A call to modernize police accountability: an evaluation of the law’s response to excess use of force by police in British Columbia

When a police officer exercises their statutory authority to use force against a member of society, and that force results in death, the public must have confidence that the police acted legitimately. The inquiry this thesis facilitates examines current police oversight law that purports to hold police accountable in circumstances of police-involved death in British Columbia. The research is motivated by two assertions: 1. The government’s response to reform the investigatory and legal processes for the determination of allegations of police-involved death is inadequate; the resulting police oversight regime is too complex, and fails to act in the public interest. 2. Oversight and law enforcement agencies limit access to the information required for families and the public to understand the circumstances of, and to fairly assess, alleged police-involved death. While this research does not anticipate a singular resolution to the complex and longstanding questions of police accountability in BC, it draws attention to an unresolved history of police un-accountability as a matter of public interest. Due to the complex nature of the legal framework, this research does not identify an exhaustive list of issues within policing law. / Graduate

Baigiamajame magistro darbe „Gero valdymo koncepcijos įgyvendinimas policijos pareigūnų veiklos valdyme: Šiaulių apskrities vyriausiojo policijos komisariato kriminalinės policijos padalinių atvejis“ yra nagrinėjamas Gero valdymo koncepcijos taikymas Lietuvos policijos pareigūnų vidaus valdyme. Šiuo darbu siekiama išanalizuoti Gero valdymo koncepcijos taikymą specifinėje viešojo sektoriaus organizacijoje – statutinėje valstybės tarnyboje – Lietuvos policijoje bei ištirti ir įvertinti Šiaulių apskrities vyriausiojo policijos komisariato kriminalinės policijos padaliniuose taikomo valdymo atitikimą Gero valdymo koncepcijai. Magistro darbą sudaro trys pagrindinės dalys, išvados, rekomendacijos, literatūros sąrašas bei priedai. Pirmojoje darbo dalyje atlikta Gero valdymo koncepcijos sisteminė analizė, kurios metu nustatyta, kad Gero valdymo koncepciją galima pritaikyti ne tik makrolygmenyje – valstybės ir savivaldos valdymo sferose, bet panaudojus šiame lygmenyje apibrėžtus principus juos pritaikyti ir mikrolygmenyje – viešojo sektoriaus organizacijos valdyme. Antrojoje dalyje pateiktos Lietuvos statutinės valstybės tarnybos veiklos valdymo ypatumų teorinės įžvalgos, išskiriant ir pabrėžiant Lietuvos policijos kriminalinės policijos padalinių valdymą. Trečiojoje dalyje pristatomi atlikto kompleksinio tyrimo, kurio metu nustatytas Šiaulių apskrities vyriausiojo policijos komisariato kriminalinės policijos padalinių valdymo atitikmens lygis Gero valdymo koncepcijai, rezultatai... [toliau žr. visą tekstą] / In the master thesis of “The Implementation of Good Governance Conception in the Operational Management of Police Officers: the Case Study of Criminal Police Departments in the Siauliai County Police Headquarters“, the application of good management concepts are being researched inside the Lithuanian Police internal management. The aim of the thesis is to analyze the application of such concepts in the specific public sector organization - statutory public service, which is Lithuanian police, as well as, to evaluate how Siauliai County Police Headquarters Criminal Police Units applies the concept of Good Governance to management compliance. Furthermore, the paper consists of three main parts: 1) Conclusions 2) Recommendations 3) References and Appendices. In the first part the concept of Good Governance revealed that it can be applied not only to the macro-level of state and local spheres of government, but to the micro-level usage of defined principles in the management of public sector organizations as well. The second part contains the theoretical insights that highlight and emphasize the Lithuanian Criminal Police Department’s management. in English The thesis deals with the liability of the members of statutory authority of a joint-stock company in antecedent legislation and in present legislation. These legislation are compared and their differences are described. Duties of a member of statutory authority (foremost duty of care), whose violation led to commencement of obligation to compensation for damage, are characterized. Specifically the thesis deals with their obligation to pay damages and their liability for damage. These relations are analyzed not only to company itself, but also in relationship to the shareholders and third persons. Thesis contains also research of claiming damages and business judgment rule.

BOARD OF DIRECTORS OF THE JOINT-STOCK COMPANY AND STATUS OF ITS MEMBERS The goal of my study is to analyse the joint-stock company, in particular the board of directors and their main duties and responsibilities. The reason for my research is my interest in company law and engaging topics related to the joint-stock company I have questioned while studying the matter. The thesis is composed of six chapters, each of them dealing with different aspects of a board of directors of joint-stock company. Chapter One is introductory and defines theoretical grounds. The chapter is subdivided into two parts. The first part outlines basic terminology used in the paper and explains the organisational structure of a joint-stock company. The second part deals with statutory models of a joint-stock company. Chapter Two describes the historical evolution of the joint-stock company. Primarily, it explains the predecessors of the joint-stock company followed by origins and development of current legal forms of joint-stock companies. Problematika oceňování církevního majetku / The issue of valuation of church property

In my thesis I tried to look into the issue of state property settlement with churches. This issue stirs public opinion in our society since the mid-nineties. The first chapter endeavours to discover the fundamental principles of the performance of the church in the past. Covering from property acquisition, through its management to the semantic role of property in general. Last but not least, it tries to describe the economic situation of the largest church in Czech Republic - Roman Catholic. The second part seeks to describe the events of nationalization of church property in February 1948, under the applicable legislation from that period. It also gives some insight into other forms of expropriation. The third chapter explore insight into the legislative process of state property settlement with churches and discusses the pros and cons of the problem in general. The fourth and fifth chapter deals with the theoretical question of valuation, valuation methods or valuation regulations. The final section summarizes the control mechanisms, which will protect the recovered property from depreciation in value.
