The goal of this diploma thesis was to discuss the issues of testamentary succession, where not only the institute of the last will and testament will be discussed, but also some other legal regulations of the succession rights, that cannot be left out while discussing the issues of testamentary succession. The presented work is devided into six chapters, where the first chapter is started with the introduction word of the author, who introduces the work and puts the reader into the problem. After this a brief digression into the past follows, showing the issues of testamentary succession in the historical context and finally, this chapter is finished with the definition of the valid legal regulation of this time. The second chapter of this work focuses on the main principles of the testamentary succession. Individual principles are named individually and analysed in details, where some of the specific declarations of these rules are explicitly pointed out not only in this chapter, but in the following ones, too. The third chapter focuses in details on individual presumptions that must be individually fullfilled, so that the succession could be possible. The law of succession is a part of civil law and its main goal is to secure the succession during generations. On somebody's decease there is come to gaining inheritance in the same point. The inheritance proceedings begin ex offo subsequently. The purpose of my thesis is to analyse the institution of testate succession. Actually there are two possibilities of inheritance succession. The first is an intestate succession and the alternative is constituted by a testate succession. Although in the Civil Code there is mentioned the intestate succession in the first place, testate succession holds the first position in practice. In fact legal heirs succeed if a deceased doesn't leave any testament. The exception is represented by forced heirs. The legal grounds to the testamentary succession there is a testament, sometimes called a will of deceased, too. It is necessary to write a testament in compliance with provisions of the Civil Code to be valid. The thesis is composed of five chapters, each of them dealing with different aspects of testate succession. Chapter One is introductory and there is also explained the historical context of testate succession. We study the behavior of diffusive Lotka-Volterra systems in environments with spatially varying carrying capacities. In particular, we use numeric and analytic techniques to study two similar models for population growth, in order to determine their qualitative differences. Additionally, we investigate competition models in the presence of periodic disasters, in order to determine what factors affect competitive dominance. We found that under conditions of high spatial heterogeneity, the model for population growth was the main factor determining coexistence. Under low spatial heterogeneity, the effect of disturbance on the stronger competitor was the main factor determining coexistence.

Spatial Patterns of Tree Invasion in an Old Field: Implications for RestorationBuschert, Karen Elizabeth January 2008 (has links)
In north-eastern North America, abandoned agricultural fields typically revert to forest after many decades of spontaneous succession. This process can be influenced in part by nearby available propagule sources and their natural patterns of dispersal. Ecological restoration encompasses understanding this natural process and how it may influence active or passive restoration efforts. This study attempts to determine the spatial and temporal patterns of establishing trees arising in an old field at 10 years post-cultivation and the implications of this process on restoration at rare and other similar sites.
The 0.8 ha field is situated at rare, an ecological reserve in Cambridge, Ontario and is bordered by forest or hedgerow on all sides. Using Environmental Monitoring and Assessment Network (EMAN) protocols, vegetation sampling was completed in the field and adjacent forest and hedgerow. A complete tree inventory was undertaken in the field, followed by a sampling of potential seed sources in the forest and hedgerow. ESRI ArcMap, a Geographic Information System (GIS) was utilized for both spatial representation and spatial analysis. Research revealed that the application of geostatistics to ecological data here and elsewhere in the literature has some specific challenges which need to be overcome for analysis of spatial data.
Currently, the old field shows early signs of woody plant invasion from the nearby forest. Both trees and shrubs have become established, though not yet dominant. The primary dispersal of these species follows spatial patterns based on method of dispersal (wind, nut, fruit and clonal) and there is a higher degree of clustering of all species closer to the forest edge. Invasive species such as Rhamnus cathartica and Rhamnus frangula have become established in the old field and may influence successional patterns. Implications for restoration include the creation of goals and objectives which incorporate these natural processes into a future management plan. Specific recommendations include:
1) Develop a management strategy for invasive species such as Rhamnus spp. which can detrimentally affect restoration goals;
2) Continue to monitor EMAN plots for the production of time-series data on the same site;
3) Identify sites with good regeneration potential based on spatial patterns identified in this research and collect additional information such as soil conditions, canopy cover, etc.;
4) Extend the current GIS database created for this thesis to become an inventory of natural and cultural features for the reserve. Advanced spatial analysis required a more extensive data set and/or custom programming.

The Silurian trilobites of the Girvan District Strathclyde region, ScotlandHowells, Yvonne January 1978 (has links)
The trilobite fauna of the Silurian successions of the Girvan area, Strathclyde Region, Scotland, is revised. Twenty eight genera (one new) belonging to the Scutelluidae, Illaenidae, Proetidae, Brachymetopidae, Aulacopleuridae, Harpetidae, Cheiruridae, Encrinuridae, Calymenidae, Phacopidae, Pterygometopidae, Lichidae and Odontopleuridae are represented, and include thirty nine named species (fifteen new), and twenty nine forms under open nomenclature. The fauna is interpreted as having occupied a shallow shelf environment. The distribution of trilobite species is compared with the shore-parallel brachiopod communities recognized in rocks of the same age in Wales and the Welsh Borderland.
