„Televizijos laidų formatų teisinės apsaugos aspektai“ – tema, analizuojama šiame magistriniame darbe. Pirmosios formatų pagrindu sukurtos televizijos laidos buvo pradėtos transliuoti dar dvidešimto amžiaus šeštajame dešimtmetyje. Nuo to laiko ženkliai išaugo tiek formatų pagrindu transliuojamų televizijos laidų skaičius, tiek jų populiarumas, o tuo pačiu ir pelnas, gaunamas iš šių laidų transliavimo. Atsižvelgiant į šias aplinkybes, televizijos laidų formatų kūrėjai bei jų pagrindu sukurtų televizijos laidų transliuotojai siekia apsaugoti televizijos laidų formatus nuo neteisėto jų naudojimo ir tokiu būdu maksimalizuoti pelną. Dėl šių priežasčių tiek užsienio teismų praktikoje, tiek užsienio teisės doktrinoje jau gana seniai analizuojama televizijos laidų formatų teisinės apsaugos problema, tačiau Lietuvos Respublikos šis klausimas dar nė karto nebuvo iškeltas. Tiek užsienio teismų praktikoje, tiek doktrinoje daugiausia diskusijų sukelia autorių teisės teikiamos apsaugos taikymas televizijos laidos formatams. Akivaizdu, jog autorių teisės normų teikiamos apsaugos taikymas televizijos laidų formatams turi įvairių privalumų - ši apsaugos rūšis taikoma vos tik sukūrus kūrinį ir galioja tam tikrą, įstatymų nustatytą laiką, nepriklausomai nuo šio kūrinio įregistravimo ar paskelbimo, turtinės autorių teisės gali būti perleistos sutarčių, testamento, dovanojimo ar kitais teisėtais pagrindais. The first TV shows based on the TV program formats have been launched in the early 1960’s. The number of TV shows based on TV program formats, their popularity and the profit has increased a lot. According to these factors, the owners of TV program formats are interested in the legal protection of these works in order to maximize their profits. Therefore the foreign case law and doctrine has been analyzing the possibilities of legal protection of TV formats for a long time and still is. However, neither Lithuanian case law, nor doctrine deals with this question. The foreign case law and doctrine usually discuss the possibilities of copyright protection of TV program formats. The advantages of copyright protection are manifold: copyright arises on creation and continues for a statutorily defined period irrespective of registration or promotion. It can be transmitted by will, licensed or, as in common law countries, also be assigned. Most importantly, copyright is governed by a number of international treaties and can easily be made the subject of international transactions.
