pio da isonomia e a impossibilidade de interven??o judicial no processo de formula??o das pol?ticas p?blicas para tentar afastar a responsabilidade dos entes p?blicos. Em contrapartida, o Judici?rio tem, reiteradamente, concedido tutelas liminares ou de m?rito determinando o fornecimento das presta??es materiais indicadas pelos m?dicos que acompanham o tratamento dos pacientes que recorrem ? tutela jurisdicional. Neste contexto, a media??o, objeto de estudo e de resolu??o apresentado neste trabalho, se apresenta como um instrumento conciliador entre a cl?usula da reserva do financeiramente poss?vel e o direito ao m?nimo existencial, na medida em que busca atender a todos mediante racionaliza??o das presta??es de sa?de, coibi??o da influ?ncia negativista da ind?stria farmac?utica, com a prioriza??o do bem-estar do indiv?duo e a qualidade das rela??es. Trata-se de meio alternativo ? judicializa??o que, al?m de estimular e desenvolver a participa??o ativa do cidad?o na formula??o de pol?ticas p?blicas, tamb?m possibilita ao gestor p?blico o conhecimento das necessidades da comunidade. ? neste sentido que se afirma e se defende que o direito ? sa?de deixou de ser a mera presta??o de assist?ncia m?dica e de prescri??o de medicamentos, mas um di?logo consciente do m?nimo existencial para a garantia de uma vida digna
