This thesis examines the relationship between justice and recovery for survivors of sexual violence in the aftermath of armed conflict. Using the case study of the International Criminal Tribunal for the former Yugoslavia (ICTY), the thesis evaluates whether international criminal justice can contribute positively to victim vindication and restoration. While the historical war crimes tribunals at Nuremberg and Tokyo have been widely criticised for exercising a “victor’s justice”, this thesis illustrates a discernible shift towards a form of “victim’s justice” that extends beyond the parameters of punishment and proportionality for serious violations of international humanitarian law (IHL). Restorative principles of justice have thus been increasingly incorporated within current international criminal jurisdictions, reflected in victim-friendly legislation at the ICTY and the recently established International Criminal Court (ICC). These developments recognise the significance of justice for victims in the aftermath of armed conflict. (For complete abstract open document)

Moterims, patyrusioms seksualinį smurtą, kreipiantis į policiją tenka susidurti su sistema, neatitinkančia jų lūkesčių. Vienas pagrindinių to atspindžių yra jų apklausos, atliekamos pareigūnų neturinčių specialaus psichologinio pasirengimo. Kriminalistikos literatūroje nurodoma, kad nors įvairių proceso dalyvių apklausa skiriasi procesiniu reglamentavimu ir taktiniais būdais, tačiau pasiruošimas jai turi bendrų bruožų. Nagrinėjama tik įprastinės apklausos taktika, kurioje nėra akcentuojami tokių subtilių bylų, kaip seksualinio prievartavimo, apklausos ypatumai.
Pagrindinis šio tyrimo objektas yra baudžiamosios bylos, nagrinėtos pagal LR BK149 išžaginimo ir 150 seksualinio prievartavimo straipsnius. Tyrimo tikslas išanalizuoti baudžiamųjų bylų praktiką Lietuvoje ir pagrindines problemas susijusias su ikiteisminio tyrimo organizavimu. Tyrimas atliktas naudojantis matematinės statistikos, lyginamosios analizės, tiesioginės apklausos, empiriniu, internetinės apklausos ir teisiniu lyginamuoju metodais.
Matematinės statistikos metodu analizuojami išstudijuotų bylų tam tikri parametrai. Dažniausiai seksualiai smurtauja anksčiau teisti už vagystes ir plėšimus; vidutiniškai 30 metų amžiaus vyrai; moterys dažniausiai nukenčia bendrų išgertuvių metu; nuo asmens, su kuriuo anksčiau buvo pažįstamos, bet lytinių santykių neturėjo; ikiteisminiai tyrimai pradedami už veikas atliktas vieno asmens; ikiteisminiai tyrimai užtrunka vidutiniškai 395 dienas; tyrimuose vidutiniškai atliekama 3,8... Usually first desperation is an interviewing with police officer, who rarely is qualified to communicate with a delicate victim. Tutorial tells common interviewing concepts, but delicate, such as sexual violence victims. The main object of this research is criminal cases of rape and sexual abuse articles. The aim of this study is analyzing the practice of criminal cases deal with female sexual violence in Lithuania the main problems associated with organizing of investigation. The study was carried out using various methods: method of mathematical statistics, comparative analysis, the direct questioning method, empirical method, online questioning method, the comparative legal method.
Mathematical statistical method is used to analyze the main parameters of cases. In most interesting results are such as:
the averaged subject is previously convicted of theft and robbery, on 30.2 years old man;
the averaged circumstances are common drinking parties ;
the averaged victim is 29,5 years old woman, who is wearing pants but skirt;
the averaged duration of pre-trial investigation is 395 days;
Comparative analysis of the method showed the strengths and weaknesses of cases: centralized investigated sexual abuse cases are more constructive and their analysis is faster and more efficient.
